Que cabe destacar que el NCMEC es una organizacion sin fines de
lucro con sede en los Estados Unidos de America. Esta institucion ha recibido
apoyo del Congreso de los EE.UU. con el fin de construir una respuesta
mencionado, cuyo objeto consiste en definir los estandares para que este
Ministerio Publico Fiscal pueda establecer una conexion remota con la red virtual
interna privada (el "Servicio VPN") de NCMEC, con el fin especifico de descargar
antedicho, esta Fiscalia General debera descargar y/o revisar todos los Informes

articulo 1°.

Acuerdo para el Acceso Remoto a CyberTipline celebrado entre el Centro Nacional
para Ninos Desaparecidos y Explotados; y el Fiscal del Ministerio Publico de la Ciudad
de Buenos Aires, Argentina.

2896 Y depende organicamente del MPF, quien garantiza y se compromete a
cumplir funciones con probado conocimiento, competencia y autoridad, conforme
a la legislaci6n y la normativa por las que se rige dicho MPF.
• Computadora fuera de red. Siempre que sea posible, el MPF accedera a los
Informes CyberTip/ine utilizando una computadora fuera de red.
• Acceso a Internet. Se requerira que el MPF tenga una cuenta con un Proveedor
de Servicios de Internet (PSI), ya que dicha conexi6n Ie permitira acceder al
Servicio VPN.
QUINTA.
• Cargar, publicar, distribuir via correo electronico, transmitir de algun otro modo 0
publicar accesos directos 0 vinculos de acceso a material que contengan virus
informaticos, troyanos, bombas de tiempo, trampas (trap doors) 0 cualquier otro
tipo de codigo informatico, archivo 0 programa 0 pedidos reiterados de
informacion diseiiada para interrumpir, destruir 0 Iimitar la funcionalidad de
cualquier computadora 0 software 0 equipamiento de telecomunicaciones 0
datos del MPF 0, respecto del Servicio VPN, reducir su nivel de calidad,
interrumpir 0 afectar su normal rendimiento y funcionamiento.
• Utilizar el Servicio VPN para conectar una red LAN 0 cualquier otro tipo de red a
red del NCMEC.

OCTAVA.
EI MPF reconoce que cierto material e informacion que pueda lIegar a su poder 0
conocimiento en relacion con su uso del Servicio VPN puede ser de caracter
confidencial 0 de propiedad exclusiva del NCMEC ("Informacion Confidencial"). EI MPF
acuerda mantener dicha Informacion Confidencial en la mas estricta confidencialidad y
abstenerse de utilizar dicha informacion para cualquier proposito que no sea la
investigacion de delitos relacionados con la explotacion sexual de menores. Asimismo,
se compromete a revelar su contenido unicamente a personal autorizado que requiera
dicha Informacion Confidencial y abstenerse de revelarla 0 exponer su contenido a
terceros. EI MPF acepta implementar medidas de proteccion fisicas, electronicas y
administrativas para evitar el acceso no autorizado a la Informacion Confidencial.
NOVENA.
EI acceso al Servicio VPN es "como es", sin garantias de ninguna c1ase. EI NCMEC
rechaza expresamente toda garantia legal incluida, sin limitacion alguna, las garantias
de comercializacion, idoneidad para un fin en particular y no infringir en los derechos de
propiedad.

CyberTipline Remote Access Agreement executed by The National Center for Missing
and Exploited Children and the Prosecutor Public Ministry of the City of Buenos Aires,
Argentina.
This Agreement is entered by and between The National Center for Missing and
Exploited Children (hereinafter "NCMEC") represented' by Linda Krieg, with legal
domicile in 699 Prince Street, Alexandria, VA 22314, USA, and the Prosecutor Public
Ministry of the City of Buenos Aires, represented by the General Prosecutor Mr.
German Carlos Garavano, with domicile in Av. Paseo Co16n1333, 1zth Floor, Ciudad
Autonoma de Buenos Aires, Argentina, (hereinafter "MPF").
Both parties mutually agree to execute this Agreement, subject to the following:
FIRST.
SECOND.
This Agreement shall stay in effect from the date of the last signature until one of the
parties notifies the other in writing with thirty (30) days in advance, its intention to
terminate this Agreement. MPF hereby acknowledges and agrees that NCMEC has the
right to suspend MPF's access to the VPN Service, in whole or in part, at any time and
for any period of time, for any reason, including technical reasons or MPF's violation of
this Agreement.
THIRD.
• CyberTipline Reports. The MPF shall solely use the VPN Service in order to
download CyberTipline Reports and shall download CyberTipline Reports promptly
following receipt of an email notification that NCMEC has made a CyberTipline Report
accessible to the MPF. Notwithstanding the foregoing, the MPF shall download/review
all CyberTipline Reports designated as "Priority CyberTipline Reports" as quickly as
possible following receipt of a notification that NCMEC has made a Priority CyberTipline
Report accessible.

• Authorized Users. CJI agrees to designate at least one (1) dedicated personnel and
one (1) designated back-up to download CyberTipline Reports (each an "Authorized
User"). The MPF shall provide NCMEC with contact information for each Authorized
User in order for NCMEC to create login credentials. The MPF shall notify NCMEC if the
primary designee is out of the office or unavailable for any extended period of time or if
there is an anticipated delay in the downloading of CyberTipline Reports. The MPF
acknowledges and agrees that it shall be responsible for all acts and omissions of
Authorized Users, and any act or omission by an Authorized User which, if undertaken
by the MPF, would constitute a breach of this policy, shall be deemed a breach of this
Agreement by the MPF. The MPF shall undertake reasonable efforts to make all
Authorized Users aware of the provisions of this Agreement and shall cause Authorized
Users to comply with such provisions.
• Status. The MPF represents and warrants that it is an agency with demonstrated
knowledge, capability and authority under the laws and regulations governing it to
investigate and prosecute child sexual exploitation, including technology facilitated
crimes against children.
• Feedback. When possible, the MPF agrees to provide NCMEC with feedback
regarding status and/or usefulness on specific CyberTipline Reports.
• Training. Upon activation of access to the VPN Service, MPF's Authorized User will
participate in an introductory online demonstration of the CyberTipline with NCMEC
staff. Moreover, the MPF will also make the Authorized User available to learn about
any online technological updates that will impact the VPN Service or the use of the
Cyber Tipline.
FOURTH.
• Protection of Password. The MPF shall at all times use the highest industry
standards related to the protection of user names and passwords used to access the
VPN Service. Without limiting the foregoing, the MPF agrees to: (a) refrain from
disclosing passwords, PINS, or access codes, except to essential personnel, (b) use
\ reasonable workstation security measures, and (e) notify NCMEC immediately if the
'. MPF believes its password security has been compromised.

Virus Protection S~ftware. The M~F is ~esponsible for ensuring comprehe~sive vir~s
malware protection software, including upgrades and patches consistent with

industry standards, is implemented and maintained on any systems interacting with
NCMEC's VPN Service.
• Stand-alone Computer. Whenever possible, the MPF shall access the CyberTipline
Reports on a stand-alone computer.
• Internet Access. The MPF is required to maintain an account with an Internet Service
Provider (lSP). The ISP connection will enable MPF to connect to the VPN Service.
• Content. The MPF will exercise all possible precautions to minimize the exposure to
the sensitive content contained in CyberTipline Reports to personnel not directly
downloading or investigating associated leads.
FIFTH.
• Use of the VPN Service for means other than downloading the CyberTipline Reports.
• Accessing any data and/or networks to which the MPF does not have authorization to
access.
• Using or attempting to use the VPN Service after termination of this Agreement.

hardware, telecommunications equipment, or MPF data or diminishing the quality of,
interfering with the performance of, or impairing the functionality of the VPN Service.
• Use of the VPN Service to connect a LAN or other network to NCMEC's network.
SIXTH.
SEVENTH.
The MPF has no reasonable expectation of privacy in the information sent, received,
stored, transmitted to others, or accessed through NCMEC Property, regardless of
whether that information is personal or business-related. Authorized NCMEC
representatives may monitor the use of its information technology resources, including,
but limited to, MPF's use of the VPN Service. The use of NCMEC Property constitutes
consent to all the terms and conditions of this Agreement. Application of passwords or
other security measures does not in any way diminish NCMEC's right to monitor and
access materials on its systems, nor does it create any privacy rights for MPF in the
messages and files it receives, stores, or transmits via the VPN Service.
EIGHTH.
The MPF acknowledges that some of the material and information that may come into
its possession or knowledge in connection with its use of the VPN Service may be
confidential or proprietary to NCMEC ("Confidential Information"). The MPF agrees to
hold all such Confidential Information in strictest confidence and not to make any use of
such Confidential Information for any purpose other than to investigate crimes of child
sexual exploitation, to release it only to authorized employees requiring such
Confidential Information, and not to release or disclose it to any other party. The MPF
agrees to implement physical, electronic, and managerial safeguards to prevent

unauthorized access to Confidential Information.

by the MPF may result in immediate suspension of access to the VPN Service by
NCMEC or other punitive actions taken by third parties.
NINETH.
Access to the VPN service is provided "as is," with no warranties whatsoever.
NCMEC expressly disclaims to the fullest extent permitted by law all express, implied,
and statutory warranties, including, without limitation, the warranties of merchantability,
fitness for a particular purpose, and non-infringement of proprietary rights.
TENTH.
Under no circumstances shall NCMEC be liable to the MPF, any Authorized User, or
any third party on account of use or misuse of or reliance on the VPN service, arising
from any claim relating to this Agreement, including an alleged or actual breach by
Agency, or the subject matter hereof. Such limitation of liability shall apply to prevent
recovery from NCMEC of direct, indirect, incidental, consequential, special, exemplary,
and punitive damages whether such claim is based on warranty, contract, tort (including
negligence), or otherwise, (even if NCMEC has been advised of the possibility of such
damages). The MPF shall hold NCMEC and its employees harmless from all such
damages and agrees to cooperate fully with NCMEC and its legal counsel in resolving
any claims or disputes. Such limitation shall apply notwithstanding any failure of
essential purpose of any limited remedy and to the fullest extent permitted by law.
NCMEC disclaims any and all responsibility or liability for the accuracy, content,
completeness, legality, reliability, or operability or availability of information or material
displayed in or accessible through the service. NCMEC disclaims any responsibility for
the deletion, failure to store, misdelivery, or untimely delivery of any information or
material. NCMEC disclaims any responsibility for any harm resulting from downloading
or accessing any information or material on the internet through the VPN service.
ELEVENTH.
In the case of any conflict related with the interpretation or implementation of this
Agreement, the parties agree to solve and overcome it by means of direct negotiation
between both parties, i.e., MPF and NCMEC. If the parties fail to reach a satisfactory
solution, they both agree to submit themselves to an arbitration process where each
~ party will designate an arbitrator and jointly will appoint another.
