INSTRUCTIVO
MIEMBROS DE LA POLICÍA NACIONAL
EN SERVICIO ACTIVO

PRESENTACIÓN

El Consejo Nacional Electoral de acuerdo con la Ley Orgánica Electoral y de Organi-

zaciones Políticas, Código de la Democracia, “Organiza, dirige, vigila y garantiza, de
manera transparente y eficaz los procesos electorales, convoca a elecciones, realiza
los cómputos electorales, proclama los resultados y posesiona a quienes resulten
electas o electos.”

Asimismo, su misión es “Garantizar el ejercicio de los derechos políticos que se expre-

san a través del sufragio, así como los referentes a la organización política de la ciuda-
danía; y, promover el fortalecimiento de la democracia, mediante la organización de
procesos electorales y el apoyo a las organizaciones políticas y sociales, asegurando
una participación equitativa, igualitaria, paritaria, intercultural, libre, democrática y
justa, para elegir y ser elegidos.”

En el marco de esta normativa, el Consejo Nacional Elec-

toral aprobó el inicio del periodo electoral para las
Elecciones Presidenciales, Legislativas Antici-
padas 2023 y Consultas Populares: Yasuní y
Chocó Andino.

En estas elecciones el Consejo Nacional

Electoral ratifica su responsabilidad de ga-
rantizar un proceso electoral transparente,
participativo e inclusivo.

PROHIBICIONES A MIEMBROS DE LA
POLICÍA NACIONAL EN SERVICIO ACTIVO

• Ser miembros de las Juntas Receptoras del Voto.

• Portar armas al momento de sufragar.

• Participar en actividades proselitistas o de las organi-

zaciones políticas o sociales dentro de las unidades y
dependencias de la Policía Nacional a las que perte-

1. ANTES DEL DÍA DE LAS VOTACIONES

• Participar en la capacitación presencial impartida por las Delegaciones Provincia-

les Electorales.

• Controlar el cumplimiento de la prohibición de expendio y consumo de bebidas

alcohólicas, 36 horas antes del inicio de las votaciones hasta 12 horas luego del
día de las votaciones.

• Apoyar a los coordinadores electorales en el retiro de la propaganda electoral en

un perímetro de 100 metros a la redonda de los recintos electorales, 48 horas an-
tes del día de las votaciones.

• Participar en los simulacros programados en cada jurisdicción provincial según la

función designada.

• Notificar con la boleta de citación a los presuntos contraventores electorales.

2. DURANTE EL DÍA DE LAS VOTACIONES

17 DE AGOSTO - VOTO DE PERSONAS PRIVADAS DE
LA LIBERTAD SIN SENTENCIA CONDENATORIA
EJECUTORIADA

• Trasladar y custodiar el material electoral y al personal

encargado de receptar el voto a personas privadas de
la libertad a los centros de privación de la libertad.

18 DE AGOSTO - VOTO EN CASA

Trasladar y custodiar el material electoral y al personal

encargado de receptar el voto en casa.

20 DE AGOSTO – DÍA DE LAS VOTACIONES

• Controlar el cumplimiento de la prohibición de expendio y consumo de bebidas

alcohólicas.

• Verificar que en el exterior de los recintos electorales no se realice proselitismo

político.

• Colaborar en el ingreso de electores con discapacidad, mujeres embarazadas, per-

sonas con niños en brazos, adultos mayores, observadores electorales, delegados
de organizaciones políticas, representantes de los medios de comunicación y de
organismos de socorro.

 • Evitar aglomeraciones de personas alrededor del recinto electoral.
• Controlar que los ciudadanos no porten armas ni se encuentren en estado etílico.
• Notificar a presuntos contraventores electorales con la boleta de citación.

RECUERDE: Su función es mantener la seguridad externa y orden público en

las instalaciones donde funcionen: recintos electorales, CPE, DPE y el Centro
de Mando.

VOTACIÓN DE LOS MIEMBROS DE LA

POLICÍA NACIONAL EN SERVICIO ACTIVO
Lugar de votación de los miembros de la Policía Nacional

Los miembros de la Policía Nacional en servicio activo podrán sufragar en la JRV del
recinto electoral donde se encuentren prestando sus servicios o en cualquier recinto
electoral cercano a su ubicación.

Votación

El Consejo Nacional Electoral en coordinación con la Comandancia

General de la Policía Nacional entregará la “credencial para votar”
(adhesivo) a cada uno de los miembros de la Policía
Nacional en servicio activo para garantizar su de-
recho al voto.

RECUERDE: El personal de la
Policía Nacional ejercerá su de-
recho al voto sin portar armas

RECUERDE: El personal de la Poli-

cía Nacional ejercera su derecho al
voto por una sola vez.

 ATENCIÓN Y ASISTENCIA A PERSONAS CON
DISCAPACIDAD AL EXTERIOR DEL RECINTO

1 Identificarse ante las personas con discapaci-

dad, ofrecer su apoyo y ayuda con cortesía si
es aceptada. De ser necesario, proceder de la
siguiente manera :

Personas con discapacidad visual: Ofrecer ayu-
da para guiarle; si aceptada la ayuda, camine
un paso adelante para anticipar obstáculos
como gradas, puertas, rampas , entre otros.

3 Personas con discapacidad física: Facilitar la

movilidad de las personas que utilicen silla de
ruedas, muletas, andadores o cualquier otro
método de movilización al interior o exterior
del recinto.

4 Personas con discapacidad intelectual: En el

caso de que una persona con discapacidad
intelectual no se encuentre acompañada, pro-
ceder a asistirla con ayuda técnica, similares a
la de otro tipo de discapacidad.

PRESUNTAS CONTRAVENCIONES ELECTORALES

BOLETA DE CITACIÓN

El procedimiento de flagrancia se aplicará cuando un miembro de la Policía Nacional o

una autoridad electoral presencien el cometimiento flagrante de las contravenciones
electorales. En estos casos el miembro de la Policía Nacional solicitará la presentación
de la cédula del presunto contraventor con el fin de verificar sus datos personales; pos-
teriormente, le entregará el original de la BOLETA DE CITACIÓN en la que constará la
información detallada de la presunta contravención electoral.

Previo a la entrega de la BOLETA DE CITACIÓN, el presunto

contraventor deberá ser instruido sobre los derechos cons-
titucionales que le asisten. En ningún caso, se dispondrá la
privación de la libertad de los presuntos contraventores.

Si el caso configura una infracción de tipo penal, el ciuda-

dano será puesto a órdenes de la autoridad com-
petente.

El duplicado de la BOLETA DE CITACIÓN,

el parte policial respectivo y los elementos
probatorios, en caso de existir serán entregados por
la Policía Nacional a la directora o director de la DPE de
la jurisdicción respectiva en el plazo máximo de 48 horas
posteriores al cometimiento de la presunta contravención
electoral.

que el Consejo Nacional Electoral, por mandato del artículo 217 inciso segundo y artículo 219 numeral
11 de la Constitución de la República del Ecuador, en concordancia con los artículos 25, numeral 3,
290 y 291 de la Ley Orgánica Electoral y de Organizaciones Políticas de la República del Ecuador,
Código de la Democracia, es el órgano competente para conocer, resolver y sancionar sobre el
cometimiento de contravenciones electorales, por lo que iniciará el trámite correspondiente por
presuntamente haber incurrido en la (s) siguiente (s) contravención (es):
CONTRAVENCIONES
Quien injustificadamente retarde el envío o la entrega de los documentos electorales a las juntas
respectivas (Art. 290 N.1, Código de la Democracia).
Quien retenga el pasaporte o la cédula de ciudadanía o identidad de otra persona, con el fin de coartar
la libertad del sufragio (Art. 290 N.3, Código de la Democracia).
Los vocales de las juntas receptoras del voto que con su decisión contribuyan a negar el voto de una
electora o elector facultado por hacerlo, a que acepten el voto de una electora o elector impedido
legalmente para sufragar (Art. 290 N.4, Código de la Democracia).
Quien haga propaganda dentro del recinto electoral en el día de los comicios (Art. 291 N.1, Código de
la Democracia)

Quien haga propaganda electoral en los días en que dicha propaganda se encuentra prohibida por la
ley (Art. 291 N.2, Código de la Democracia)
Quien expenda o consuma bebidas alcohólicas en los días en que exista prohibición de expendio o
consumo de tales bebidas (Art. 291 N.3, Código de la Democracia).
El que ingrese al recinto electoral o se presente a votar en estado de embriaguez (Art. 291 N.4, Código
de la Democracia).
Quien suscite alguna alteración o perturbación en el desarrollo de las votaciones, dentro o fuera de los
recintos electorales (Art. 291 N.5, Código de la Democracia).
Quien se presente a votar portando armas (Art. 291 N.6, Código de la Democracia).

todiará al operador de escáner, al kit técnico
electoral y a los sobres amarillos T hasta el
CPE.

POLICÍA RECOLECTOR:

• Recibir de cada coordinador de mesa los sobres color amarillo T con las actas de
instalación y escrutinio y firmar el acta de entrega-recepción.

• Entregar al policía transportador los sobres color amarillo T de la totalidad de las

juntas receptoras del voto del recinto NO-CDA y firmar el acta de entrega-recep-
ción.

POLICÍA TRANSPORTADOR:

• Llevar los sobres color amarillo T que recibió del policía recolector del recinto NO-
CDA hacia el recinto CDA o al CPE, entregar al operador de escáner en el punto de
digitalización y firmar el acta de entrega-recepción.
