Resumen
Abstract
Through this essay we will address the problem regarding the functions of civil liability.
The judgments issued by the magistrates that contain a compensation order do not take
into account the role modeling behavior within society that they must fulfill through
these functions. In this way, we start from the assumption that the preventive and
sanctioning functions of civil liability have been applied by our judiciary in an
inadequate way.
We will use the study and review of all the academic arguments and instruments
available to analyze what is the role that today both the prevention of damage and its
eventual sanction within civil liability play.
INTRODUCCIÓN
No cabe duda que la responsabilidad civil extracontractual se configura como uno de los
sectores del Derecho Civil que más producción científica ha generado a lo largo de los
siglos, porque, pese a ser un legado que ha llegado hasta nuestros días desde su inicial
formulación en el Derecho romano, lejos de considerarse agotado en los términos de su
inicial formulación, ha experimentado continuas y profundas evoluciones, que la han
situado en el punto de mira del análisis doctrinal y jurisprudencial llevado a cabo en los
distintos momentos históricos.
Por lo que, en este caso, la obligación de indemnizar surge porque una persona causa
un daño al infringir las normas generales de respeto a los demás, pero al margen de toda
relación jurídica previa entre el causante y la víctima.
