II.- EXPRESA AGRAVIOS. FUNDA RECURSO. II.- A) PRIMER AGRAVIO: QUE LAS
LIQUIDACIONES DE EXPENSAS MENSUALES SON INSUFICIENTES PARA
SUSTENTAR EL INCUMPLIMIENTO. ERRÓNEA INTERPRETACIÓN DEL ACUERDO
CELEBRADO Y SU ALCANCE LEGAL FRENTE A LAS LIQUIDACIONES DE EXPENSAS
Y CONDUCTAS POSTERIORES. FALTA DE VALORACIÓN DE LAS PRUEBAS
PRODUCIDAS EN AUTOS Y EXPEDIENTES CONEXOS.
El juez a quo, efectuó una breve reseña del acuerdo celebrado en fecha 11 de Julio
de 2013, que fuera suscripto por la coactora Liliana Schiaffino (denominada en el acuerdo
como la subrogada) y por la otra parte, en representación del Consorcio, lo hizo el Dr.
Benegas (apoderado de la Sra. Administradora Argentina Arias Arnaldo) el cual fue
ratificado posteriormente por dicha administradora.
En lo que respecta y es relevante a los efectos de este agravio, el juez a quo se
pregunta en qué consistiría el cumplimento exigido en la demanda, por cuanto entiende que
los hechos descriptos para sustentarla no serían idóneos para generar incumplimientos,
esto es, según su valoración, que las publicaciones de liquidaciones de expensas en las 3
cuales se consignó una deuda a cargo de la U.F. nro. 111, no sería suficiente para sustentar
el incumplimiento alegado, dado que el Consorcio no ha iniciado ningún tipo de acción
tendiente a reclamar su pago, y que en ese supuesto podría recién considerarse que ha
existido un incumplimiento en los términos de la clausula segunda del acuerdo celebrado.
The judge a quo made a brief report of the agreement made on July 11th, 2013, executed by
the plaintiff Liliana Schiaffino (named therein as the represented) and by the other party, in
representation of the Consorcio, Benegas J.D. (attorney-in-fact of the Administradora
Argentina Arias Arnaldo [Argentine Administrator Arias Arnaldo]), which was ratified after by
said administrator.
As regards this issue and what is relevant to it, the judge a quo wonders about the grounds
of the performance claimed in the complaint, as he understands that the facts described to
support it would not be sufficient/would not qualify to constitute a breach, that is, according
to the appraisal, that the publications of _______ of expenses, three of which recorded a
debt for the U.F. nro. 111 [Unit No. 111], would not be enough to support the breach
declared because the Consorcio has not performed any action to claim the payment
whatsoever, and in that event, then it could be considered that there has been a breach of
the terms of the second covenant of the agreement made.
SEGUNDO AGRAVIO: INEXISTENCIA DE UNA CONDUCTA ANTIJURIDICA. LA FALSA
IMPUTACIÓN DE UNA DEUDA EN FLAGRANTE VIOLACIÓN AL ACUERDO DE PAGO
CELEBRADO CONSTITUYE UNA INFRACCIÓN ILICITA.
El juez a quo refiere que no se advierte cual sería la conducta antijurídica requerida
para la conformación de un supuesto de responsabilidad civil. Justifica dicho argumento en
base que al momento en que esta parte promovió la acción, se manifestó que se
desconocían las causas de la publicación de esa deuda en las liquidaciones mensuales.
Al respecto, debemos señalar que esta parte lo que manifestó es que, producto del
silencio de la demandada ante las oportunas intimaciones extrajudiciales remitidas mediante
cartas documento – que lucen agregadas en autos, y cuya autenticidad se encuentra
acreditada-, no fue posible contar con absoluta certeza su causa u origen, más allá que
entendemos que con las pruebas arrimadas era posible concluir de modo razonable su
ilegitimidad, en razón de las conductas posteriores en uso del principio de los actos propios,
incluyendo las manifestaciones vertidas en el escrito de contestación de demanda.
The judge a quo states that it is not evident the unlawful conduct that may be required to
constitute an alleged civil liability. He supports this argument based on the moment that the
party herein initiated the action; he stated that the causes of the publication of said debt in
the monthly liquidations were unknown.
In this regard, we shall indicate that the party herein stated that, as a result of the
defendant’s silence/non-answer to the appropriate extrajudicial summons sent through the
registered letter- that are added to the case file, and its authenticity is accredited-, it was not
possible to have with absolute certainty its cause or origin, beyond the fact that we believe
that with the evidence presented it was possible to reasonably conclude its illegitimacy,
regarding the subsequent conducts in use of the principle of own acts, including the
manifestations expressed in the answer of the complaint.
-III- CONSIDERACIONES A PARTIR DE LA DOCUMENTACIÓN ACOMPAÑADA EN LOS
TÉRMINOS DEL ART. 260 INC. 3 CPCCN.
Conforme nuestra presentación de fecha 05/03, esta parte adjunto en los términos
del art. 260 inc. 3 del Cpr., nueva documentación de fecha posterior a la providencia de
autos para sentencia.
Si bien VV.SS aún no se han pronunciado respecto a la aceptación de dicha
documentación para su agregación a estas actuaciones al momento de esta expresión de
agravios, me veo en la necesidad de manifestarme respecto a su valoración como
elementos de prueba relevantes para sustentar el norte de todo proceso: la búsqueda de la
verdad jurídicamente objetiva.
Consecuentemente, los documentos cuya incorporación se pretende demuestran el
daño continuo que el Consorcio demandado ha provocado a las accionantes desde la
primera oportunidad en que ha imputado la deuda a la unidad funcional, pues este no sólo
imputa el supuesto capital adeudado, sino también los intereses que se devengan mes a
mes. Como se ha dicho esto constituye un 21 hecho revelador de la intención, voluntad y
pretendida exigibilidad de la deuda por parte del Consorcio, por más que no se trata de un
reclamo y/o acción judicial, pues la conducta mantiene su carácter de antijurídica, todo ello
conforme el instrumento de liquidación de expensas acompañado y su correspondiente
aviso de pago.
In addition, the email duly and timely attached shows that the consorcio demands
the full payment and thus will not accept partial payments. This shows the damage caused,
and the defendant also demands, intends, and claims the payment of the debt, contrary to
what the judge a quo sustained.
Said documents show the intent, will, and claim from the Consorcio to collect the
debt that was charged to the unit unlawfully, and thus, it is a true/authentic element of
evidence that invalidates/deprives of value the allegations made by the judge a quo at the
moment of dismissal of the _______________.
As to that, in addition to the grounds filed in this motion/appeal, plus the
appraisal/judgment made at the moment of the appeal brief / argument (alegato final =
closing argument) / statement (alegato inicial = opening statement), we request that the
Judges of this Excma Sala I de la Cámara del fuero [Honorable Courtroom I of the Court of
the venue], revoke the judgment appealed and consequently accept the complaint filed, as
we consider that said order has withdrawn from legal logic, _____, and from a right
interpretation of the events occurred. We request to be heard, as per our right to be heard in
the widest sense to obtain a fair judgment that considers the reality of the events, while we
consider that our proprietary rights and trust have been affected/damaged due to the
conduct of the defendant and of his attorney-in-law, who in an abusive exercise of their
rights have put us in a vulnerable position by continuing to arbitrarily charge an already paid
debt.
ofV- PRAYER
a) That the issue presented be considered as submitted in due time and form, and
the appeal timely filed be considered as sustained.
b) That the defendant be given notice of this appeal in the form and style pursuant to
art. 265 del Cpr. [section 265 of the Civil and Commercial Procedural Code of the
Argentine Republic]
c) That the timely revoke of the appealed judgment on its whole, admitting the
complaint filed in all its terms, with the express imposition of costs on the defendant.
