en las vias procesales prevlas (Art. 5, Inc. 2 del Cdigo Procesal Constluclonal), igualmente
saUsfactorlas, que tambln garanticen la proteceln del derecho constluclonal amenazado 0 vulnerado y contra otras personas jurldlcas, en tanto stas -en nuestra leglslacin- tambin pueden favorecer 18 comlsln de delios y ser pasibles de ser sancionadas (Ar. 105 del Cdlgo Penal). entities - through its holders - from asserting its rights by previous procedural means (Section 5,
Paragraph 2 of the Constitutional Code of Procedure) which are also satisfactory and ensure the
protection of the constitutional right threatened or infringed and against other legal entities, as these legal
entities - under our legislation - may also foster the commission of crimes and are likely to be punished (Section 105 of the Criminal Code). In this manner, the ordinary type of proceedings suitable for the protection of the right to honor is a criminal complaint, which shall be brought before the competent

The complaint is based upon the findings of fact and conclusions of law
described herein below.
II. RECITALS
A. Background
"La Oroya" Metallurgical Complex since October 1997 and the "Cobriza"
Mine located in Huancavelica since September 1998. Both facilities were
outstanding debt owed by ORP, which currently exceeds over US$ 139
millon. In February 2010, the involuntary bankruptcy proceeding was
ORC of over US $ 156 million (which includes the above promissory note
of US $ 139 million).

the Creditors' Meeting, and the future of the Complex and all the
inhabitants of La Oroya working for the Complex has been uncertain since
that time.
26. Notwithstanding all of the aforesaid facts, in accordance with the scheme
ORC's rights as ORP's creditor, Cormn has misused the media and
misled the civil society by publishing false defamatory information that

31. On April 18, 2011 Cormn filed a revised civil action against DRP and
DRC, among other Renco Group entities, in the Twelfth Civil Court
Specialized in Commercial Matters (Docket 1890-2011) falsely stating that
