I. INTRODUCCIÓN
a) Concepto de identidad
When we see anything to be in any place in any instant of time, we are sure (be it
what it will) that it is that very thing, and not another which at that same time exists
in another place, how like and undistinguishable soever it may be in all other
respects: and in this consists IDENTITY, when the ideas it is attributed to vary not
at all from what they were that moment wherein we consider their former existence,
and to which we compare the present1.

For we never finding, nor conceiving it possible, that two things of the same kind

Antes de ello, hay que partir del hecho de que Locke diferencia entre
substancia, hombre y persona “it being one thing to be the same SUBSTANCE,
another the same MAN, and a third the same PERSON”7.
The sound man in our mouths is the sign, is nothing else but of an animal of such
a certain form (…) For I presume it is not the idea of a thinking or rational being
alone that makes the IDEA OF A MAN in most people’s sense: but of a body, so
and so shaped, joined to it8.
The idea then we have, to which we give the GENERAL name substance, being
nothing but the supposed, but unknown, support of those qualities we find existing,
which we imagine cannot subsist SINE RE SUBSTANTE, without something to
support them, we call that support SUBSTANTIA; which, according to the true
import of the word, is, in plain English, standing under or upholding9.
[A person is] a thinking intelligent being, that has reason and reflection, and can
consider itself as itself, the same thinking thing, in different times and places;
which it does only by that consciousness which is inseparable from thinking, and,
as it seems to me, essential to it10.

For if the identity of SOUL ALONE makes the same MAN; and there be nothing
in the nature of matter why the same individual spirit may not be united to different
bodies, it will be possible that those men, living in distant ages, and of different
tempers, may have been the same man12.

In this alone consists personal identity, i.e. the sameness of a rational being: and as
far as this consciousness can be extended backwards to any past action or thought,
so far reaches the identity of that person18.

“L’introspezione si distingue pertanto dalla consapevolezza immediata o coscienza
concomitante che di necessità accompagna ogni atto psichico cosciente ch’è detto tale
precisamente per l’avvertenza che l’io ha di essere in atto di sentire, volere, pensare, ecc.:
qui si avverte unicamente come soggetto in atto rispetto ad un oggetto. Nell’introspezione
l’io diventa a un tempo soggetto e oggetto in quanto procede all’osservazione di se stesso
(Selbstbeobachtung): è quindi un processo di riflessione che suppone un certo grado di
maturità psichica ed è in questo senso che l’introspezione è stata assunta come il metodo

SELF is that conscious thinking thing, — whatever substance made up of, (whether
spiritual or material, simple or compounded, it matters not) —which is sensible or
conscious of pleasure and pain, capable of happiness or misery, and so is concerned
for itself, as far as that consciousness extends29.
III. VALORACIÓN
a) Consideraciones
Esto se expresa básicamente en dos presupuestos, que por razón del espacio
del trabajo no fundamentaremos, sino que daremos por aceptados remitiendo a
bibliografía para ello. En primer lugar, la dependencia metafísica y la
independencia existencial de los seres dotados de libertad30; y por otra parte, la
persona como:

b) Valoración metafísica-ontológica
Sin embargo, el error más grave es hacer residir la persona, que como hemos
dicho está al nivel del ser, a niveles inferiores como una facultad/operación
intelectual (forma substancial/alma) u órgano corporal como la mente
(materia/cuerpo). Ello implica que si esta facultad u órgano no se da funcionalmente
en una “persona” debe concluirse que esa “substancia individual” ha perdido su
carácter de persona, y la dignidad que se le reconoce a nivel jurídico. Es más, en
cuanto un individuo de la especia humana no tenga desarrollada dicha facultad u
órgano (feto, infante) no adquiere aún la categoría de persona.

c) Perspectiva existencial
Locke tiene una buena intuición cuando hace residir la persona en cuanto yo
en la consciencia, y su identidad en la memoria.

Por tanto, es correcto afirmar que el “yo” se forja “en el plano ontológico-
existencial del actuar, es decir, de su actividad espiritual, que es libre e
independiente”38, lo que Locke identifica, como fruto no como fundamento, en la
consciencia.

IV. CONCLUSIÓN
Desde este punto de vista confundir ambos planos, que Locke no diferencia,
tiene consecuencias gravísimas en el ámbito de la dignidad de la persona, cuyos
derechos podrían, aparentemente con una razón justa, ser gravemente violados.
Puede haber seres humanos que no sean en sí mismos un “yo” en cuanto no realizan
elecciones en su vida, no obra libremente (por incapacidad física o mental, por no
tener aún edad suficiente) pero que, de todas maneras, poseen un valor fundamental
a nivel metafísico en cuanto personas41.
