Se realiza éste Contrato de Arrendamiento a Corto
Plazo entre el Sr. Drew Bonnell and Mrs. Bernice
Bonnell (“Arrendatarios”) y Sr. Jacques
Dornbierer Hogan (“Propietario/Arrendador”).
1. POLÍTICAS DE RENTA: El “Propietario” en
su carácter de dueño del inmueble denominado
CONDOMINIO DELCANTO FLAMINGOS
NUEVO VALLARTA DPTO. PH 10 D PASEO
COCOTEROS 652 SUR. NVO VALLARTA,
BAHIA DE BANDERAS NAYARIT, lugar que
designa como su domicilio para efectos del presente
Contrato; se obliga a prestar el servicio de
“Arrendamiento/Hospedaje” en favor de los
señores Sr. Drew Bonnell and Mrs. Bernice
Bonnell “Arrendatarios”.- - - - - - - - - - - - - - - - -
Se realiza éste contrato entre Los “Arrendatarios”
y el “Propietario” por una estancia de 9 días, 8
noches; Del Día 18 de Febrero 2023 al 26 de
Febrero del año 2023. - - - - - - - - - - - - - - - - - - -
El uso de la propiedad y sus instalaciones y equipo
es por el periodo específicamente determinado.
Así mismo la llegada a Delcanto deberá de ser
entre 2 a 4 pm y la salida a las 11 am como hora
máxima. La propiedad se comprende de 4
habitaciones, 4 baños, sala-comedor
completamente amueblada, cocina equipada,
estacionamiento para 1 auto, terraza privada, WIFI,
T.V, así como Aire acondicionado; los cuáles no
se garantiza que por errores en los sistemas de
control de las empresas; en los cuales nos es
imposible intervenir haya alguna complicación
técnica o error de funcionamiento. Cualquier
prorroga en la estancia estará sujeta a
disponibilidad y aceptación del propietario. - - - - -
Los “Arrendatarios” a su vez manifiestan que
están de acuerdo en iniciar la renta en buenas
condiciones en que se encuentra la unidad en
éste momento, con el inventario y fotografías
que ya se mostraron los “Arrendatarios” y que
forma parte de éste contrato. - - - - - - - - - - - - - -
2. RENTA: La Renta total será de $95,000
(noventa y cinco mil pesos 00/100 M.N). - - - - - -
Los “Arrendatarios” realizarán un primer
depósito del 80% equivalente a la cantidad de
$76,000 (setenta y seis mil pesos 00/100 M.
cuenta Bancaria de Delcanto asignada para La
Unidad en Renta con éstos datos bancarios para
transferencia Internacional:

Quedando la cantidad restante de $19,000
(diecinueve mil pesos 00/100 M.N) en Efectivo a
su llegada a Delcanto. - - - - - - - - - - - - - - - - - - -
Se requerirá de un depósito de $10,000 (diez mil
pesos 00/100 M.N.) como Depósito en Garantía,
el cual se dará de igual forma a su llegada; El
depósito será utilizado para cubrir cualquier
reparación o daño que el inmueble pueda sufrir
durante la estadía, por descuido o mal uso por
parte de “Los Arrendatarios”. En caso de que no
se presente ningún daño, el dinero será devuelto a
la fecha de salida. Para ésto, si el Cliente tiene que
retirarse antes de las 11 am, podrá dejar un
número de tarjeta para realizar el depósito
correspondiente de los $10,000 (diez mil pesos
00/100 M.N.) dentro de las 48 horas por parte del
Administrador de la Renta autorizado; para efecto
de la devolución mencionada en los párrafos
anteriores. El pago de la limpieza se encuentra
Incluida en el precio total de la renta. La limpieza
será realizada, al momento del Check out. Los
Arrendatarios tienen prohibido dejar Botellas o
Basura al momento de la Salida de la Unidad,
teniéndose que cobrar $50 cincuenta dólares si
esto acontece, así mismo, si deja trastes sucios,
directo de su depósito en Garantía. “Los
Arrendatarios” no pagan el Servicio de
Electricidad.- - - - - - - - - - - - - - - - - - - - - - - - - -
3. SERVICIOS: Con la Renta de la Unidad se
proporciona el uso de Áreas comunes, servicio de
televisión, agua, Aire acondicionado, Internet en la
Terraza. Y dentro el Condominio, Obligándose
Los Arrendatarios a respetar y aceptar el
Reglamento del Condominio. El precio total de la
renta, Incluye el servicio de electricidad. - - - - - -
4. RETRASO EN LA FECHA DE
LLEGADA: En caso de que (“Los Arrendatarios”)
llegue a la propiedad en una fecha posterior a la
estipulada en el presente contrato, no le dará
derecho a excederse a la fecha de terminación del

5. ESTACIONAMIENTO: El Arrendatario
deberá de usar solamente el área de
estacionamiento para un auto designado para el
uso del “Propietario”. Espacio PH10-D. - - - - - - -
6. BRAZALETES DE HOSPEDAJE: al
momento del “Check in” el personal de Delcanto
les proporcionarán brazaletes a cada una de las
personas que vayan a rentar la Unidad: brazaletes
que tendrán que conservar durante toda su estancia
y de los cuales los Rentistas o huéspedes tendrán
que regresar al momento del “Check Out” o pagar
la cantidad determinada por Administración por el
extravío de cada una. - - - - - - - - - - - - - - - - - - - -
7. PROCEDIMIENTO DE REGISTRO AL
LLEGAR A DELCANTO: Por Regla General,
dictada por la Administración y establecida en el
Reglamento Interno Condominal, al momento del
“Check in” El Arrendatario tendrá que
proporcionar una Tarjeta de Crédito para dejar
como Deposito de Garantía un total de $10,000
diez mil pesos, los cuales serán Cargados, durante
toda su Estadía en la Unidad correspondiente: ésto
ante la posibilidad de que hubieran daños a las áreas
de Uso Común en Condominios Delcanto. Mismo
Cargo que se liberará al momento del “Check out”.
8. CANCELACIÓN: Para el depósito inicial hay
una política de no reembolso y el dueño se quedará
con el 100% del depósito en caso de cancelación a
menos que sea con 120 días de anticipación y
notificado al Propietario. Así mismo en caso de que
El Arrendatario no pueda viajar por restricciones
derivadas al COVID-19, si avisa con la anticipación
ya mencionada se le devolverá el 100% del depósito
realizado o podrá utilizarlo para reservaciones
futuras. En el caso de que el Dueño decida Vender
o se concrete una Compraventa del inmueble
referido en el tiempo de la estadía del Arrendatario
por lo cual requieran desalojar la Unidad; el
propietario le devolverá el 100% de la cantidad
depositada o pagada al propietario por la Renta de

9. RENUNCIA DE RESPONSABILIDAD El
Arrendatario está de acuerdo que “El Propietario”
no tiene ninguna responsabilidad en caso de
accidentes, daños, robo o cualquier otro
inconveniente que sufriera en el departamento o en
el resto del edificio durante su estancia.
Renunciando desde este momento a cualquier
derecho que lo asista. - - - - - - - - - - - - - - - - - - - -
10. ARRENDATARIO: No se permite el ingreso
de Mascotas por parte de los Arrendatarios a la
Unidad, a menos que se acredite que está
Certificado como animal de servicio o de apoyo
emocional. La capacidad máxima de la unidad es de
únicamente 10 personas por esta ocasión. No está
permitido el acceso a visitantes a la propiedad sin
el previo consentimiento del “Propietario”, en
caso de violación a esta cláusula será motivo de
pérdida total del depósito en Seguridad o en

Las partes convienen en que la ejecución de éste
contrato puede llevarse a cabo separadamente
mediante la firma de cada una de las partes de
manera individual en contrapartes, que podrá ser
transmitida por cualquier medio electrónico o

El presente contrato se presenta en un formato del
contrato original en el idioma español y su
traducción al idioma inglés incluido. Dicha
traducción es una traducción de cortesía no oficial
y por lo tanto para efectos legales solamente tendrá
validez la versión el idioma español, dado en

Para cualquier asunto relacionado con la
interpretación y cumplimiento del presente
contrato, las partes se someten expresamente al
contenido del Código Civil del Estado de Nayarit,
así como a la jurisdicción y competencia de los
Tribunales de la Localidad de Nuevo Vallarta
Nayarit, renunciando a cualquier otra que les
pudiese corresponder en razón de su domicilio,

 SHORT TERM RENTAL AGREEMENT
This agreement is entered Mr. Drew Bonnell and
Mrs. Bernice Bonnell (“Tenants”) and Jacques
Dornbierer Hogan (“Owner”). - - - - - - - - - - - - -
1. PREMISES/TERM/USE: The “Owner” of the
property knows as CONDOMINIO DELCANTO
FLAMINGOS NUEVO VALLARTA, DPTMENT:
PH 10-D PASEO COCOTEROS 652 SOUTH NVO
VALLARTA, BAHIA DE BANDERAS NAYARIT,
place designated as the official address for any
legal matters related to this property for vacational
time to Mr. Drew Bonnell and Mrs. Bernice
Bonnell (“Tenants”), for the term of 9 days, 8
nights from February 18th of 2023 to February
26th of 2023.- - - - - - - - - - - - - - - - - - - - - - - - - - -
The use of the property and its premises is deemed
strictly for this period. Also the arrival to Delcanto
have to be between 2 to 4 pm and the Check Out
at 11 am as the maximum time. The Condo has 4
bedrooms, 4 bathrooms fully furnished, kitchen
equipped, and parking lot for 1 vehicle, private
terrace, WIFI, TV, as well as Air conditioning;
Which is not guaranteed by errors in the control
systems of companies; In which it is impossible for
us to intervene if there is an error of operation. Any
additional extension to the previous stay has to be
informed and have the acceptance of the owner. -
The (“Tenants”) declare here in, that they agree to
start this rental in good condition as the unit is at
this time, with the inventory and photographs that
have already been shown to them and that are part

2. RENT: The Total Rental Price will be $95,000
mexican pesos. The "Tenants" will make a first
rental deposit in the amount of $76,000 mexican
pesos in advance for the confirmation of the Rent to
the Home Owners Account in Delcanto assigned
to the Unit PH 10-D, which is:

the Remain Balance will be paid in the amount of
$19,000 mexican pesos in Cash when they arrived
to Delcanto.- - - - - - - - - - - - - - - - - - - - - - - - - - -
A deposit of $10,000 mexican pesos will be
required as a Damage Deposit, which will be given
upon arrival; the deposit will be used to cover any
repairs or damages that the property may suffer
during the stay, due to carelessness or misuse by
"The Tenants". In the event that no damage
occurs, the money will be returned on the date of
departure. For this, if the Client has to leave before
11:00 a.m., he/she may leave a credit card number
to make the corresponding deposit of five hundred
dollars within 48 hours by the authorized Rental
Manager; for the purpose of the refund mentioned
in the previous paragraphs. - - - - - - - - - - - - - - - -
Cleaning fee is included in the main Price; this
will be to leave the Condominium as it was
delivered. It is forbidden to leave Bottles or
Garbage at the time of the Unit's Exit, having to
charge $ 50 fifty dollars to the client if this happens.
It will be charged too, If they leave dirty dishes.
CFE Electric Service is included. - - - - - - - - - - -
3. SERVICES: Owner acknowledges that he has
the obligation to provide the Following services:
Common Areas, TV, Air conditioning and internet
on the Terrace service and Inside Condominium.
Tenant has the obligation to respect the
Condominium Rules. It does not include the
payment of electricity service, this is for bad
experiences that we have had for the constant use
and neglect of air conditioners; The use and
amount of energy generated remains in the hands
of the Guests during the time of their stay.- - - - - -
4. DELAY IN TENDER OF POSSESSION: If the
(“Tenants”) arrived to the Property on a later date than
the stipulated in this contract, he will not be entitled to
exceed the date of termination thereof. In case the
Tenants can’t travel because of COVID-19 restrictions,
if is notified within 120 days of anticipation, the Owner
will refund 100% of the deposit or it could be retained
for a future reservation - - - - - - - - - - - - - - - - - - - - - -
5. PARKING: Tenant shall use only those parking
spaces designated for their use by the owner PH10-
D (only one parking). - - - - - - - - - - - - - - - - - - - -
6. TENANTS BRACELETS: At the time of “Check
in” Delcanto staff will provide bracelets to each of
the people who are going to stay in the Unit:
bracelets that they will have to keep throughout
their stay and from which the Renters or guests will
have to return to the moment of “Check Out” or
pay a Sanction determined by the Administration of
Delcanto for the loss of each one. - - - - - - - - - - - -
7. REGISTRATION PROCEDURE: By General
Rule, dictated by the Administration and
established in the Internal Condo Regulations, at
the time of “Check in” the Guests will have to
provide a Credit Card to leave as a Deposit of
Guarantee a total of $ 10,000 mexican pesos, which
will be Hold, during their entire stay in the
corresponding Unit: this given the possibility that
there would be damages to the Common Use areas
in Delcanto Condominiums. Same charge that will
be unhold at the time of “Check out”.- - - - - - - - -
8. CANCELATIONS: For the initial deposit there
is a no refund policy and the owner will keep 100%
of the deposit in case of cancellation unless it is 120
days in advance and notified to the Owner.
Likewise, in the event that the Tenants cannot travel
due to restrictions derived from COVID-19, if they
notify the aforementioned in advance, 100% of the
deposit made will be returned or they can be used
for future reservations. In the event that the Owner
decides to sell or a Purchase and Sale of the
property referred to in the time of the stay of the
Tenants for which they are required to vacate the
Unit; the owner will return 100% of the amount
deposited or paid to the owner for the Rent of the

9. LIABILITY WAIVER: Tenant agrees to waive
any claim of liability against Owner for Injury or
theft that may occurs during the occupancy of this
property and the complex. - - - - - - - - - - - - - - - - -
10. TENANT TERMS: Having animals on the
property during the stay is prohibited, unless It is
certified as a service or emotional support animal.
The numbers of people allowed for this time in the
Condominium are 8 people. It is not allowed
visitors to access the property without the consent
of “Owner”, violation of tenant terms shall result
in fail forfeiture of security deposit. - - - - - - - - - - -
Both parties agree that the execution of. This
Agreement, which may follow from it, can be made
by each party signing individually in counterparts
and transmitted by way of any electronic way or

This Agreement is executed in English and Spanish,
both versions shall bind the parties and both shall
constitute one and the same agreement; provided,
however, that in case of doubt as the proper
interpretation of this agreement, the Spanish

This Agreement shall be governed by, and
construed in accordance with, the laws of the
United Mexican States, and any claim or
controversy arising there from shall be resolved
under the laws, and in the courts of jurisdiction of
Nuevo Vallarta, state Nayarit, and the parties
hereto waive any other venue to which they may be
entitled now or in the future due to nationality,
