He sido informado que el Convenio sobre el Trabajo Marítimo ILO 2006 es aplicable en el buque donde voy a prestar mis
servicios, y que dicho Convenio regula las condiciones mínimas aplicables a la prestación de mis servicios a bordo.

I have been informed that ILO MARITIME LABOUR CONVENTION 2006 is applicable to the vessel where I am going to render
services, and that such Convention rules the minimum conditions applicable to my services on board.

Declaro que he sido informado sobre el contenido del Convenio sobre el Trabajo Marítimo ILO 2006, documentos que están a mi
disposición en esta oficina y en el buque.

I declare that I have been informed about the content of the ILO MARITIME CONVENTION 2006 which is available at this office
and on board.

En lo básico, he sido informado en los siguientes términos y condiciones:

In general terms, I have been duly informed about the following terms and conditions:

• Puede usted asesorarse sobre los términos y condiciones del contrato antes de su firma.
You can seek advice concerning terms and conditions for the Seafarer employment agreement before signing it.

• Puede usted asesorarse de cualquier condición especial aplicable al trabajo y de la política del armador con respecto a su
empleo.
You can seek advice on any particular condition applicable to the post and on the particular shipowner’s policy
concerning your employment.

• Está prohibido que un servicio de colocación y contratación de marinos le cobre por su contratación ni que le carguen
otros gastos, directa o indirectamente, excluyendo el costo de la obtención de un certificado médico legal nacional, la
libreta de navegación, pasaporte u otros documentos personales de viaje similares, sin incluir el coste de los visados que
correrán a cargo del armador.
It´s forbidden that a seafarers recruitment and placement service charge you any amount for providing employment or
charge you directly or indirectly any other expense, excluding the seafarer cost for obtaining a national statutory medical
certificate, the national seafarer book, passport or other similar personal travel documents, not including the Visas cost
which shall be borned by the shipowner.

• Tiene usted derecho a que se le entregue un Acuerdo de Empleo de la Gente de mar o contrato de trabajo por escrito que
debe de estar debidamente firmado, con sus datos, los datos completos del armador, el lugar de la firma, la fecha, las
funciones que desempeñará, el salario, el número de vacaciones, las prestaciones de protección de la salud y de
seguridad social de acuerdo con la Ley del estado de la bandera, su derecho a ser repatriado y las referencias a la norma
aplicable al mismo. Este Acuerdo de Empleo se le entregará con tiempo suficiente para examinarlo antes y después de
que lo haya firmado y recibirá una copia del mismo.
You are entitled to receive a written Seafarer Employment Agreement or labour contract that must be duly signed, with all
your personnel details, ship-owner details, signing place and date, capacity in which you are employed, wages, annual
leave paid, health and social protection benefits, your entitlement to be repatriated, and the reference to the applicable
law. This employment agreement will be delivered to you in adequate time to be initially examined and after signing it, you
will receive a copy of the above agreement.

• Tiene derecho a que se le entregue un estado de cuenta mensual de los pagos adeudados y sumas abonadas.
You are entitled to receive a monthly due payments account and the paid amounts.

• Tiene derecho a transferir cantidades de forma mensual a sus familiares, dependientes o beneficiarios.
You are entitled to transfer all or part of your earnings to your family, dependants or legal beneficiaries.

• Tiene derecho a designar una cuenta bancaria para el pago de su salario en tiempo.
You are entitled to nominate a bank account in which wages shall be paid on time.

• Tiene usted el derecho a las vacaciones pagadas que se establecen en la Ley aplicable al contrato.
You are entitled to paid leaves as stated at the Applicable Law.

• Tiene usted derecho a ser repatriado a costa del armador. No se puede deducir ninguna cantidad al tripulante en
concepto de coste o gastos de repatriación, excepto en el caso de que se determine que es culpable de una infracción
grave de sus obligaciones laborales.

 You are entitled to be repatriated by Owners account. Deductions of any amount owed to the seafarer on account of
repatriation costs or expenses are prohibited except in case you are found to be in serious default of your employment
obligations.

• Tiene usted derecho a ser repatriado junto con sus enseres personales
You have the right to be repatriated along with your personal belongings

• He sido informado del contenido de la cláusula A4.2.7 del CTM, 2006: Los armadores o sus representantes deberán
adoptar medidas para proteger los bienes dejados a bordo por la gente de mar enferma, lesionada o fallecida y
devolvérselos a sus parientes más próximos.
I have been informed of the contents of MLC, 2006 Standard A4.2.7: Shipowners or their representatives shall take
measures for safeguarding property left on board by sick, injured or deceased seafarers and for returning it to them or to
their next of kin.

• Tiene usted derecho a ser indemnizado por perdida del buque o naufragio, lo que puede estar limitado a dos meses de
salario.
You are entitled to a compensation for the vessel`s loss or foundering which could be limited to two months’ salary.

• Tiene usted derecho a recibir atención médica a bordo del buque y en tierra en el puerto de recalada.
You are entitled to medical assistance whether on board or ashore.

• Tiene usted derecho a recibir ayuda y apoyo material en relación con las consecuencias financieras de una enfermedad,
lesión o muerte ocurridas mientras preste servicios, incluida la repatriación de sus enseres personales.
You are entitled to material assistance and support from the shipowner with respect to the financial consequence of
sickness, injury or death occurring while serving under a seafarer´s employment agreement, including the repatriation of
your personal belongings

• Usted tiene derecho a que las solicitudes de asesoramiento o cualquier otra información solicitada por su familia sean
tratadas con rapidez, comprensión y sin costo.
You are entitled to request for advice or any other information demanded by your family, dealt promptly with
understanding and at no cost.

• Usted tiene derecho a disponer a bordo gratuitamente de una alimentación y agua potable de buena calidad y en
condiciones higiénicas reglamentadas y que tomen en consideración su origen cultural y religioso.
You are entitled to have free access onboard to good quality food and drinking water provided under regulated hygienic
conditions and take into account your cultural and religious background.

• Usted tiene derecho a acceso a una protección en materia de seguridad social, o sistema similar que sea admitido por el
estado de bandera.
You are entitled to access to social security protection, or similar system accepted by the flag state.

• Usted tiene derecho al mantenimiento del acuerdo de empleo y cobro de salaries y otras prestaciones en el caso de
cautiverio como producto de actos de robo a mano armada o pirateria contra el buque, y hasta que sea usted repatriado
You are entitle to maintain the seafarer employment agreement, wages and other benefits in case you are held captive
due to acts of piracy or armed robbery against the ship, and till you are repatriated.

• A bordo del buque cuenta usted con un procedimiento para una tramitación justa, eficaz y rápida de las quejas relativas al
Convenio del Trabajo Marítimo, 2006.
On board, there are procedures for the fair, effective and expeditious complaints proceedings concerning the Maritime
Labour Convention, 2006

• De este procedimiento se le ha entregado una copia antes de la firma del acuerdo de empleo
A copy of this procedure has been delivered to me before signing the seafarer employment agreement
