Peruano es propietario de los bienes
muebles e inmuebles ubicados en el territorio de la
República y en el extranjero que le corresponden por
ley y ejerce su dominio administrativamente, a través
del Gobierno Nacional, los Gobiernos Regionales y
los Gobiernos Locales
 Sobre la definición de bienes estatales:
*El artículo 3 de la Ley
establecía la definición de
bienes estatales:
“Son los bienes muebles e
inmuebles de dominio público y
dominio privado del Estado que
tienen como titular al Estado o
cualquier entidad que conforma
el Sistema Nacional de Bienes
Estatales”.
*Posteriormente, el Decreto
Legislativo N° 1439, promulgado el
15 de setiembre del 2018 que
aprueba el Sistema Nacional de
Abastecimiento, en su primera
disposición complementaria
modificatoria precisa la definición de
“Para los efectos de Estado:
esta Ley, los bienes estatales
bienes del
se circunscriben a los predios, tales como terrenos,
áreas de playa, islas, y otros de dominio privado y
de dominio público, que tienen como titular al
Estado o a cualquier entidad pública que conforma
el Sistema Nacional de Bienes Estatales,
independientemente del nivel de gobierno al que
pertenezcan, conforme se establezca en el
Reglamento”.

SOBRE LOS BIENES DEL ESTADO
Y LA FUNCIÓN DE LA SBN
Mediante Ley N° 29151, se aprueba la Ley
General del Sistema Nacional de Bienes del
Estado, la cual reconoce a la SBN como ente
rector del Sistema Nacional de Bienes Estatales y
como la entidad encargada de normar y
supervisar los actos de adquisición, disposición,
administración y registro de los bienes estatales
que realicen las entidades, con el propósito de
lograr una administración ordenada y eficiente.
Las Municipalidades forman parte de dicho
sistema.
*La Superintendencia Nacional
de Bienes Estatales (SBN):
Es un organismo público
descentralizado adscrito al Ministerio
de Vivienda, Construcción y
Saneamiento. Tiene personería jurídica
de derecho público y goza de
autonomía económica, presupuestal,
financiera, técnica y funcional
necesaria para la ejecución de los actos
de adquisición, disposición,
administración, registro y control de los
bienes de propiedad estatal, cuya
administración está a su cargo de
acuerdo con la normativa vigente.

Clasificación de los bienes por su
alcance o envergadura

De acuerdo al artículo 4, literal a) de la Ley
N° 29151: “Son aquellos bienes
comprendidos en los incisos c), d), e), f), g)
y h) del numeral 3 del artículo 2 del
Decreto Supremo N° 023-2004- PCM”.
