Ejemplo de Dar Bienes Inciertos Bienes
Inciertos
Luis(deudor) y María(acreedor) celebran
un contrato de compra y venta de dos
vehículos, en el contrato María como
vendedora se compromete a entregarle 2
camionetas a cambio de que Luis como el
comprador le realice un pago de 20.000
dólares. Según el art. 1142° del C.C, se
puede saber la especie y la cantidad del
bien incierto. Como podemos observar
María solo ha especificado la cantidad y la
especie mas no especificó la marca o el
estado de las camionetas, burlando a Luis
quien si tiene que pagar el dinero
acordado. Según el art. 1143° del C.C, es
de la elección de Luis aceptar el bien
incierto basándose en los criterios si no es
inferior a la media.

 Los bienes inciertos son aquellos determinados al menos en
su especie y cantidad (determinables) que pasarán a
convertirse en bienes ciertos una vez que se haya
practicado sobre ellos la “elección”, teniéndose en cuenta
que los requisitos mencionados (especie y cantidad)
deberán presentarse de manera copulativa, de lo
contrario, el acto jurídico resultará inválido por tener un
objeto jurídicamente imposible.

 Los bienes fungibles son aquellos que siempre tendrán un

reemplazo (sustituibles) en el mundo jurídico (comunes) por
lo que cuando sean objeto de una obligación (contrato)
siempre serán posibles de encontrar para cumplir la misma.
Los bienes no fungibles son aquellos que nunca tendrán un
reemplazo (insustituibles) en el mundo jurídico (únicos) por
lo que cuando sean objeto de una obligación y se
deterioren, extingan o pierdan ello dará lugar al
incumplimiento de la obligación (contrato).
