OBJETO:
ADVERTENCIAS CONCEPTUALES:
Asimismo, se asume como punto de partida que no existe una regla unificada de
carga de la prueba aplicable a todo tipo de proceso judicial, sino que existen diversas
reglas que tienen vigencia en diversos campos como el proceso civil o el penal.
Cada autor tendrá libertad de asumir estos puntos de partida o de realizar una crítica
sobre los mismos, como también proponer otras concepciones sobre la carga de la
prueba o de la flexibilización probatoria. No obstante, la temática logra unificación
cuando se tiene presente que es usual encontrar en la doctrina y la jurisprudencia
que las mencionadas formas de flexibilización probatoria implican reglas distribución
probatoria entre los justiciables.

OBJECTIVE
To invite the academic community interested in the subject to submit book chapters
for the book The Burden of Proof and the Rules of Evidential Flexibility, which
address the study of the burden of proof in relation to its objective, subjective and
practical meanings, as well as its modalities of evidential flexibility such as the
special substantive rules of liability for damages, legal presumptions or presumptions
of law, presumptions of certain fact, dynamism of evidence, among others, in
different legal fields such as civil, constitutional, criminal, labor or administrative law.

CONCEPTUAL CAVEATS:
In order to create thematic unity around the themes of burden of proof and evidential
flexibility, we start from the idea that the burden of proof has usually been understood
in the doctrine and jurisprudence of countries of the Civil Law tradition in its objective
and subjective senses. In its objective sense, the burden of proof refers to a rule of
judgment that the judge must take into consideration in the situation of non liquet in
which there is an absence of evidence or doubts about the evidence provided. The
subjective sense refers to a rule addressed to the parties that indicates what it is
incumbent upon them to prove in the judicial process.
The burden of proof may also be conceived as a technical or practical rule consisting
of the distribution effect of the evidentiary contribution among the litigants that
produces various rules of the legal order in substantive or procedural fields such as
the rules of liability for damages, legal presumptions, presumptions of basic fact, the
dynamism of evidence, etc.
Also, we assume as a starting point that there is no unified rule in relation to the
burden of proof applicable to all types of judicial proceedings, but rather that there
are different rules that apply in different fields such as civil or criminal legal
proceedings.

Papers can be about any of the topics in relation to the burden of proof, such as,
among others:
1. Burden of proof in civil, family, administrative, labor and social security legal
proceedings.
The presentation of the chapter must comply with the following criteria:
The citation follows the following style: author's last name, year: page(s). e.g.,
Ferrajoli, 2010: 33-34.
The academic coordinators will review each manuscript received according to the
terms of reference and its thematic relevance. Authors will be informed whether their
text has been accepted or rejected and, if necessary, will be asked to make
corrections or amendments. The academic coordinators will be responsible for
writing the general presentation of the book, before it is sent to the Editorial
Committee of the Faculty who will appoint referees for the double-blind peer review
process.
