Tras una decisión de diciembre de 2021 del Tribunal Supremo del Reino Unido que confirmaba
que el Gobierno del Reino Unido había reconocido al Sr. Guaidó como presidente legítimo y que
sus actos de nombramiento constituían actos oficiales de estado, el Tribunal Comercial tenía una
tarea: determinar si ciertas decisiones del TSJ que declaraban nulos los actos del presidente
Guaidó debían ser reconocidas por los tribunales del Reino Unido. El Tribunal ha determinado
ahora que no debe concederse tal reconocimiento.
El Tribunal consideró que las decisiones del TSJ del Régimen eran en sí mismas incompatibles
con el reconocimiento del presidente Guaidó por parte del Reino Unido. El régimen también
infringió las normas de justicia natural del Reino Unido ya que se dictaron en procedimientos en
los que ni el presidente Guaidó ni sus designados fueron notificados ni se les dio la oportunidad
de presentar argumentos.
El presidente Guaidó expresó una vez más su agradecimiento a los tribunales ingleses que
constituyen un muro de protección para las libertades del pueblo en un país de estado de derecho
como el Reino Unido.
El presidente Guaidó reconoció que es probable que Maduro busque apelar la decisión inglesa,
pero expresó su plena confianza en que los nombramientos de su personal serán confirmados.

cinco miembros del Directorio del BCV designados por el presidente Guaidó, dos de los cuales
administraron en su momento las reservas extranjeras de Venezuela, incluido el oro, y otros

continuamente las cuentas del BCV, trabajan bajo la vigorosa supervisión de la Contraloría

President Guaido Welcomes Court Decision in Gold Case
Caracas- July 29, 2022 – In another international victory for democracy and freedom, Interim
Venezuela President Juan Guaido welcomed Friday’s decision of England’s Commercial Court
refusing to give recognition in the United Kingdom to decisions of the Maduro Regime’s
Supreme Tribunal of Justice (STJ) declaring Guaido’s appointments to the board of the Central
Bank of Venezuela and as Special Attorney General null and void.
Following a December 2021 decision of the Supreme Court of the United Kingdom confirming
that the Government the United Kingdom had recognized Mr. Guaido as President and that his
acts of appointment constituted official acts of state, the Commercial Court had one task - to
determine whether certain STJ decisions declaring President Guaido’s acts null and void should
be recognized by courts in the United Kingdom. The Court has now determined that no such
recognition should be granted.
The Court found that the Regime’s STJ decisions were themselves inconsistent with the
recognition of President Guaido by the United Kingdom. The Regime also ran afoul of the
United Kingdom’s standards of natural justice because they were rendered in proceedings in
which neither Mr. Guaido nor his appointees were notified or afforded an opportunity to present
argument.
President Guaido once again expressed his gratitude to the English courts which form a bastion
of the people’s liberties in a rule of law country like the United Kingdom.
President Guaido said: “Unfortunately, this type of honest and transparent judicial
process does not exist in Venezuela, because the Maduro regime cares more about
power and money than it does about the people of Venezuela. We are grateful that
the United Kingdom reminds us and the world of what is possible in a Democracy
that respects the Rule of Law”.
President Guaido went on to say: “The men, women and children of Venezuela
are proud of the courage, resolve and professionalism of the Attorney General, the
Board of the BCV and our Legal Team demonstrated in this victory for future
generations.”
President Guaido recognized that the Maduro side will likely seek to appeal the English decision
but expressed full confidence that the appointments of his personnel will be confirmed.
All Venezuelans can be proud of the transparent work performed each day by the five members
of the Board of the BCV appointed by President Guaido, two of whom once managed
Venezuela’s foreign reserves, including gold, and other members with financial supervisory and
risk management experience, who continually publish the BCV’s accounts, work under the
vigorous oversight of the Venezuelan Comptroller and present reports to the National Assembly.
