OBJETO DE LA TEORIA DEL
ESTADO
 1. NOCIONES PREVIAS ACERCA DEL ESTADO:
A) El hombre en la realidad social

C) El orden jurídico

D) El Estado

El primer problema que debemos resolver consiste en determinar cuál es el objeto de la materia cuyo estudio
emprendemos.

¿Cuál es la realidad del Estado?; es decir, qué cosa es el Estado?

¿Se trata sólo de una creación de la inteligencia del hombre, o por el contrario tiene una existencia real, una categoría
específica dentro del mundo del ser?
Al enunciar el Estado nos damos cuenta inmediatamente de que existe algo en la realidad a lo que se ajusta esa
demonización sentimos la presencia del Estado como algo que se encuentra en nuestra vida social. En la vida diaria
advertimos la presencia del Estado a través de sus diversas manifestaciones; continuamente hablamos e oímos hablar
del Gobierno de la autoridad de los secretarios de Estado del Ejército vemos pasar la bandera, y con frecuencia nos
tropezamos con los guardianes del orden público el Estado "nos ofrece un primer conocimiento, que podríamos llamar
vulgar de su realidad.

De acuerdo con Heller, “El Estado se nos aparece, pues de primera intención como un algo, como una realidad, como
un hacer humano incesantemente renovado“.
