11. ¿Qué es la Intervención excluyente de propiedad?

En esta intervención un tercero que es propietario de los bienes embargados, podrá
interponer Intervención Excluyente de Propiedad ante el Ejecutor Coactivo en cualquier momento antes que se
inicie el remate del bien.
12. ¿Que es Remate y cuales son sus sistemas y modalidades?
El remate viene a ser la venta de bienes en público, al mejor postor. Es la subasta como acto público dirigido a la
enajenación forzosa. Concurre el juez, las partes y el público, entre el que estarán los posibles licitadores.

Existen dos (02) sistemas de remate: A viva voz y en Sobre Cerrado, a su vez, el Remate se podrá realizar vía dos
modalidades:

1. Oblaje: Consiste en hacer el depósito del monto mínimo para poder postular. Para ello, existen dos modalidades: El
Sistema de posturas a viva voz, cuando se realiza el depósito antes del inicio del remate y el Sistema de sobre
cerrado cuando se presenta el sobre conteniendo la oferta.
2. Arras: El ganador del bien, después de concluido el remate, entregará en calidad de garantía, como mínimo, el
equivalente al treinta por ciento (30%) del monto ofertado.

● La deuda tributaria ha quedado extinguida por cualquiera de los medios señalados en el

Artículo 27 del Código Tributario, por ejemplo, con el pago.

● La Orden de Pago o resolución materia de cobranza hayan sido declaradas nulas, revocadas o
sustituidas después de la notificación de la Resolución de Ejecución Coactiva.

● La persona obligada es declarada en quiebra.

● Una ley o norma con rango de ley lo disponga expresamente.
