Resumen
Over the years, human beings tend to surround ourselves with pets of different
species until we make them part of our family; But at the same time, the constant
presence of a pattern of behavior has been noted where people claim that they are
bored, fed up or cannot have them in their homes any longer, therefore, they opt
for “easy solutions” that correspond to abandoning their pets.
The presence of these street dogs and cats has become a growing concern in
Colombia and even around the world, generating negative impacts both on the
well-being of the animals and on the public health of citizens, it is estimated that
there is an approximate of 3 million dogs and cats under this street situation; This
increase has also occurred because many of these dogs and cats were never
sterilized and are reproducing more and more.
Colombia has developed a wide variety of jurisprudence around animals and has
entered into discussion as to whether they are considered subjects of law under
our legislation and the Political Constitution of 1991; The Constitutional Court
finally determined them as objects of special constitutional protection, but without
subtracting from their category of sentient beings, concluding with this that animals
have a special regulation that protects them. Therefore, and regarding the social
well-being and public health of the citizenship, it becomes important that the
National Development Plan, articulated with the Departmental and Municipal
Development Plan, includes a protection and well-being program focused on
domestic animals that are in a state of vulnerability, developing shelter campaigns
and veterinary support.
A lo largo de los años los animales fueron catalogados como objetos o muebles de
conformidad con el código civil, por ende, no se tenía culturalmente bajo una
noción de reconocimiento de un ser de especial protección; no fue hasta 1990 en
la universidad de Harvard donde DAVID FAVRE, con The Gathering Momentum, 1
J. Animal L. 1, 9-14 (2005), motivó el concepto de derecho animal y desde
entonces ha estado en auge hasta el punto de convertirse en una rama emergente
del derecho en diferentes países del mundo.
Sin embargo de lo anterior, estas siguen siendo normas que no son acatadas por
la comunidad, a pesar que estos animales tienen una gran importancia como parte
de la creación, conservación de ecosistemas y además de no solo brindar ayuda a
sus amos con el trabajo como era el caso de los vehículos de tracción animal o
animales de granja, sino también brindan compañía, seguridad y bienestar para
quienes los rodean, al punto de que incluso como tratamiento psicológico son
catalogados como animales de compañía y apoyo emocional.
