Bienvenido al Sitio web de Universal Mind Health (el “Sitio”), gestionado por Universal
Mind Health, LLC (“Universal Mind Health” o “Nosotros”).

Universal Mind Health es una plataforma que pone en contacto a personas que buscan
servicios de salud mental con psicólogos colegiados. Universal Mind Health no presta
servicios de salud mental, sino que facilita la prestación de dichos servicios por psicólogos
colegiados. Los psicólogos colegiados que aparecen en el Sitio son proveedores
independientes y son los únicos responsables de los servicios que prestan.

Estas Condiciones de Uso (“Condiciones”) establecen los términos y condiciones que rigen
el uso y acceso al Sitio y constituyen un contrato legalmente vinculante entre usted y
Nosotros. Estas Condiciones incorporan todos los términos y condiciones adicionales
publicados por Universal Mind Health a través del Sitio, o puestos a su disposición.

La Política de privacidad (“Política”) describe el modo en que Universal Mind Health puede

cuenta y riesgo del usuario, que deberá cumplir todas las leyes, normas y reglamentos

únicamente para su uso personal y no comercial o con el fin de hacer negocios con
Nosotros.

El Sitio, incluidos todos los contenidos, la información y los materiales incorporados o

puestos a disposición a través del Sitio, son propiedad exclusiva de Universal Mind Health
o de sus proveedores, y están protegidos por la legislación estadounidense e
internacional. Usted se compromete a no acceder ni utilizar el Sitio, ni ningún contenido,

3. NORMAS DE CONDUCTA

En relación con el Sitio, usted se compromete a NO:

● Publicar, transmitir o poner a disposición a través o en relación con el Sitio cualquier

material que sea o pueda ser: (a) amenazador, acosador, degradante, odioso o
intimidatorio, o que de cualquier otra forma no respete los derechos y la dignidad de los
demás; (b) difamatorio, calumnioso, fraudulento o de cualquier otra forma ilícita; (c)
obsceno, indecente, pornográfico o de cualquier otra forma censurable; o (d) protegido
por derechos de autor, marca registrada, secreto comercial, derecho de publicidad o
privacidad o cualquier otro derecho de propiedad, sin el consentimiento expreso previo y
por escrito del propietario correspondiente.
● Insertar o permitir que se inserte en el Sitio cualquier software malicioso o dañino,
incluido, entre otros, cualquier software diseñado para (a) realizar cambios no autorizados
o causar daños en el Sitio o en Materiales de Terceros, tal y como se define más adelante;
(b) copiar, proporcionar acceso no autorizado o impedir el acceso autorizado al Sitio; o (c)
impedir la detección de cualquier invasión no autorizada del Sitio («Malware»).
● Utilizar el Sitio para cualquier fin comercial no autorizado, incluida la competencia con su
nombre comercial, o para cualquier fin fraudulento o de otro modo ilícito o ilegal.
● Recoger o recopilar información sobre los usuarios del Sitio.
● Interferir o interrumpir el funcionamiento del Sitio o de los servidores o redes utilizados
para que el Sitio esté disponible, incluso pirateando o desfigurando cualquier parte del
Sitio; o violar cualquier requisito, procedimiento o política de dichos servidores o redes.
● Restringir o impedir a cualquier otra persona el uso del Sitio.
● Reproducir, modificar, adaptar, traducir, crear obras derivadas, vender, alquilar, arrendar,
prestar, compartir, distribuir o explotar de cualquier otro modo cualquier parte del Sitio (o
cualquier uso del mismo), salvo en los casos expresamente autorizados en el presente
documento.
● Realizar ingeniería inversa, descompilar o desensamblar cualquier parte del Sitio, excepto
cuando dicha restricción esté expresamente prohibida por la legislación aplicable.
● Eliminar del Sitio cualquier aviso de copyright, marca comercial u otros derechos de
propiedad.
● Enmarcar o reflejar cualquier parte del Sitio, o incorporar de otro modo cualquier parte
del Sitio en cualquier producto o servicio.
● Descargar y almacenar sistemáticamente el contenido del Sitio.
● Utilizar cualquier robot, araña, aplicación de búsqueda/recuperación del sitio u otro
dispositivo manual o automático para recuperar, indexar, «raspar», «extraer datos» o
recopilar de cualquier otro modo el contenido del Sitio, o reproducir o eludir la estructura
de navegación o presentación del Sitio, sin el consentimiento expreso previo por escrito
de su razón social. Sin perjuicio de lo anterior, y con sujeción al cumplimiento de las
instrucciones publicadas en el archivo robots.txt ubicado en el directorio raíz del Sitio,
Universal Mind Health concede a los operadores de motores de búsqueda públicos
permiso para utilizar arañas para copiar materiales del Sitio con el único fin de (y
únicamente en la medida necesaria para) crear índices de búsqueda disponibles
públicamente de dichos materiales, pero no cachés ni archivos de dichos materiales.

Usted se compromete a indemnizar, defender y eximirnos de responsabilidad a Nosotros

y a nuestras filiales, directivos, administradores, agentes y empleados por cualquier
reclamación, responsabilidad, daños, sentencias, indemnizaciones, pérdidas, costes,
gastos y honorarios (incluidos los honorarios de abogados) que se deriven o estén

garantizamos que el Sitio esté o vaya a estar actualizado, completo, correcto o seguro, o

(INCLUYENDO NEGLIGENCIA), RESPONSABILIDAD ESTRICTA U OTRA TEORÍA, INCLUYENDO
DAÑOS POR PÉRDIDA DE BENEFICIOS, USO O DATOS, PÉRDIDA DE OTROS INTANGIBLES, O
PÉRDIDA DE SEGURIDAD DE LOS MATERIALES ENVIADOS (INCLUYENDO LA
INTERCEPTACIÓN NO AUTORIZADA POR TERCEROS DE CUALQUIER MATERIAL ENVIADO),
INCLUSO SI SE AVISA CON ANTELACIÓN DE LA POSIBILIDAD DE TALES DAÑOS O
PÉRDIDAS. SIN PERJUICIO DE LO ANTERIOR, USTED ACEPTA QUE UNIVERSAL MIND
HEALTH NO SERÁ RESPONSABLE DE LOS DAÑOS Y PERJUICIOS DE CUALQUIER TIPO
RESULTANTES DE SU USO O IMPOSIBILIDAD DE USO DEL SITIO O DE CUALQUIER
MATERIAL DE TERCEROS, INCLUYENDO CUALQUIER MALWARE O CUALQUIER VIRUS,
GUSANO, HACK, O SOFTWARE MALICIOSO QUE PUEDA SER TRANSMITIDO EN RELACIÓN
CON EL MISMO. USTED RECONOCE Y ACEPTA QUE SU ÚNICO Y EXCLUSIVO REMEDIO EN
CASO DE DISCONFORMIDAD CON EL SITIO ES DEJAR DE USAR EL SITIO. USTED ACEPTA
QUE LA RESPONSABILIDAD TOTAL MÁXIMA DE UNIVERSAL MENT HEALTH POR TODOS
LOS DAÑOS, PÉRDIDAS Y CAUSAS DE ACCIÓN, YA SEA CONTRACTUAL,
EXTRACONTRACTUAL (INCLUIDA LA NEGLIGENCIA) O DE OTRO TIPO, SERÁ DE 100 USD.

La ley aplicable puede no permitir limitaciones en ciertas garantías implícitas, o

exclusiones o limitaciones de ciertos daños; únicamente en la medida en que dicha ley se
aplique a usted, algunas o todas las renuncias, exclusiones o limitaciones anteriores
pueden no aplicarse a usted, y usted puede tener ciertos derechos adicionales.

8. CANCELACIÓN

Universal Mind Health podrá rescindir o suspender su acceso al Sitio en cualquier

momento, con o sin causa o aviso, incluso si consideramos que usted ha infringido o

9. NOTIFICACIÓN DE INFRACCIÓN DE DERECHOS DE AUTOR

Estas Condiciones se regirán por las leyes de Estados Unidos. Cualquier controversia

Universal Mind Health is a platform that connects individuals seeking mental health
services with licensed psychologists. Universal Mind Health does not provide mental
health services itself, but rather facilitates the provision of such services by licensed
psychologists. The licensed psychologists listed on the Site are independent providers and
are solely responsible for the services they provide.

These Terms of Use (“Terms”) state the terms and conditions governing your use of and
access to the Site and constitute a legally binding contract between you and your business
name. These Terms incorporate any additional terms and conditions posted by Universal
Mind Health through the Site, or otherwise made available to you by your business name.

The Privacy Policy (“Policy”) describes how Universal Mind Health may use and disclose
information that we may collect about all users and viewers through the Site.

3. RULES OF CONDUCT

In connection with the Site, you agree NOT to:

which the reCAPTCHA service uses to evaluate your use of the Site. By using the

UNAUTHORIZED INTERCEPTION BY THIRD PARTIES OF ANY SUBMITTED MATERIALS), EVEN
IF ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. WITHOUT

8. TERMINATION

suspension, (a) your right to access and use the Site will immediately cease; (b) Universal
Mind Health may immediately deactivate or delete your user name, password and

and may retain or delete such materials in your business name’s sole discretion; and (d)
except for the license granted to you to access and use the Site, the remaining provisions

10. GOVERNING LAW AND JURISDICTION

These Terms are governed by, and will be construed in accordance with the laws of the
United States and is not intended to subject us to the laws or jurisdiction of any state,
country or territory other than the United States.

This Terms shall be governed by the laws of the United States. Any dispute relating to the
interpretation, validity or enforceability of these Terms shall be resolved in the Courts
located in the State of Wyoming. The parties expressly waive any other jurisdiction and/or
venue to which they may be entitled.

entire agreement between you and Universal Mind Health relating to the subject matter
hereof, and supersede any and all prior or contemporaneous written or oral agreements
or understandings between you and Universal Mind Health relating to such subject
matter. Notices to you (including notices of changes to these Terms) may be made via
posting to the Site or by email (including in each case via links), or by regular mail. Without
limitation, a printed version of these Terms and of any notice given in electronic form will
be admissible in judicial or administrative proceedings based upon or relating to these
Terms to the same extent and subject to the same conditions as other business
documents and records originally generated and maintained in printed form. Universal
Mind Health will not be responsible for any failure to fulfill any obligation due to any cause
