RESIDENTE DE RETORNO (DS-117)

Un residente permanente de los Estados Unidos que ha permanecido fuera de los Estados Unidos durante más de 12
meses o pasada la validez del permiso de reentrada (reentry permit), necesitará una visa de inmigrante para volver a
entrar a los Estados Unidos y reanudar la residencia permanente.

Existe una disposición bajo la ley de visas de los Estados Unidos sobre la aprobación del estatus especial de
inmigrante como residente de retorno a quien reúne los siguientes tres requisitos:

• Ha permanecido fuera de los Estados Unidos debido a circunstancias fuera de su control;

• Era residente legal permanente al momento de salir de los Estados Unidos; y
• Al momento de salir de los Estados Unidos tenía intenciones de regresar y ha mantenido esa intención.

A fin de poder programar una cita para presentar la solicitud de residente de retorno, debe crear una cuenta en el
sistema de citas. Tenga a bien leer atentamente las opciones para asegurarse seleccionar la categoría correcta en
base al tiempo que ha estado afuera de los Estados Unidos. Una vez que haya completado el registro, podrá
programar la cita disponible. Nuestra oficina no programará la cita para usted.

DOCUMENTACION REQUERIDA para presentar la solicitud:

• Formulario DS-117 completo y firmado.

• Pasaporte válido y fotocopia de la página de datos biográficos.
• Pasaportes anteriores
• Tarjeta de Residente Permanente “Green card” (original y copia)
• Prueba de su última salida de Estados Unidos. Ejemplos: tarjeta de embarque, y/o sellos en el pasaporte –
original y fotocopia.
• Prueba de lazos con Estados Unidos y su intención de regreso. Ejemplos: Formulario 1040 de impuestos de IRS
del último año o el ticket de regreso a Estados Unidos
• Prueba de que su estadía fuera de los Estados Unidos se debió a razones fuera de su control (Ejemplos:
incapacidad médica, empleo con una compañía estadounidense en el exterior). Si su estadía fuera de los EE. UU. se
debió a una emergencia médica debe incluir una carta del médico tratante traducida al inglés – original y fotocopia.
• Arancel de la solicitud: U.S.$180 por cada solicitante. Este arancel será abonado en la Embajada el día de su
entrevista.

OPCIONES DE PAGO: Tarjeta de crédito internacional o en efectivo (en UNA sola moneda y con monto exacto; pueden
ser dólares americanos o pesos argentinos).

El día de la cita, un oficial consular analizara la documentación presentada y realizara una breve entrevista. Si el oficial
consular determina que el solicitante de DS-117 califica como “Residente de retorno” estaremos enviándole un correo
electrónico con instrucciones y los documentos requeridos para gestionar la visa de inmigrante dentro de los 6 meses.

Si el oficial consular determina que el/la solicitante no califica como “Residente de retorno”, se rechazara la solicitud
considerando que abandono su estatus de residente legal de los Estados Unidos. El fee para presentar el DS-117 no
es reembolsable.

El proceso completo puede demorar varios meses y, por lo tanto, recomendamos que la persona que desee postularse
como “residente de retorno” lo haga lo antes posible.

Nota: La Embajada cierra todos los Feriados Nacionales de Argentina y de los Estados Unidos.

RETURNING RESIDENT (DS-117)

A permanent resident alien who has remained outside the United States for longer than twelve months, or beyond the validity
period of a reentry permit, will require a new immigrant visa in order to reenter the United States and resume permanent
residence.

U.S. immigration law allows for the issuance of a special immigrant returning resident visa to an alien who meets all
three of the following criteria:

• Has remained outside the United States for more than one year due to circumstances beyond their control.
• Was a lawful permanent resident when they departed the United States; and
• Intended to return to the United States when they initially departed the United States and has maintained this intent.

To schedule an appointment for a returning resident you must create an account in the appointment system. Please review
the options carefully to ensure you select the correct category based on the amount of time you have been outside the
United States. Once you have completed the registration, you will be able to select an available appointment. We will not
schedule the appointment for you.

DOCUMENTS REQUIRED to submit the application:

• Completed and signed form DS-117.

• Valid passport and a photocopy of its biographic page.
• Previous passports.
• Your Permanent Resident Card (original and photocopy).
• Proof of your last departure from the United States. Examples: boarding pass and/or passport stamps-
original and photocopies.
• Proof of your ties to the United States and your intention to return. Examples: IRS tax form 1040 for last year(s) and
return air ticket to the United States.
• Proof that your stay outside the United States was for reasons beyond your control. If your stay outside of
the United States was due to a medical emergency, you will need to provide a letter from a medical practitioner
translated into English and photocopy of the letter.
• Petition Fee: USD180 per person. The fee will be paid at the Embassy on the day of your interview.

PAYMENT OPTIONS: International credit card or cash (only exact change is accepted, in either U.S. dollars OR Argentine
pesos).

On the day of the appointment, a Consular Officer will review the submitted documentation and conduct a brief interview.
If the Consular Officer determines that a DS-117 applicant qualifies as a Returning Resident, we will then email the
instructions and list of documents required to apply for the immigrant visa within six months.

If the Consular Office determines that the applicant does not qualify as a Returning Resident, the application will be
refused on the grounds that the alien has abandoned their residence in the United States. If the DS-117 is refused, the
fee is not refundable.

The full process can take several months, and therefore we recommend that the person wishing to apply as a returning
resident does so as soon as possible.

Note: The Embassy is closed on weekends and all U.S. and Argentine official holidays
