II. ANTECEDENTES:

2.1. Mediante la ADJUDICACIÓN SIMPLIFICADA N°031-2022- MPM/CSP PRIMERA

CONVOCATORIA, se adjudica la ejecución de la obra : “CREACIÓN DEL PARQUE DEL
AGUA EN LA URBANIZACIÓN VISTA ALEGRE DE LA CIUDAD DE MOYOBAMBA,
PROVINCIA DE MOYOBAMBA - SAN MARTÍN”, con código único de inversiones Nº
2329818 al CONSORCIO AQUA II, integrado por las empresas (EMPRESA WAYRA
GROUP S.A.C. CON 40% REPRESENTADO POR SR. ALEX LUDVIN BAZAN
BUSTAMANTE Y PRINCOR S.A.C. CON 60% REPRESENTADO POR EL SR. OSCAR
MANUEL JESUS PINEDA REATEGUI)

2.2. Con fecha 20 de diciembre del 2022, se celebra el CONTRATO N°084-2022-MPM entre
la MUNICIPALIDAD PROVINCIAL DE MOYOBAMBA y el CONSORCIO AQUA II, cuyo
objeto es la ejecución de la obra: “CREACIÓN DEL PARQUE DEL AGUA EN LA
URBANIZACIÓN VISTA ALEGRE DE LA CIUDAD DE MOYOBAMBA, PROVINCIA DE
MOYOBAMBA - SAN MARTÍN”, con código único de inversiones Nº 2329818.

2.3. Con fecha 28 de diciembre de 2022, se celebra el CONTRATO N°096-2022-MPM, entre

la MUNICIPALIDAD PROVINCIAL DE MOYOBAMBA Y EL CONSORCIO SUPERVISOR
AMAZONAS, para la supervisión de la obra: “CREACIÓN DEL PARQUE DEL AGUA EN
LA URBANIZACIÓN VISTA ALEGRE DE LA CIUDAD DE MOYOBAMBA, PROVINCIA
DE MOYOBAMBA - SAN MARTÍN”, con código único de inversiones Nº 2329818.

2.4. Con fecha 04 de enero, se firma el ACTA DE ENTREGA DE TERRENO entre los
representantes de la MUNICIPALIDAD PROVINCIAL DE MOYOBAMBA el Ing. Gunter
Alonso Vela Villacorta como Gerente Municipal, Ing. César Augusto Rocha Sandoval,
como Gerente de Desarrollo Territorial; asimismo el Sr. Alex Ludvin Bazán Bustamante
Como Representante Común del “CONSORCIO AQUA II”, Ing. Cayo Mori Macedo,
como Residente De Obra, Ing. Julio Cesar Diaz Huamán como Representante de
“CONSORCIO SUPERVISOR AMAZONAS.”, Ing. Lita Cecilia Vilca García como
Supervisor De Obra.

2.5. Con fecha 05 de enero firman el ACTA DE INICIO DE OBRA entre los representantes de
la MUNICIPALIDAD PROVINCIAL DE MOYOBAMBA el Ing. Gunter Alonso Vela
Villacorta como Gerente Municipal, Ing. César Augusto Rocha Sandoval, como Gerente
de Desarrollo Territorial; asimismo el Sr. Alex Ludvin Bazán Bustamante Como
Representante Común del “CONSORCIO AQUA II”, Ing. Cayo Mori Macedo, como

2.6. De esta manera se Inicia de manera física el inicio del plazo contractual de obra con la
ejecución de las partidas de Obras Provisionales así mismo, se hace apertura del
cuaderno de obra digital.

2.7. Con fecha 20 de enero de 2023, el CONSORCIO AQUA II, hace llegar a la supervisión el
Informe de Compatibilidad del Proyecto de acuerdo a los plazos previstos en el RLC.

2.8. Con fecha 31 de marzo de 2023, mediante la CARTA N° 144931-03-2023/CSA/CAII el

CONSORCIO AQUA II, hace llegar a la supervisión el Informe de valorización
contractual N° 03 correspondiente al mes de marzo – 2023.

2.9. Con fecha 07 de abril de 2023, mediante CARTANº 008- LCVG- CSA-2023 el
SUPERVISOR presenta el Informe N° 007-LCVG-CSA-2023 donde el Supervisor de
Obra Ing° Lita Cecilia Vilca García.

III. BASE LEGAL:

➢ LEY DE CONTRATACIONES DEL ESTADO Y SU REGLAMENTO (Aprobado por

D.S.N° 344-2018-EF).

➢ CONTRATO N° 084-2022-MPM

IV. CAUSAS QUE ORIGINA LA ACTUALIZACION DEL PROGRAMA DE EJECUCION DE

OBRA

Mediante Informe el Informe N° 007-LCVG-CSA-2023 donde el Supervisor de Obra Ing°

Lita Cecilia Vilca García en el item 4.1. CONCLUSIONES refiere que .. “ La diferencia
que existe en entre Avance de Obra Programado y el Avance de Obra físico Real es de
13.89 %, encontrándose actualmente como ATRASADA”, lo que significa que la
valorización acumulada al mes de marzo es menor al 80% del monto de la valorización
acumulada programada al mes de marzo.

Mediante cuaderno de obra, el supervisor de obra suscribe en el asiento N° 233, del 01

de abril 2023 la supervisión solicita al contratista que en cumplimiento al art. 203.1, la
presentación de calendario acelerado de trabajos lo cual hasta la fecha no ha sido
cumplido por la contratista según el previsto en el término de siete (7) días siguientes.
por lo que se insta al cumplimiento de los plazos establecidos de acuerdo a ley.

Mediante cuaderno de obra, el residente de obra suscribe en el asiento N° 247, del 10
de abril 2023 la contratista hace llegar la presentación de calendario acelerado de
trabajos mediante CARTA N° 145410-04-2023/CSA/CAII en respuesta al asiento 233 del
supervisor.

V. PRONUNCIAMIENTO DE LA SUPERVISION :

Con fecha 10 de febrero de 2023, el Residente de obra presenta ante la supervisión el

calendario acelerado de trabajos en cumplimiento al Art. 203.1

De lo planteado por el Residente de obra la Supervisión ha realizado la verificación de

las actividades reprogramados en el tiempo previsto de acuerdo al saldo de obra que
aún resta valorizar, dicho planteamiento cumple con lo establecido en el Reglamento
Nacional de Edificaciones y amparado en la Ley de Contrataciones del Estado y su
Reglamento (aprobado por D.S.N° 344-2018-EF)

V. CONCLUSIONES Y RECOMENDACIONES:

6.1. La presentación del calendario reprogramado por el Contratista cumple con lo

especificado en el Art. 203.1 de la Ley de Contrataciones del Estado y su
Reglamento.

6.2. Por todo lo manifestado y sustentado anteriormente con la documentación

respectiva es acorde con los plazos establecidos, por lo que la SUPERVISIÓN se
PRONUNCIA DE MANERA CONFORME al CALENDARIO ACELERADO DE
TRABAJOS, presentado por la contratista CONSORCIO AQUA II, en cumplimento
con el Art. 203.2 en la Ley de Contrataciones del Estado y su Reglamento.

6.3. Se recomienda que el presente informe sea tramitado ante la GERENCIA DE

DESARROLLO TERRITORIAL DE LA MUNICIPALIDAD PROVINCIAL DE
MOYOBAMBA, para su conocimiento y demás fines
