RESUMEN
La violencia contra la mujer, al estar tan his-
tóricamente instalada y estructurada, ha re-
basado el ámbito jurídico y se ha constituido
en un fenómeno social y político. Así, ante
una circunstancia de violencia, la mujer, al
verse desprotegida por el Estado, busca, por
un instinto de supervivencia, defenderse
también con violencia. En el presente artí-
culo, la autora analiza, desde la perspectiva
de género, la manera en que los operadores
de justicia valoran la legítima defensa que
ejerce la mujer víctima de violencia. Final-
mente, indica las posibilidades que tiene la
Comisión de Justicia de Género del Poder
Judicial para abordar esta problemática.

ABSTRACT
Violence against women, being so historica-
lly installed and structured, has gone beyond
the legal sphere and has become a social and
political phenomenon. Thus, faced with a
circumstance of violence, women, finding
themselves unprotected by the State, seek,
out of survival instinct, to defend them-
selves with violence. In this article, the
author analyzes, from a gender perspective,
the way in which justice operators value
the legitimate defense exercised by women
who are victims of violence. Finally, she
indicates the possibilities that the Gender
Justice Commission of the Judiciary has to
address this problem.
