Preambulo

La pena de muerte es un tema radical: la postura que se toma ante él influirá,

consciente o inconscientemente, en la postura ante otros problemas importantes con la
violencia, el terrorismo, el divorcio, el aborto, el derecho de propiedad, los marginados,
la opresión del poder, la Polí-tica criminal retributiva o Re personalizadora o
reformadora de estructuras sociales, los derechos humanos (1). TOHARIA, en su libro El
Juez español, lo ha constatado, por ejemplo, respecto a las opiniones de los jueces.

El artículo 11 de la Constitución dice actualmente que “El derecho a la vida es inviolable.

No habrá pena de muerte”, pero con la modificación, si se aprueba el acto legislativo
quedaría “El derecho a la vida es inviolable” sin embargo este derecho queda muy en
duda dada la atrocidades de unos pocos en la sociedad.

La plenaria de la Cámara de Representantes aprobó el proyecto que busca establecer en Colombia la cadena
perpetua para violadores y asesinos de niños y niñas.
“Las niñas y niños, víctimas de maltrato, abuso o violación sexual son,
por lo general, aquellos que buscan el cariño que no reciben”, dice
Huxoll-von Ahn, y agrega que justo la falta de atención hace a los niños
más débiles. Por ello, uno de los principios de la prevención se basa en
que los niños deben poder decir “No”, porque “los niños que aprenden
a rechazar cierto lenguaje o acciones de los adultos, crecen más seguros
de sí mismos”. Una postura que reduce el riesgo de ser vulnerados.
Tesis principal
El argumento que ya existe una pena de 60 años que es
casi una pena perpetua, pues el claro ejemplo de que
no ha servido para persuadir sobre la gravedad del
delito de tal modo si queremos que esto se reduzca no
más que debemos implementar como la posibilidad
número uno la pena de muerte.
Recordamos que el derecho a la vida es inviolable claro está, pero
debemos acatar que al momento de la persona realizar este acto tan
macabro como queda el estado mental de los niños, ante la situación,
claro esta si sobreviven a este ataque, claramente es como si la vida de
ellos se estuviera terminando, literalmente los traumas y las secuelas que
este acto dejo marcado en ellos para la respectiva acusación la cual no
existe se deben tener en cuenta todo este tipo de aspectos

De igual forma si nos ponemos en contexto si una persona que realiza
este acto que puede ella sentir o claramente sabemos que una persona
la cual sea cuerda no realizara esto a menos de que tenga un tipo de
enfermedad por la cual si es así estos individuos que realizan esta clase
de actos no deberían caminar incluso existir en el mismo mundo de
nuestros niños ya que la existencia de estos es una clara amenaza para
nuestros niños, para minimizar estas elevadas tazas de muertes y
violaciones a niños en Colombia debemos replantear la acusación
que le estamos dando a estas personas.
