Historia del Derecho Procesal
EL DERECHO PROCESAL nace al aparecer el principio, en el cual es ilícito hacerse
justicia por su propia mano, y que los ciudadanos, deben someter sus conflictos al jefe del
grupo social; noción que comienza a desarrollarse cuando se acepta que la autoridad debe
adaptarse a normas previas para administrar justicia.
Historia del Derecho Procesal Romano

El Derecho Romano puede definirse como un sistema de acciones. Acción es el poder jurídico de perseguir en
juicio lo que es debido.

Dentro del Derecho Procesal Romano, pueden distinguirse dos elementos cruciales: a) La acción.
b) La intervención del Estado. En un principio, el Derecho Procesal era más practicado entre los
particulares y fue con el paso de los años que su presencia cobró fuerza en el Derecho Público.

En Roma la iurisdictio es desde el principio y por largo tiempo considerada un poder personal del magistrado que
no comprende la sentencia, es decir, compete a la iurisdictio dar el planteo pero no la solución del caso. A partir
del siglo I d.C. comienza a estructurarse como una función del estado cumplida a través de funcionarios jueces.
Entonces la iurisdictio será más o menos asimilable a la de nuestros días, porque comprenderá también la
facultad de emitir el iudicium o sentencia. En un principio existía una moderada intervención del poder público en
las controversias privadas.
Historia del Derecho Procesal Germano

El Derecho procesal Germano se establecido como una lucha entre partes y tenia lugar ante
asambleas populares en las cuales residía el poder jurisdiccional , limitándose la fusión del juez a
dirigir formalmente el debate y a dictar una solución fina teniendo en cuenta lo discutido en la
asamblea

Eran considerados como peritos en derecho, en los primeros tiempos, y de jueces permanentes
especiales (scabini) durante el denominado período franco (siglos v a xii de nuestra era)

Un acusado debía demostrar su inocencia sometiéndose a pruebas tales como sostener una piedra al
rojo vivo, o agua hirviendo. En ocasiones también se obligaba a los acusados a permanecer largo
tiempo bajo el agua. Si era capaz de soportarlo, se entendía que Dios le ayudaba por no ser culpable.
La naturaleza de las mismas tenía carácter de medio de prueba y juicio de Dios.
