Clases:
Las clases son de carácter teórico-práctico, aunque predomina la práctica. La
mayor parte de la carga horaria de la asignatura (120 horas anuales) se
dedicará a la práctica, la cual le permitirá al alumno internalizar los conceptos y
aplicarlos correctamente.
En esta cátedra, se trabaja individualmente o en forma grupal de acuerdo con
el tema propuesto en cada clase, pero se enfatiza el trabajo individual, ya que
los parciales y el examen final son individuales. Se apunta a familiarizar al
alumno con situaciones en las que deberá desenvolverse solo, sin la ayuda de
sus pares, en un entorno que quizás puede generarle presión.
Tal como se mencionó anteriormente, los textos que se analizan clase a clase
abarcan diversos temas del campo del derecho que, en numerosas
oportunidades, se prestan a debate. El debate también permite que el alumno
internalice conocimiento y lo haga propio.
En esta asignatura, es de suma importancia que el alumno asista a todas las
clases. El desempeño de cada alumno es permanentemente evaluado.
EVALUACIÓN
Criterios de evaluación:
Al momento de evaluar los exámenes parciales y finales, se tendrán en cuenta
los siguientes puntos:
a. Interpretación de consignas: la interpretación de consignas es
fundamental para una resolución adecuada de los ejercicios propuestos. El
alumno debe limitarse a realizar lo que se indica en la consigna, nada más ni
nada menos.
b. Correcta realización de las actividades: la correcta realización de las
actividades está estrechamente relacionada con la correcta interpretación de
las consignas. Si las consignas se interpretan incorrectamente, las actividades
se realizarán del mismo modo.
c. Ortografía y redacción: en esta asignatura, la “palabra” (el uso correcto y
aceptable de la lengua materna) es la “herramienta” que deberá utilizarse a
diario. Todo lo que el alumno produzca debe estar redactado correctamente,
con lenguaje académico y aceptable, y con una ortografía excelente. Los
errores de ortografía y la mala redacción son eliminatorios en instancias de
trabajos prácticos, exámenes parciales y exámenes finales.
d. Presentación general del manuscrito: una correcta producción del alumno
pierde todo sentido si lo escrito es ilegible. Por ello, además de la correcta
interpretación de consignas, la correcta realización de las actividades, la buena
ortografía y la redacción se suman a la presentación general del manuscrito.
De nada sirve que la producción del alumno sea excelente si no puede leerse
y, de ese modo, aprovecharse y utilizarse para construir conocimiento.

- Todas las evaluaciones deberán ser realizadas con LAPICERA azul o negra.
NO se permite escribir con lápiz.
- Como requisito obligatorio de la cátedra, cada alumno deberá tener su propio
DICCIONARIO BILINGÜE impreso para las clases, las evaluaciones parciales y
finales. Los diccionarios NO se comparten en instancias de evaluación. No se
permite usar diccionarios electrónicos. El diccionario bilingüe es parte de la
bibliografía obligatoria de la cátedra, lo que implica que el alumno tiene la
OBLIGACIÓN de tener siempre el diccionario bilingüe, tanto para las clases
como para las instancias de exámenes.

M ost nations today follow one of two major legal traditions: common law or civil
law. The common law tradition emerged in England during the Middle Ages and was
applied within British colonies across continents. The civil law tradition developed in
continental Europe at the same time and was applied in the colonies of European impe-
rial powers such as Spain and Portugal.

Recordemos siempre que, a pesar de que un texto esté escrito en un idioma
que no conozcamos o no manejamos, no significa que carezca de sentido.

The term “ATTORNEY GENERAL” is used to refer to any person who holds a general power of
attorney to represent a principal in all matters. In the common law tradition, anyone who

govern, impact and deal with the legal interactions between different nations, their
governments, businesses and organizations, to include their rights and
responsibilities in these dealings.

Lo que debe quedar claro sobre las frases sustantivas es que nunca habrá un VERBO
CONJUGADO en su formación. Además, a pesar de existir una regla que dice que las
preposiciones y conjunciones separan frases, es importante resaltar que para los propósitos de
esta cátedra en particular, se debe trabajar con UNIDADES DE SENTIDO. Se trata de ir más allá de
la estructura de la frase, para llegar al significado y recién ahí decidir si una preposición o
conjunción separa o une frases.

This book sides with those who believe that sometimes legal institutions and legal
procedures matter as such and not merely as contingent means to realize valuable ends.
To do so, the book examines several legal institutions.
Chapter 2 examines the value of rights. Traditionally it is believed that rights are
valuable because they promote the realization of values such as autonomy. Instead the
chapter argues that the values underlying (some) rights are partially constructed by
entrenching rights. Chapter 3 shows that the value of public institutions is not grounded

Instead, some goods are intrinsically public; their value hinges on their public provision.
Chapter 5 shows that constitutional directives are not mere contingent instruments to
promote justice. In the absence of constitutional entrenchment of rights citizens live ‘at
the mercy of’ their legislatures (even if legislatures protect justice adequately). Lastly,
Chapter 6 defends judicial review on the grounds that it is an embodiment of the right to
a hearing. The book also shows that the proposed justifications resting on the view that
legal institutions and procedures matter as such account for the enduring appeal of these

Unlike most modern states, Britain does not have a codified constitution
but an unwritten one formed of Acts of Parliament, court judgments and
conventions. Professor Robert Blackburn explains this system, including
Magna Carta’s place within it, and asks whether the UK should now have a
written constitution.
For most people, especially abroad, the United Kingdom does not have a constitution
at all in the sense most commonly used around the world — a document of
fundamental importance setting out the structure of government and its relationship
with its citizens. All modern states, saving only the UK, New Zealand and Israel, have
adopted a documentary constitution of this kind, the first and most complete model
being that of the United States of America in 1788. However, in Britain we certainly say
that we have a constitution, but it is one that exists in an abstract sense comprising a
host of diverse laws, practices and conventions that have evolved over a long period of
time. The key landmark is the Bill of Rights (1689), which established the supremacy of
Parliament over the Crown following the forcible replacement of King James II (r.1685–
88) by William III (r.1689–1702) and Mary (r.1689–94) in the Glorious Revolution
(1688).
The Monarchy is one of the three components of Parliament along with Commons and
Lords. In legal theory, the Queen has absolute and judicially unchallengeable power to
refuse her assent to a Bill passed by the two Houses of Parliament. However,
convention dictates the precise opposite and in practice she automatically gives her
assent to any government Bill that has been duly passed and agreed by Parliament.
Another important convention is that government ministers must have a seat in
Parliament (and, in the case of the Prime Minister and Chancellor of the Exchequer,
specifically in the House of Commons) in order to hold office. This is a vital aspect of
what is known as the ‘Westminster system of parliamentary government’, providing a
direct form of executive responsibility and accountability to the legislature.

Rights
Children's rights are the human rights of
child.
Interpretations of children's rights range from allowing children the capacity for autonomous action to the
enforcement of children being physically, mentally and emotionally free from abuse, though what constitutes "abuse" is
a matter of debate. Other definitions include the rights to care and nurturing.
"A child is any human being below the age of eighteen years, unless under the law applicable to the child, majority is
attained earlier." According to Cornell University, a child is a person, not a subperson, and the parent has absolute
interest and possession of the child, but this is very much an American view. The term "child" does not necessarily
mean minor but can include adult children as well as adult nondependent children.
There are no definitions of other terms used to describe young people such as "adolescents", "teenagers," or "youth"
in international law, but the children's rights movement is considered distinct from the youth rights movement.
The field of children's rights spans the fields of law, politics, religion, and morality.

Abstract
Competition law (encompassing both antitrust and consumer protection) is the forgotten
stepchild of health care quality. This paper introduces readers to competition law and
policy, describes its institutional features and analytic framework, surveys the ways in
which competition law has influenced quality-based competition, and outlines some areas
in need of further development. Competition law protects the competitive process—not
individual competitors. It guides the structural features of the health care system and the

Archbishop of Canterbury and is subject to regulation by the Master of the Faculties. The
rules which affect Notaries are very similar to the rules which affect Solicitors. They must

Leandra Ramm's promising career as an opera singer fell to pieces after she
was stalked by a man half way across the world but her legal battle against
him resulted in the first successful conviction for international cyberstalking.

nothing, as the crimes were committed in Singapore. The police in Singapore
showed no interest, as the crime of cyberstalking did not exist in that jurisdiction.
There is no such thing as an international cyberstalking treaty and so Mak
continued to destroy not only Ms Ramm’s career, but also started to stalk other
women and those linked to them, in Singapore and Europe, both physically and
in cyberspace.
Eventually, Mak’s stalking cost Ramm her opera career. She contemplated
suicide and was diagnosed with post traumatic stress disorder. In 2011, when
Ramm hired a cybercrime expert, A J Fardella, things started to shift in her
favour. Mak pleaded guilty to sending Ramm 31 threatening emails and admitted
to 11 other offences, including intentional harassment, in December 2013. He
was jailed for three years. Ramm’s case is the first successful conviction of
international cyberstalking.
Police and prosecutors say that cyberstalking – the persistent use of the internet,
e-mail, social networks, instant messaging or related digital devices to annoy,
harass or threaten – is growing, and that they still lack the legal tools to combat
it. Cyberstalking falls into three main categories: direct communication, indirect
communication, which is circulated or posted online, and misrepresentation
online.
Many stalkers threaten their victims from nations without stalking laws.
Stalking has always been a highly gendered crime. It is estimated that around
80—90% of stalkers are male and 80% of victims of physical stalking are
female. More men experience cyberstalking than physical stalking, but women
remain disproportionately affected both on and offline. Victims fall into three

There has been some real progress for the victims of cyberstalking, both in
Europe and internationally. On August 1st, the Istanbul Convention became
binding in the European countries which have ratified it, meaning that there is
harmonisation of laws regarding violence against women across Europe –
including stalking. The stalking harmonisation in the Convention has been
drafted so that it is gender neutral to protect both men and women.
Johanna Nelles, head of the Violence against Women unit at the Council of
Europe, says that the Convention is highly significant. “It introduces the offence
of stalking across all countries that ratify the Convention and also stalkers can be
given a restraining order.” Fourteen countries have ratified the treaty so far (not
the UK). It does not distinguish between on and offline stalking.
The treaty came about partly because of sustained campaigning on the part of
two British charities led by survivors of stalking – Alexis Bowater, the chief
executive of the Network for Surviving Stalking, and Ann Moulds of Action
Scotland Against Stalking. Moulds says that the directive restores the voice of
the victim to the process and she has argued for countries to use Scottish stalking
law as the European template.
Another step forward is Ramm’s fledgling organisation in the US, the non-profit
Alliance Against Cybercrime. Its first project, the Ramm Initiative, focuses on
cyberstalking and attempts to tie it to cybercrime generally.
Leandra Ramm lost one career and a decade of her life. A cyberstalker tried to
destroy her. But she’s now married, with a child on the way. “This happened for
a reason,” she says. “I’m not just going to forget about the other victims because
I won my case.”

Verbos modales
Los verbos modales expresan la modalidad o matiz de una frase verbal, como
por ejemplo, obligación, posibilidad o probabilidad. Son, a su vez, verbos auxiliares que
van seguidos por verbos en infinitivo, que completan su significado. Una característica
de estos verbos es que se conjugan de la misma manera para todas las personas.
Además, carecen de la mayoría de los tiempos verbales.
Los dividiremos en dos grupos, según su significado:

Cabe destacar que en la jerga legal, los verbos modales SHALL y MAY tienen
significados y matices exclusivos para el campo jurídico. Se hará referencia a estos dos
verbos más adelante en esta sección.
Además, tal como se mencionó antes, este verbo tiene un matiz especial cuando se
encuentra en textos relativos al derecho, en los cuales se lo emplea para expresar lo
que una persona tiene permitido hacer. Por ejemplo, The Company may assign this
Agreement with prior written consent of the other party (La Compañía puede ceder el
presente Acuerdo con el consentimiento previo por escrito de la otra parte).
MIGHT: Es menos usado que los demás verbos modales e indica una posibilidad más
remota. Se traduce como podía, podría, pudiera, etc.
Además, tal como se mencionó antes, este verbo tiene un significado especial cuando
se encuentra en el ámbito jurídico. Se lo emplea para expresar lo siguiente:
- Imponer una obligación (sentido obligatorio): The debtor shall be notified of
any action taken by the bank (Se deberá notificar al deudor sobre toda medida
tomada por el banco).
- Establecer una indicación: The answer to the complaint shall be filed within 15
days as from the date of its receipt by defendant (La respuesta a la denuncia se

- Hacer referencia a un derecho o una habilitación: The defendant shall be
reimbursed for any costs incurred during the course of this legal proceeding (Se

- Expresar significado futuro: The Franchisor shall not engage in any activity
related to the Franchised Business until 2 years shall have expired as from the
date the Franchisor terminates this Agreement at his or her option (El
franquiciador no deberá participar en ninguna actividad relacionada con el
negocio franquiciado hasta que no hayan transcurrido dos años desde la fecha
en que rescinde este acuerdo o según lo decida).
First Amendment
The First Amendment guarantees freedoms concerning religion, expression,
assembly, and the right to petition. It forbids Congress from both promoting
one religion over others and also restricting an individual’s religious practices.
It guarantees freedom of expression by prohibiting Congress from restricting
the press or the rights of individuals to speak freely. It also guarantees the
right of citizens to assemble peaceably and to petition their government.
Amendment I
Congress shall make no law respecting an establishment of religion, or
prohibiting the free exercise thereof; or abridging the freedom of speech, or of
the press; or the right of the people peaceably to assemble, and to petition the
government for a redress of grievances.
Second Amendment
The Second Amendment has most recently been interpreted to grant the right
of gun ownership to individuals for purposes that include self-defense. At first
it was thought to apply only to the Federal government, but through the
mechanism of the Fourteenth Amendment, it has been applied to the states as
well.
Amendment II
A well regulated militia, being necessary to the security of a free state, the right
of the people to keep and bear arms, shall not be infringed.
Third Amendment
Described by some as “a preference for the Civilian over the Military,” the Third
Amendment forbids the forcible housing of military personnel in a citizen’s
home during peacetime and requires the process to be “prescribed by law” in
times of war. This Amendment is not considered controversial and has never
been litigated before the United States Supreme Court.

Fourth Amendment
The Fourth Amendment originally enforced the notion that “each man’s home is
his castle”, secure from unreasonable searches and seizures of property by the
government. It protects against arbitrary arrests, and is the basis of the law
regarding search warrants, stop-and-frisk, safety inspections, wiretaps, and
other forms of surveillance, as well as being central to many other criminal law
topics and to privacy law.
Amendment IV
The right of the people to be secure in their persons, houses, papers, and
effects, against unreasonable searches and seizures, shall not be violated, and
no warrants shall be issued, but upon probable cause, supported by oath or
affirmation, and particularly describing the place to be searched, and the
persons or things to be seized.
Fifth Amendment
The Fifth Amendment creates a number of rights relevant to both criminal and
civil legal proceedings. In criminal cases, the Fifth Amendment guarantees the
right to a grand jury, forbids “double jeopardy,” and protects against self-
incrimination. It also requires that “due process of law” be part of any
proceeding that denies a citizen “life, liberty or property” and requires the
government to compensate citizens when it takes private property for public
use.
Amendment V
No person shall be held to answer for a capital, or otherwise infamous crime,
unless on a presentment or indictment of a grand jury, except in cases arising
in the land or naval forces, or in the militia, when in actual service in time of
war or public danger; nor shall any person be subject for the same offense to
be twice put in jeopardy of life or limb; nor shall be compelled in any criminal
case to be a witness against himself, nor be deprived of life, liberty, or
property, without due process of law; nor shall private property be taken for
public use, without just compensation.
Sixth Amendment
The Sixth Amendment guarantees the rights of criminal defendants, including
the right to a public trial without unnecessary delay, the right to a lawyer,
the right to an impartial jury, and the right to know who your accusers areand
the nature of the charges and evidence against you. It has been most visibly
tested in a series of cases involving terrorism, but much more often figures in
cases that involve (for example) jury selection or the protection of witnesses,
including victims of sex crimes as well as witnesses in need of protection from
retaliation.
Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and
public trial, by an impartial jury of the state and district wherein the crime shall
have been committed, which district shall have been previously ascertained by
law, and to be informed of the nature and cause of the accusation; to be
confronted with the witnesses against him; to have compulsory process for
obtaining witnesses in his favor, and to have the assistance of counsel for his
defense.
Seventh Amendment
The Seventh Amendment continues a practice from English common law of
distinguishing civil claims which must be tried before a jury (absent waiver by
the parties) from claims and issues that may be heard by a judge alone. It only
governs federal civil courts and has no application to civil courts set up by the
states when those courts are hearing only disputes of state law.
Amendment VII
In suits at common law, where the value in controversy shall exceed twenty
dollars, the right of trial by jury shall be preserved, and no fact tried by a jury,
shall be otherwise reexamined in any court of the United States, than according
to the rules of the common law.
Eighth Amendment
Most often mentioned in the context of the death penalty, the Eighth
Amendment prohibits cruel and unusual punishments, but also mentions
“excessive fines” and bail. The “excessive fines” clause surfaces (among other
places) in cases of civil and criminal forfeiture, for example when property
is seized during a drug raid.
Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and
unusual punishments inflicted.

Introduction
Victoria is one of the 7 states of Australia. Currently, Australian law is
generated from three distinct yet interlocked sources. Namely, the Australian
common law, Federal laws that are enacted by the Australian Parliament and
the laws enacted by the parliaments of each of the individual 7 states.
Victoria, like all other states in Australia, is considered to be it’s own private
jurisdiction and has it’s own hierarchical system of courts. While Victorian law
can certainly influence the law in other states, it is not binding.
The legal profession in Victoria is split into solicitors and barristers. In addition
to the education that is required to enter the profession as a solicitor, there is
further training that is required to enter practice as a barrister in Victoria.

Victorian Supreme Court and practice law in Victoria must also complete one

In order to be eligible to apply as an articled clerk in a law firm, many firms will
require students to do a summer clerkship with the firm in their penultimate
year. Most firms offer clerkships that run for four weeks either during the
November-February or during June/July.

Mutual Recognition
Only legal practitioners from other Australian states or from New Zealand fall
under Victoria’s Mutual recognition program and are exempt from undertaking

Controversial new anti-terrorism laws were passed by China, saying they are
needed to combat growing threats.
The new laws were passed on Sunday by China's legislature. These laws create a new
anti-terror agency and security forces with significant powers.
Critics say the laws are too broad and can be used against dissidents and religious
minorities.
China has blamed Muslim Uighur separatists from Xinjiang for several public attacks in
recent years.
Last week, warnings for foreigners were issued by several Western governments in
Beijing's Sanlitun neighbourhood citing intelligence of a possible threat there.
AFP. One of the more prominent public attacks China has seen in recent years was
the 1 March 2014 knife attack at a Kunming train station
Under the new law, China will have a single counter-terrorism body which the country's
public security ministry says "will be in charge of identifying terrorist activities and
personnel, and coordinate nationwide anti-terrorist work".
The official Chinese media cited a knife attack which left 29 people dead at a train
station in 2014 as giving greater urgency to the the legislation.
The attack by four assailants was widely attributed to a Uighur group, the mainly-
Muslim minority in the western Xinjiang province.
The Chinese government is keen that the undoubtedly tough measures it takes there
are viewed as "counter-terrorism" (similar to measures taken by Western countries)
rather than as the oppression of an ethnic minority.
The law will also give the authorities greater rights to monitor private
communications. Just like in other countries, the government says this will not
infringe liberty.
Human rights groups say the laws are too broad and sweeping, and could be
used to crack down on dissidents as well as religious minorities.
Amnesty International said in March, while the laws were still being drafted, that
they have no safeguard to prevent those practicing their religion or criticise the
government from being "persecuted on broad charges related to 'terrorism' or
'extremism."
Human Rights Watch also said the laws are not in line with international
standards, and pointed out that the new agencies would have "enormous
discretionary powers".
Prominent Chinese dissident Hu Jia tweeted on Monday of the new laws: "What
it is used for is not terrorism, but rather in the name of combating terrorism, it
attacks all kinds of protests, particularly group and street protests. It creates all
kinds of emergency situations where it can monitor and severely restrict citizens
and groups."
AFP. The far western province of Xinjiang is home to a significant population of the
Muslim Uighur community in China
China has repeatedly said that it faces legitimate terror threats and that the laws
are needed to combat them. It has also denied repressing Uighurs and other
minorities.
But many of the public attacks, particularly those in Xinjiang, have been difficult
for news media to independently verify as China severely restricts foreigners'
travel into such areas and the flow of information during such incidents.
China has also said that internet freedom and intellectual property rights would
not be impinged on by its new laws.

Each state has its own separate laws that govern what types of property constitute separate
property and what types constitute marital property (often called "community property"). Upon
separation by death or divorce, the court will separate all of the marital property evenly. In order to
avoid a court deciding what happens to your property attained during your marriage, you can use a
prenuptial agreement.
Without a prenup, creditors can go after the marital property even though only one spouse is the
debtor. To avoid this, limit your debt liability in a prenuptial agreement.
If you have children from a previous relationship and you want to ensure that they inherit some of
your property, you can use a prenup.
If you have a family heirloom, family business, even a future inheritance, or other piece of
property that you want to keep in your birth family, you can specify this in your prenup.
Prenuptial agreements are only a part of ensuring that your estate plan is carried out how you see
fit. Remember, that you must also create and secure other documents such as wills and living
trusts.
Remember that your state has laws that govern who gets what in a divorce. With a prenup you can
bypass a lot of these laws by agreeing yourselves on who will get what. While some states prohibit
it, other states even allow you to decide whether you will be entitled to alimony or not. Check your
state’s law or with a family law attorney to clarify this issue when drafting the prenuptial
agreement.
There are numerous reasons for a prenuptial agreement. Below is a list of items commonly
included in prenuptial agreements:
• Separate business
• Retirement benefits
• Savings contributions
• Property distribution to the survivor, including life insurance, in the event of death
State laws restrict what can and cannot be included in prenuptial agreements. Below is a list of
things most states will not allow in prenuptial agreements:
Ever y state prohibits you from including anything illegal in your prenuptial agreement. In fact,
doing so can put the whole prenuptial document or parts of it at risk of being set aside.
A prenup cannot include child support or child custody issues. The court has the final say in
calculating child support. The court deter mines child support based on a "best interest of the
child" standard, with several factors at play. A court would never uphold a provision of a
prenuptial agreement that dealt with child support, child custody, or visitation, because these are
issues of public policy. The court retains the power to decide what is in the child’s best interest and
will not deny a child the right to financial support or the opportunity to have a relationship with a
fit parent.
This is the most commonly struck down provision by courts. A few states strictly prohibit this.
Other states look down on it and limit your ability to give up your alimony rights. Some states do
allow alimony waivers. Be sure to check with your own state’s laws.
Encourage divorce
Judges scrutinize prenuptial agreements in detail to look for anything that tends to offer a financial
incentive for divorce. If a provision can be read to encourage divorce, the court will set it aside.
Courts used to view any provision detailing how proper ty would be divided as encouraging
divorce, because society has an interest against divorce. This is why judges pay such close
attention.
A prenup cannot include personal preferences, such as who has what chores, where to spend the
holidays, whose name to use, details about child rearing, or what relationship to have with certain
relatives. Prenuptial agreements are designed to address financially based issues. Any prevision
discussing nonfinancial issues will not be upheld. Judges grow uncomfortable when they see
private domestic matters included in a contract, and will often view the document as frivolous,
striking it down. If you and your spouse do want to have an agreement about such things, do it in a
separate document, with which the court will not have the power to intervene.

California – Governor Arnold Schwarzenegger signed legislation last week that will help
prevent identity theft in California. Among the provisions, the legislation will increase the
penalties for “spam,” ban the use of equipment to make fake documents, prohibit prisoners
from accessing personal information while in work programs, and authorize the Department of
Managed Healthcare to perform criminal background checks for state employees and others
who have access to medical information.
“Identity theft is one of the fastest growing crimes in America,” said Governor Schwarzenegger.
“We must do everything we can to close the vulnerable pathways that allow thieves to steal
personal information. The effects of identity theft can be devastating and take years to recover
from.”
• SB 13 requires that the Committee for the Protection of Human Subjects at the Health
and Human Services Agency approve scientific research proposals before state agencies are
permitted to disclose personal information to be used while conducting scientific research.
• SB 158 eliminates the requirement that one provide his or her Social Security Number
on a power of attorney form and authorizes any party accepting the form to seek
identification of the agent.
• SB 460 expands existing law to prohibit any offender confined in a county facility or
any inmate confined in the California Department of Corrections and Rehabilitation (DCR),
from employment that provides access to the personal information of private individuals, by
making the provisions of law applicable regardless of the commitment offense of the inmate.
AB 361 provides that it is a misdemeanor for notaries public to willfully fail to perform the
required duties of a notary and requires the court to revoke a notary's commission if the
notary is convicted of a felony or for willfully failing to perform his or her duties. This bill also
clarifies that the crime of forgery includes falsifying an acknowledgement of a notary.
• AB 1517 would permit the Department of Managed Health Care (DMHC) to run
criminal background checks on any prospective employee whose duties would include access
to medical information. This bill also requires the DMHC to conduct criminal background
checks on any contractor, its employees, agents or subcontractors that, as a part of their
contracts with the DMHC, will have access to medical records.
This year, the Governor also increased the budget for the California Office of Privacy
Protection (COPP) by $446,000 to help protect against identity theft, including education and
outreach efforts to consumers and organizations throughout California.
Governor Schwarzenegger has consistently worked to protect public safety and expand
victims' rights in California since taking office. Specifically, he has signed legislation to
strengthen Megan's law; worked to pass Proposition 69 to expand the states DNA database;
protected the integrity of California's Three Strike's Law by defeating Proposition 66;
increased the ability of crime victims to participate in parole hearings; improved victim
restitution laws; and appointed victim advocates to statewide commissions and offices.

Even during her pregnancy, Brenda Peppers, an addict, smoked crack. Her daughter was
eventually stillborn, and Peppers — who also suffered from a condition characterized by
a breakdown of red blood cells — spent weeks in a coma.
After that trauma in 1996, Peppers never went back to drugs, but two years later,
prosecutors in her home state of South Carolina slapped her with charges of abusing
her unborn child by taking the cocaine. Now, after a guilty plea and two years'
probation, the 35-year-old is challenging the 1997 state Supreme Court ruling that
allowed prosecutors to press charges against her.
Peppers became one of about 200 women in 30 states who have been prosecuted in
recent years for "fetal abuse."
In most fetal abuse cases, women have been arrested and charged with various crimes
including possession of a controlled substance, delivering drugs to a minor, corruption
of a minor, and child abuse and neglect. Others have been charged with assault with a
deadly weapon and manslaughter.
Fetal abuse cases don't necessarily involve drug abuse. Last fall, a pregnant
Massachusetts woman was imprisoned for refusing to see a doctor on religious
grounds.
Although fetal abuse cases crop up across the nation, no state Supreme Court but South
Carolina's has upheld the conviction of a woman charged with child abuse for using
cocaine during pregnancy.
Activists on either side of the abortion debate as well as pregnant women's advocates
are closely watching the Peppers case, as it could mark a trend in how fetuses and their
mothers are treated under the law.
In hearing the case last week, South Carolina's highest court reconsidered whether a
viable fetus — it is "viable" when it can live outside the womb — should be considered a
"child" under the state's child abuse laws when its mother takes drugs while pregnant.
The hearing came just weeks after 24-year-old Regina McKnight, also from South
Carolina, became the first woman in the nation to be convicted of homicide for killing
her unborn child through drug use. She was sentenced to 12 years in prison with no
parole.
Advocates for pregnant women say the South Carolina law takes the wrong approach in
dealing with the decades-old question of how to handle pregnant women who take
drugs. Instead of taking a punitive approach that scares women away from getting help,
the state should treat pregnant drug abusers as addicts with medical problems,
advocates say.
"The word on the street is that it is much more likely that your kids will be taken away
from you if you go for help," said Susan Dunn, counsel for the South Carolina Advocates
for Pregnant Women, who said the law has kept many women from seeking drug
rehabilitation and prenatal care.
Women's advocates also say the state law targets women who are disproportionately
minority and low-income. "They're picking on a vulnerable population," Dunn said, "a
population not much inspired to fight."
Other critics of the South Carolina law say the law distorts the effect cocaine has on
unborn children.
While prenatal illegal drug use by women does have negative effects on infants, such
effects are no more severe than if the woman smoked or drank alcohol during
pregnancy, says Deborah Frank, an associate professor of pediatrics at Boston
University whose study on the matter was published in the Journal of the American
Medical Association last spring.
Punishing pregnant drug users can only risk scaring women away from seeking the care
they need, she added. "You need to help them by addressing their addictions," Frank
said. "You can't punish or terrify people out of an addiction."
Those assessments of the South Carolina law and its effects are inaccurate, says the
spokesman for the state's Attorney General Charles Condon. In reality, only a handful of

women have been prosecuted for abusing drugs while pregnant in the five years since
the law took effect, says spokesman Robb McBurney.
For those pregnant women in need of drug rehabilitation, the state's system offers help
at every step of the process, McBurney says, and only turns to prosecution when the
woman resists treatment.
"The state has a compelling interest in making sure that parent gets treatment and I
think those kids will be better off if the state takes some action," he said. "These are not
responsible people we're talking about."
Further, McBurney rejects the notion that women are afraid to come forward for
treatment out of fear that their children will be taken away.
"This has not been our experience, the horror stories that the other side draws up on
these things just don't happen," he said.
Condon was also instrumental in creating a policy in 1989 that involved testing pregnant
women for drugs at hospitals without their consent and turning the results over to
police. The program began at a time when emergency room workers were reporting
repeated cases of crack-addicted women giving birth.
Last March, the U.S. Supreme Court struck down the policy, saying it violated the
women's Fourth Amendment right against unreasonable search and seizure.

Abstract
Duty to consult and accommodate jurisprudence does not live up to the promise of
reconciliation that the Supreme Court of Canada has identified as the grand purpose of
section 35(1) of the Constitution Acts. I argue that a relational framework to the duty to
consult and accommodate would forward reconciliation between Indigenous and non-
Indigenous peoples within Canada. I suggest four bijural principles to ground this
framework: respect, recognition, reciprocity and reconciliation – all of which find
support in Canadian and Indigenous laws.
The principle of respect situates Indigenous and non-Indigenous peoples within a web
of relationships that define our identities and level of self-respect. Practical strategies
include making interdependence primary, rejecting colonial attitudes, and creating space
for Indigenous communities to foster cultural difference.
In the context of the duty to consult and accommodate, each principle points to
attitudinal shifts and concrete actions that have implications for Canadian judges and
governments. Implementing this relational framework provides a promising pathway
forward to rebuild Indigenous/non-Indigenous relationships within Canada.

Abstract
Elder mediation is a process for resolving conflicts between older adults and their families. Some
scholars have argued that older adults may be disadvantaged in elder mediation. At particular risk
are older adults who have diminished cognitive capacity or are victims of elder abuse. Older adults
in those situations may bargain away their legal rights in mediation due to having less negotiating
ability. In this thesis I examine this issue through a review of scholarly literature, laws and
policies. I identify situations where vulnerable or incapable older adults may be harmed in
mediation. I argue that elder mediators must choose an appropriate course of action in these
situations to ensure that the older adult participant is not harmed. Many of these decisions have
ethical considerations.
I then examine existing ethical codes and demonstrate that these do not provide sufficient guidance
to elder mediators in these situations. In order to fill this gap, I propose that elder mediators adopt
an ethical decision–making process. I argue that elder mediators can effectively use this ten-step
process and demonstrate how to use it in practice by applying it to a typical elder mediation
scenario.

Artículo 31º.- Se receptarán por lo menos dos (2) y no más de cuatro (4)
Pruebas Parciales por asignatura. El alumno deberá aprobar la totalidad de las
pruebas parciales, con un puntaje no inferior a cuatro (4) puntos en cada una.
Las Cátedras deberán proponer al Departamento Académico respectivo, en su
Plan Anual, el régimen y oportunidad de recuperación, para casos de alumnos
aplazados en una de aquellas Evaluaciones.

Artículo 35º.- Los Diplomas que con las formalidades correspondientes deban

persona del Egresado en Acto Público de Colación de Grados.
Excepcionalmente, y por causas debidamente justificadas, podrán
realizarse Colaciones Privadas. En cualquier supuesto, deberá
certificarse fehacientemente la entrega y la recepción, a través de
Instrumento especifico que se integre a un libro foliado.

los planes de estudio correspondientes a las carreras que se cursan en la misma, en cinco (5)
épocas o turnos durante el año calendario:
a) 1º Turno Febrero – Marzo: tres (3 )llamados
b) 2º Turno Mayo: un (1) llamado
c) 3º Turno Julio – Agosto: dos (2) llamados
d) 4º Turno Septiembre: un (1) llamado
e) 5º Turno Noviembre – Diciembre : dos (2) llamados.
Artículo 42º.- La fecha y horario de los Exámenes, serán fijados por la Secretaría
de Asuntos Académicos del Rectorado.
Artículo 44º.- En caso de ser decretado asueto o feriado el día establecido para
la constitución de una mesa examinadora, el examen se tomará el día hábil
inmediato siguiente y a la misma hora.
SEGUNDA SECCIÓN
Artículo 47º.- Las Mesas Especiales a las que hace referencia el artículo
precedente podrán solicitarse durante todo el año académico, aunque con una
posterioridad no inferior a los cinco (5) días hábiles desde la última fecha de
Exámenes del Turno ordinario inmediato anterior.

Artículo 51º.- Hasta cinco (5) días corridos antes de la fecha fijada para el
examen, cualquiera de los miembros de la Mesa Examinadora podrá ser
recusado por escrito ante el Departamento Académico o Decanato de Sede
correspondiente, explicitando las causas que justifiquen debidamente la
recusación. Esta será considerada por los Decanos de Departamentos o de
Sede, recabando, previamente, todos los datos y elementos de juicio que se
consideren necesarios. La decisión será adoptada antes de la fecha prevista
para el Examen y con carácter de irrecurrible. En caso de darse curso a la
recusación y constituirse una nueva Mesa Examinadora para el alumno
recusante, con exclusión del docente recusado, e incorporación de
reemplazante, el acto se desarrollará de acuerdo a este reglamento.
Artículo 52º.- No podrá ser causal de recusación el haber sido aplazado por el
docente recusado. En caso que el recusado fuera algún Funcionario de esta
Universidad, se procederá conforme al Manual de Procedimientos y de
Trámites Administrativos.
TERCERA SECCIÓN
EXAMENES
PRIMERA SECCIÓN
Artículo 58º.- El alumno aplazado en una fecha de exámenes, podrá rendir solo
una vez más la misma asignatura en otro llamado del mismo turno.
Artículo 59º.- Las inscripciones de los alumnos para rendir exámenes regulares
o libres se efectuarán en la respectiva Dependencia de la Secretaría de Asuntos
Académicos del Rectorado o de las Sedes, por medio documentado y/o del
Sistema SIU, en las fechas que a tal efecto se establezcan, y con una antelación
de no menos de cinco (5) días hábiles a la fecha de examen, sin contar ésta.
Artículo 60º.- La inscripción para rendir un examen, deberá realizarse
personalmente por el interesado, o en su defecto, por persona delegada con
autorización escrita. El alumno que estuviere ausente durante la fecha de
inscripción podrá presentar su solicitud por correspondencia certificada con
aviso de retorno o Carta Documento dirigida a la Secretaria de Asuntos
Académicos del Rectorado o de la Sede correspondiente. La fehaciente
constancia de su envío, servirá de Instrumento válido de Solicitud de
Inscripción.
SEGUNDA SECCIÓN
Artículo 62º.- Todos los exámenes serán públicos, bajo pena de nulidad. Antes
de iniciar el examen, la Mesa Examinadora procederá a verificar, delante de los
alumnos inscriptos presentes, que se encuentran en el bolillero todas las bolillas
del programa de examen. Asimismo, el alumno podrá solicitar al momento de
extraer bolillas que se constate la inclusión en el bolillero de todas aquellas que
correspondan al programa de examen.

PRIMERA SECCIÓN
Artículo 72º.- Las Actas de exámenes deberán ser firmadas por los alumnos
examinados, y al final de la nómina de alumnos inscriptos para rendir, por la
máxima autoridad titular o formalmente Delegada de la Secretaría de Asuntos
Académicos del Rectorado o de la Sede.
SEGUNDA SECCIÓN
Artículo 75º.- Las actas de exámenes que queden en poder de las Secretarias de
Asuntos Académicos del Rectorado o de las Sedes respectivas, serán
encuadernadas, foliadas y selladas, discriminadas por Carreras y Planes de
Estudio. Este procedimiento se efectivizará al vencimiento de año académico.
La Autoridad Interviniente dejará constancia de los libros y el número de folios
que contienen, además de las visaciones y/o controles propios de los
organismos de Supervisión o Auditación de la Universidad y/o del Ministerio
de Educación, Ciencia y Tecnología de la Nación.
TERCERA SECCIÓN
Artículo 77º.- Todas las Actas de Examen, una vez encuadernadas, quedarán
bajo custodia de la Secretaría de Asuntos Académicos del Rectorado.
SECCIÓN ÚNICA
Artículo 80º.- Para poder acceder al sistema de Promoción sin Examen Final, el
alumno, además de inscribirse específicamente, deberá tener al momento de su

Artículo 83º.- El alumno que, aunque habiendo satisfecho los demás requisitos,
no alcanzare el puntaje requerido, pero sí un promedio de cuatro (4) o más,
quedará en condiciones de Regular, debiendo rendir Examen Final en tal
modalidad. Los alumnos que no hayan alcanzado aquel promedio quedarán en
condición de Libres.
SECCIÓN ÚNICA
Artículo 87º.- A los fines de la inscripción por pase en una Carrera de esta
Universidad, los pretendientes deberán solicitar equivalencias en las
asignaturas del Plan de Estudios de aquella. Deberán asimismo haber
aprobado, como mínimo,
dos materias de las asignaturas correspondientes al Primer Año del Plan de
Estudios de la Carrera de origen.
PRIMERA SECCIÓN
Artículo 93º.- Para el caso en el que dos (2) o más asignaturas aprobadas en la
Universidad de origen, resultaren totalmente equivalentes a una (1) materia del
Plan de Estudio de esta, se consignará como calificación, el promedio del
puntaje obtenido en aquellas.
SEGUNDA SECCIÓN
Artículo 96º.- En todos los casos, la validez de las equivalencias entre las
materias ya aprobadas se regirán por las siguientes condiciones:
a) Hasta no más allá de cuatro (4) años -de la fecha de aprobación de la
asignatura en cuestión- podrá otorgarse equivalencias directas, según lo
dispuesto por la presente ordenanza.
b) Entre cuatro (4) y ocho (8) años de aquella fecha de aprobación, las
equivalencias están sujetas a ciertos requisitos que pongan en evidencia
la actualización de los contenidos específicos de la asignatura en
cuestión: Coloquios; aprobación de Trabajos Prácticos, Evaluación
parcial, etc. Dichos requisitos serán determinados, en cada caso, por los
Departamentos Académicos respectivos.
c) Con más de ocho (8) años de aquella fecha de aprobación de la
asignatura, no se otorgarán equivalencias. Para aquellos casos, que por
sus características particulares sean considerados como excepcionales, el
Departamento correspondiente, podrá disponer que sean exceptuados de
los tratamientos de los incisos b) y c) del presente artículo.
TERCERA SECCIÓN
Artículo 100º.- Las Pruebas de Complementación podrán ser rendidas una sola
vez. Si el alumno no aprobare, perderá definitivamente el derecho a la
equivalencia, debiendo en este caso quedar sujeto para su evaluación en la
Asignatura, a las demás normas respectivas de este Ordenamiento.
Las Pruebas de Complementación serán evaluadas y calificadas
según lo previsto en este Ordenamiento para los Exámenes Finales de Alumnos
Regulares.
