Alimentación para los Trabajadores Workers Food Benefit

En la Gaceta Oficial N° 39.666 de fecha 4 de mayo de 2011,
fue publicado el Decreto N° 8189, por medio del cual se dicta
el Decreto con Rango, Valor y Fuerza de Ley de Reforma
Parcial del Decreto con Rango, Valor y Fuerza de la Ley de
Alimentación para los Trabajadores y las Trabajadoras,
emanado de la Presidencia de la República.
De acuerdo con esta reforma, se ratifica la prohibición al
patrono de pagar en dinero en efectivo o su equivalente el
beneficio de alimentación, sin embargo, se prevén tres (03)
excepciones: (i) Cuando el empleador con menos de veinte
(20) trabajadores, se le dificulte cumplir con dicho beneficio
mediante las formas enumeradas en el artículo 4 de este
Decreto-Ley; (ii) Cuando a los trabajadores
independientemente del número de empleados con que
cuente su empleador, se le dificulte acceder a los
establecimientos habilitados para canjear los cupones o
tickets de alimentación, o utilizar la tarjeta electrónica; (iii)
cuando ocurra alguna de las situaciones previstas en el
Parágrafo Único del artículo 6 de dicho Decreto-Ley.
Decree N°8189 was published in Official Gazette N°39,666 of
May 4, 2011. This Decree with Rank, Value and Force of Law
of Partial Reform of Decree with Rank, Value and Force of
Workers Food Benefit Law was enacted by the President of the
Republic.
This Reform ratifies that employers shall be precluded from
payment of this food benefit in cash, or its equivalent; however,
three (3) exceptions are provided (i) where the employer with
less than twenty (20) workers is hindered from complying with
this benefit through the modalities established in Article 4 of
this Decree-Law; (ii) where workers, regardless of the number
of workers hired by the employer, cannot have access to the
premises authorized for trading the food tickets or coupons or
using the electronic card; (iii) where any of the events
described in Sole Paragraph of Article 6 of the Decree Law
takes place.
This Reform is effective from its publication in Official Gazette.
