Artículo 80:
El Estado reconoce el derecho de todo ser humano a participar
en la Cultura y por tanto debe fomentar la participación de

todos los habitantes de la República en la Cultura Nacional.
El Estado Reconoce, se obliga y
garantiza, con protección de fuerza de
ley constitucional; el derecho de
todos los humanos que permanecen en
el territorio, sin exceptuar o
discriminar a nadie por raza, color,
nacionalidad o preferencia alguna, ni
su estatus legal; de la participación en
actividades culturales. A su vez se
obliga también a fomentar la Más, es importante señalar que en el artículo 20,
aclara que también podrá negar el ejercicio de
participación en las mismas. actividades, que puedan ir en contra del trabajo,
salubridad, moralidad, seguridad pública y

Artículo 81:
La Cultura Nacional está constituida por las manifestaciones
artísticas, filosóficas y científicas producidas por el hombre en
Panamá a través de las épocas. El Estado promoverá,
desarrollará y custodiará este patrimonio cultural.

Señala que El Estado reconoce al
menos, 3 tipos de manifestaciones:
1. Artísticas
2. Filosóficas
3. Científicas.
Y hace énfasis en delimitar que deben
ser producto de los habitantes del
territorio nacional a través del
tiempo, y garantiza la protección
desarrollo y custodia de estas
manifestaciones culturales.

Artículo 82:
El Estado velará por la defensa, difusión y pureza
del idioma Español

Artículo 82

● Se nutre con el artículo 7 de la Constitución que

establece el idioma Español como el idioma
oficial de la República.
● Dicha defensa, difusión y pureza del español
busca que la población aprenda, conozca y
domine el idioma oficial de la República de
Panamá.
● Este artículo no impide que se quiera y pueda
aprender otros idiomas, no existe prohibición a
nivel constitucional y mucho menos legal.

Artículo 82 - Promoción
● Apoyo de la Academia Panameña de la Lengua establecida
en 1926 como correspondiente de la Real Academia
Española.
● Además, el Ministerio de Cultura a través de los concursos
literarios, hace la difusión y la educación del idioma
español.
● Concurso Nacional de literatura Ricardo Miró
● Premio Centroamericano de Literatura Rogelio Sinan
● Concurso Medio Pollito, Concurso de literatura infantil y
juvenil Carlos Francisco Changmarin, Concurso de poesía
Gustavo Batista Cedeño entre otros.

El Estado formulará la política científica nacional
destinada a promover el desarrollo de la ciencia y
tecnología

● A través de la Ley 13 de 1997 la Asamblea

Establece los Lineamientos e Instrumentos para
el Desarrollo de la Ciencia, Tecnología y la
Innovación.
● Artículo 1 menciona lo dictado en el artículo 79
de la Constitución política de 1994 que reconoce
al Estado panameño la obligación al fomento
continuo y permanente de las actividades de
investigación científica y tecnológica.

● Artículo 8 SENACYT como organismo descentralizado

adscrito al despacho de la presidencia de la República.
● El Estado a través de la Senacyt formula políticas
científicas (PENCYT). Estas políticas agrupadas en el
Plan, son divisadas a través del artículo 2 de esta ley

Objetivos del PENCYT

● Realizar análisis periódicos sobre la situación de la ciencia,

tecnología e innovación del país.
● Proponer alternativas para atender los requerimientos de
investigación y desarrollo, recursos humanos de alto nivel y
calidad, infraestructura, medios institucionales
● Definir políticas, estrategias, programas y acciones que indiquen
el rumbo hacia dónde se dirige el país
● Movilizar recursos, capacidades, instituciones empresas y
personas del sector gubernamental y sociedad civil Promover el
desarrollo del sistema nacional de investigadores
