La naturaleza y esencia
del derecho
internacional
NATURALEZA
De acuerdo con la definición tradicional, el
Derecho internacional es un conjunto de
normas que regulan el comportamiento mutuo
de los Estados, sujetos específicos del
Derecho internacional.

En caso en el territorio de un solo Estado en


este se tienen vigencia tanto normas de
Derecho Internacional y normas de Derecho
Interno, cuando hay coincidencia no existe
problema, pero cuando hay contraposición,
es indispensable considerar cuál debe
dominar.
ESENCIA
El Derecho internacional regula el
comportamiento de los seres humanos, aún
cuando regule eI comportamiento de los
Estados.

Clasificación de las
normas de validez del
derecho internacional

● Nacionales.- Las que pertenecen al sistema jurídico de un país
determinado y se aplican a éste. Ejemplo de México: art. 1 de la
CPEUM

● Extranjeras.- Las que pertenecen al ordenamiento jurídico de un país


distinto. Ejemplo: Art. 1 de la Ley de inversión extranjera

● Uniformes (Internacionales).- Aquellas que se aplican en dos o más


países a la vez, por disposición voluntaria de esas naciones a través
de un tratado, por ejemplo. Ejemplo: Código Aduanero
Centroamericano. Capítulo aparte merecería el caso de los
reglamentos y directivas establecidas por la Unión Europea.

Clasificación de las
normas según la fuerza
de su obligatoriedad
En sentido prescriptivo, decir que una norma
jurídica es válida significa que es obligatorio

corresponde con la noción kelseniana de
«fuerza obligatoria»
El derecho tiene un cumplimiento obligatorio, no es potestativo,
por lo que apoya su obligatoriedad en el poder coercitivo del
Estado.

El Derecho internacional obliga porque es un instrumento de


regulación social históricamente necesario.
2.6. Fuentes del derecho internacional
público

1. Tratados internacionales

Tratado internacional, es un acuerdo internacional celebrado por


escrito entre Estados y regido por el Derecho Internacional, ya
conste en un instrumento único o en dos o más instrumentos
conexos y cualquiera que sea su denominación particular.
2. La costumbre

Es un derecho generalmente no escrito derivado de una


práctica general aceptada como derecho. La costumbre
internacional es el resultado de una práctica general,
continua, uniforme y consistente de los Estados, los cuales la
reconocen como válida y como una obligación jurídicamente
exigible.
3. Los principios generales del derecho

Los principios propios del derecho internacional público


encontramos, entre otros: la regla pacta sunt servanda, el
respeto a la independencia de los Estados, la prohibición del
abuso del derecho, el principio de la primacía de la norma
internacional sobre la norma interna, el principio rebus sic
stantibus o cambio especial de circunstancias, etcétera.
4. La doctrina

Conjunto de principios y de normas que regula las relaciones


entre los Estados y otros sujetos de este Derecho. Existe una
doctrina individual y otra de carácter colectivo.
5. La jurisprudencia

La jurisprudencia internacional no sólo permite determinar los


alcances de los derechos básicos, sino también su armonización
recíproca, de manera que se evidencien su interrelación y su
interdependencia, para facilitar su eficacia plena.
