EL SIGNIFICADO DE LOS TÉRMINOS JURÍDICOS EN CONTEXTO (PARTE 2)

Dobletes y tripletes en inglés jurídico

Un recurso estilístico muy característico del registro jurídico es el empleo de dobletes y tripletes,
expresiones binómicas y estructuras paralelas que confieren un sello característico a los
documentos legales, e.g., I give, devise and bequeath…, made and signed, terms and conditions.

Los cognados falsos

Pueden inducir a errores de traducción:

(a) que no afectan el significado

(b) que no tienen sentido
(c) que pueden tener implicaciones peligrosas

(a) El error no afecta el significado

1. Modificación

Toda modificación de los estatutos deberá ser aprobada por los accionistas.

NOT: “modification” but “amendment”

2. Disposición

Sin perjuicio de las disposiciones del artículo 9 del presente.

NOT: “dispositions” but “provisions”

3. Revocar
Los accionistas pueden revocar a los consejeros en cualquier momento.

NOT: “revoke” but “remove”

(b) La traducción no tiene sentido

1. Motivar

Toda decisión del tribunal debe ser motivada.

NOT: “Every decision of the court must be motivated” but “The Court must state its reasons for
every decision”

2. Celebrar un contrato

NOT: “to celebrate a contract” but “to enter into a contract”

(c)El error tiene implicaciones peligrosas

1. Ejecución

La ejecución del contrato the performance of the contract

La suscripción del contrato the execution of the contract

2. Promiscuo

El juez promiscuo decidió el asunto de hostigamiento sexual.

NOT: “promiscuous judge” but “judge with general jurisdiction” (judge with jurisdiction over
civil and criminal matters)

3. Incompetente

Un juez incompetente
NOT: “an incompetent judge” but “a judge without jurisdiction”

Preposiciones sufijadas (Deitic terms)

Uno de los rasgos distintivos del lenguaje jurídico inglés es el uso de preposiciones sufijadas que
han desaparecido casi totalmente del resto de los registros de esta lengua. Trabajando con textos
jurídicos empezarás a entrar frases como esta: With reference to the second paragraph thereof,
que en realidad significa; With reference to its second paragraph.
