En la Gaceta Oficial N° 39.670 de fecha 10 de mayo de 2011,
fue publicado el Decreto N° 8.210, emanado de la
Presidencia de la República, en el cual se exonera del pago
del Impuesto sobre la Renta (ISLR) los enriquecimientos
netos de fuente venezolana, provenientes de la explotación
primaria de las actividades agrícolas, forestales, pecuarias,
avícolas, pesqueras, acuícolas y piscícolas, obtenidos por
personas naturales, jurídicas y entidades sin personalidad
jurídica, residentes en el país.
Decree N°8,210, issued by the Presidency of the Republic,
was published in Official Gazette N°39,670 of May 10, 2011.
Such Decree exonerates from income tax payment, net
income from territorial source, provided by the primary
exploitation of agriculture, forestry, cattle, poultry, fishing,
aquiculture and pisciculture activities, obtained by individuals,
corporations and entities with no juristic person (legal status),
residing in the country.

Las personas y entidades que realicen las actividades cuyos
enriquecimientos se exoneran, deberán cumplir con algunos
requisitos establecidos en el antes mencionado Decreto y
destinar el cien por ciento (100%) del monto del impuesto
que le hubiere correspondido pagar, a inversiones directas
para la respectiva actividad en materia de investigación y
desarrollo científico y tecnológico, mejoramiento de los
índices de productividad o en bienes de capital.
La pérdida que se genere con ocasión de la actividad
exonerada no podrá ser imputada en ningún ejercicio fiscal a
los enriquecimientos que se generen por la actividad gravada
con el impuesto sobre la renta.
Dichas personas y entidades deberán a su vez presentar
ante Ministerio del Poder Popular para la Agricultura y
Tierras, así como ante el SENIAT, una declaración jurada de
las inversiones y montos invertidos durante el ejercicio fiscal
2010, así como el plan de inversiones del monto del impuesto
exonerado para el ejercicio fiscal 2011, antes del 31 de
marzo de 2011. Además, deben presentar declaración jurada
sobre los montos del impuesto exonerado invertidos, dentro
de los quince (15) días hábiles siguientes a la fecha en que
se realice la inversión.
Individuals and entities conducting activities with exonerated
income shall meet certain requirements established in such
Decree and destine the hundred percent (100%) of the
amount of the tax that would have been required to be paid to
direct investments in the respective activity related to
scientific and technological research and development,
improvement of production indices, or in capital assets.
The loss arising from the exonerated activity shall not be
attributed in any fiscal year to income generated by the
activity levied with the income tax.
Such individuals and entities shall also file with the Ministry of
Popular Power for Agriculture and Land, and with SENIAT, a
sworn statement of the investments and amounts invested
during fiscal year 2010, as well as the plan to invest the
amount of the exonerated tax for fiscal year 2011, before
March 31, 2011. Additionally, a sworn statement must be filed
for the invested amounts of the exonerated tax, within the
fifteen (15) business days following the date of the
investment.
Such Decree shall be effective from January 1, 2011 to
December 31, 2012.

El citado Decreto entrará en vigencia a partir del día primero

(1°) de enero de 2011 hasta el treinta y uno (31) de diciembre
del año 2012.
