De una parte el Señor Brigadier General (RA) LUIS FERNANDO PUENTES TORRES Ph.D. mayor de
edad, identificado con cédula de ciudadanía Nº 3.181.609 de Bogotá, en su condición de Rector de la
Universidad Militar Nueva Granada, cargo para el cual fue nombrado mediante Acuerdo N° 06 del 15 de
julio de 2019 del Consejo Superior Universitario, posesionado mediante Acta No. 09 del 15 agosto de
2019, en nombre y representación de la UNIVERSIDAD MILITAR NUEVA GRANADA, entidad de
educación superior, creada mediante Decreto 84 del 23 de enero de 1980, reconocida institucionalmente
como Universidad mediante Resolución Nº 12975 del 23 de julio de 1982 del Ministerio de Educación
Nacional, organizada mediante Acuerdo Nº 013 del 10 de noviembre de 2010 del Consejo Superior
Universitario, ente universitario autónomo del orden Nacional, con régimen especial de conformidad con
lo establecido en la Ley 805 del 11 de abril de 2003, y dentro del marco de la Ley 30 de 1992, con
competencia para celebrar Convenios,  que para efectos del presente Convenio se denominará la UMNG.
Por otra parte (Nombre del representante legal) mayor de edad Identificado con Cédula de Ciudadanía
No. __________ de ___________, quien actúa en calidad de Representante Legal, _____________, según
consta en Certificado de Existencia y Representación Legal, y quien, a su vez, actúa en nombre y
representación de la University of Connecticut., completar datos institucionales de existencia, creación y
reconocimiento, quien en adelante se denominará UCONN
Manifiestan su compromiso de colaboración institucional para el desarrollo del proyecto de investigación
titulado: «Biosensing-IoT: Internet of things testbed for next generation of biosensors in 5G
scenarios», por medio del presente Convenio especial de Cooperación, de acuerdo con las siguientes
consideraciones:

On the one hand, Brigadier General (RA) LUIS FERNANDO PUENTES TORRES Ph.D. of legal age,
identified with citizenship card No. 3.181.609 of Bogotá, in his capacity as Rector of the Universidad
Militar Nueva Granada, a position to which he was appointed by Agreement No. 06 of July 15, 2019 of
the University Superior Council, sworn in by Act No. 09 of August 15, 2019, in the name and on behalf
of the UNIVERSIDAD MILITAR NUEVA GRANADA, in his capacity as Rector of the Universidad
Militar Nueva Granada. 09 of August 15, 2019, in the name and on behalf of the UNIVERSIDAD
MILITAR NUEVA GRANADA, a higher education entity, created by Decree No. 84 of January 23,
1980, institutionally recognized as a University by Resolution No. 12975 of July 23, 1982 of the
Ministry of National Education, organized by Agreement No. 013 of November 10, 2010 of the Higher
University Council, autonomous university entity of the National order, with special regime in
accordance with the provisions of Law 805 of April 11, 2003, and within the framework of Law 30 of
1992, with competence to enter into Agreements, which for the purposes of this Agreement shall be
called the UMNG.
On the other hand (Name of the legal representative) of legal age identified with Citizen's Identity Card
No. __________ of ___________, who acts as Legal Representative, _____________, as stated in the
Certificate of Existence and Legal Representation, and who, in turn, acts on behalf of the University of
Connecticut, complete institutional data of existence, creation and recognition, which hereinafter will be
called UCONN.
State their commitment to institutional collaboration for the development of the research project entitled:
"Biosensing-IoT: Internet of things testbed for next generation of biosensors in 5G scenarios", by
means of this Special Cooperation Agreement, in accordance with the following considerations:

Universidad Militar Nueva Granada y la University of Connecticut.
CONSIDERACIONES:
PRIMERA. Que el artículo 96 de la ley 489 de 1998 menciona que “Las entidades estatales, cualquiera
sea su naturaleza y orden administrativo podrán, con la observación de los principios señalados en el
artículo 209 de la Constitución, asociarse con personas jurídicas particulares, mediante la celebración de
convenios de asociación o la creación de personas jurídicas, para el desarrollo conjunto de actividades
en relación con los cometidos y funciones que les asigna a aquéllas la ley”.
SEGUNDA. Que el artículo 1° de la ley 29 de 1990, modificada por la ley 1286 de 2009, establece que
“Corresponde al Estado promover y orientar el adelanto científico y tecnológico y, por lo mismo, está
obligado a incorporar la ciencia y la tecnología a los planes y programas de desarrollo económico y
social del país y a formular planes de ciencia y tecnología tanto para el mediano como para el largo
plazo. Así mismo, deberá establecer los mecanismos de relación entre sus actividades de desarrollo
científico y tecnológico y las que, en los mismos campos, adelanten la universidad, la comunidad
científica y el sector privado colombianos”.
TERCERA. Que el artículo 1° del Decreto 393 de 1991 “Por el cual se dictan normas sobre asociación
para adelantar actividades científicas y tecnológicas, proyectos de investigación y creación de
tecnologías” establece que para adelantar las mencionadas actividades “Nación y sus Entidades
descentralizadas podrán asociarse con los particulares bajo dos modalidades” entre las que se contempla
“la celebración de Convenios Especiales de Cooperación”. Según lo confirmó la Sentencia C-316 del 13
de julio de 1995 de la Corte Constitucional, la cual declaró exequible el numeral 2° del Artículo 1° de la
norma en mención.
CUARTA. Que, según las reglas legales establecidas, por el artículo 7° del Decreto 393 de 1991, para los
Convenios Especiales de Cooperación: “Estos convenios se regirán por las normas del Derecho Privado”.
Régimen legal confirmado por la Sentencia C-316 del 13 de julio de 1995 de la Corte Constitucional, al
declarar exequible la expresión citada.
QUINTA. Que el artículo 17 del Decreto 591 de 1991, estipula que “para adelantar actividades
científicas o tecnológicas la Nación y sus entidades descentralizadas podrán celebrar con los particulares

CONSIDERATIONS:
FIRST. That Article 96 of Colombian Law 489 of 1998 states that "State entities, whatever their nature
and administrative order may, in compliance with the principles set forth in Article 209 of the
Constitution, associate with private legal entities, through the execution of association agreements or the
creation of legal entities, for the joint development of activities in relation to the tasks and functions
assigned to them by law".
SECOND: Article 1 of Colombian Law 29 of 1990, modified by Law 1286 of 2009, establishes that "It
is the responsibility of the State to promote and guide scientific and technological progress and,
therefore, it is obliged to incorporate science and technology into the plans and programs for the
economic and social development of the country and to formulate science and technology plans for both
the medium and long term. Likewise, it must establish the mechanisms of relationship between its
scientific and technological development activities and those that, in the same fields, are carried out by
the university, the scientific community and the Colombian private sector".
THIRD: Article 1 of Decree 393 of 1991 of the Office of the President of Colombia, "By which rules
are issued on association to carry out scientific and technological activities, research projects and
creation of technologies", establishes that to carry out the mentioned activities "the Nation and its
decentralized entities may associate with individuals under two modalities" among which "the
celebration of Special Cooperation Agreements" is contemplated. As confirmed by Ruling C-316 of July
13, 1995 of the Colombian Constitutional Court, which declared numeral 2 of Article 1 of the
aforementioned norm to be constitutional.
FOURTH: That, according to the legal rules established by Article 7 of the aforementioned Decree 393
of 1991, for the Special Cooperation Agreements: "These agreements shall be governed by the rules of
Private Law". Legal regime confirmed by Ruling C-316 of July 13, 1995 of the Constitutional Court,
when it declared the aforementioned expression executory.
FIFTH. Article 17 of Decree 591 of 1991, stipulates that "in order to carry out scientific or technological

y con otras entidades públicas de cualquier orden convenios especiales de cooperación. En virtud de
estos convenios, las personas que los celebran aportan recursos en dinero, en especie o de industria, para
facilitar, fomentar o desarrollar alguna de las actividades científicas o tecnológicas”.
SEXTA: Que el artículo 33 de la ley 1286 de 2009 establece que “Las actividades, contratos y convenios
que tengan por objeto la realización de actividades definidas como de ciencia, tecnología e innovación
que celebren las entidades estatales, continuarán rigiéndose por las normas especiales que les sean
aplicables. En consecuencia, tales contratos se celebrarán directamente”.
SÉPTIMA: Que la Universidad Militar Nueva Granada a través de la Vicerrectoría de Investigaciones
abrió la CONVOCATORIA INTERNA PARA LA CONFORMACIÓN DE UN BANCO DE PROYECTOS
DE INVESTIGACIÓN - VIGENCIA 2021; cuyo objetivo es: «Fomentar y fortalecer las capacidades
institucionales de CTeI existentes en la Universidad Militar Nueva Granada mediante la financiación de
proyectos que aporten, desde la investigación científica, en la superación de problemáticas evidenciadas
en el actual contexto sanitario global»; dicha convocatoria es de acceso público a través de la página web
de la Universidad.
OCTAVA: Entre las propuestas presentadas se radicó la propuesta de investigación científica titulada
«Biosensing-IoT: Internet of things testbed for next generation of biosensors in 5G scenarios» , la
cual fue presentada en conjunto con la UCONN junto a la respectiva carta de aval o intención referenciada
en el literal J del numeral 11.1 de la convocatoria mencionada en el considerando anterior.
NOVENA: Que la Universidad Militar Nueva Granada a través de la Vicerrectoría de Investigaciones
efectuó la publicación de la lista titulada PROYECTOS ELEGIBLES Y FINANCIABLES DE LA
CONVOCATORIA INTERNA PARA LA CONFORMACIÓN DE UN BANCO DE PROYECTOS DE
INVESTIGACIÓN, VIGENCIA 2021, entre las cuales se incluyó la propuesta de investigación objeto del
presente Convenio Especial de Cooperación, el cual se regirá por las siguientes:
CLÁUSULAS:
PRIMERA. OBJETO. Aunar esfuerzos para el desarrollo conjunto del proyecto de investigación

activities, the Nation and its decentralized entities may enter into special cooperation agreements with
private individuals and other public entities of any order. By virtue of these agreements, the persons who
enter into them contribute resources in money, in kind or industry, to facilitate, promote or develop any
of the scientific or technological activities".
SIXTH: That Article 33 of Law 1286 of 2009 establishes that "The activities, contracts and agreements
whose purpose is to carry out activities defined as science, technology and innovation entered into by
state entities shall continue to be governed by the special rules applicable to them. Consequently, such
contracts shall be entered into directly".
SEVENTH: That the Universidad Militar Nueva Granada through the Vice Rector's Office of Research
opened the INTERNAL CALL FOR THE CONFORMATION OF A RESEARCH PROJECT BANK -
VIGENCIA 2021; whose objective is: "To promote and strengthen the institutional capacities of CTeI
existing in the Universidad Militar Nueva Granada through the financing of projects that contribute,
from scientific research, in overcoming problems evidenced in the current global health context"; said
call is publicly accessible through the University's website.
EIGHTH: Among the proposals submitted, the scientific research proposal entitled "Biosensing-IoT:
Internet of things testbed for next generation of biosensors in 5G scenarios" was filed. which was
submitted jointly with UCONN together with the respective letter of endorsement or intention referenced
in paragraph J of numeral 11.1 of the call mentioned in the preceding recital.
NINTH: That the Universidad Militar Nueva Granada through the Vice Rector's Office of Research
published the list entitled ELIGIBLE AND FUNDABLE PROJECTS OF THE INTERNAL CALL FOR
THE CONFORMATION OF A BANK OF RESEARCH PROJECTS, PERIOD 2021, among which was
included the research proposal object of this Special Cooperation Agreement, which shall be governed
by the following:

científica titulado «Biosensing-IoT: Internet of things testbed for next generation of biosensors in 5G
scenarios».

SEGUNDA. ALCANCE DEL OBJETO. Constituyen objetivos de investigación del proyecto los
siguientes: «Objetivo general: Diseñar e implementar un sistema de prueba de soluciones de
conectividad aplicable a las medidas de biosensores diseñados por el Biosignal Processing and
Wearable Device Lab de la Universidad de Connecticut, utilizando escenarios de conectividad 5G con
SDR y arquitecturas de edge computing y cloud computing disponibles en el Wirid Lab de la UMNG.».
Siendo los objetivos específicos, los siguientes:
1. Caracterizar los parámetros de captura y transmisión de las señales de los biosensores diseñados
por el Biosignal Processing and Wearable Device Lab de la Universidad de Connecticut, con el
fin de ser transmitidos.

2. Diseñar e implementar escenarios de prueba para la conectividad entre los biosensores y los
sistemas de de análisis de datos, por medio de una red 5G, mediante tecnologías de wireless
personal area network (WPAN) como gateways LoRA, Bluetooth Low Energy -BLE, ZigBee y
WiFi IEEE802.11ah.

3. Diseñar un modelo de pruebas de concentración de señales para despliegue remoto utilizando el

modelo de gestión del laboratorio Wirid-Lab basado en kubernetes y contenedores.

4. Desplegar los experimentos remotos en cada escenario para establecer los parámetros de
desempeño como throughput, QoS, BER, ancho de banda necesario y consumo energético medio.

5. Generar un modelo de selección de opciones de comunicación dependiente del tipo de biosensor,

el entorno de usuario y la aplicación relacionada con los parámetros analizados.

TERCERA. VALOR DEL CONVENIO Y APORTES. El presente Convenio tendrá un valor total de
CIENTO SETENTA Y SEIS MILLONES NOVECIENTOS SESENTA Y UN MIL
 Convenio Especial de Cooperación No. IMP-ING-3487 de 2021 suscrito entre la Special Cooperation Agreement No. IMP-ING-3487 of 2021 subscribed between the

OCHOCIENTOS CINCUENTA Y SIETE PESOS COLOMBIANOS M/L ($176.961.857,00)

aportados de la siguiente manera y distribuidos según lo establece la estructura presupuestal de la
propuesta de investigación titulada. «Biosensing-IoT: Internet of things testbed for next generation of
biosensors in 5G scenarios». Los aportes en recurso fresco serán ejecutados directamente en cada
Institución:

a) La UMNG hace un aporte de: SETENTA Y NUEVE MILLONES NOVECIENTOS SESENTA Y

SEIS MIL SETECIENTOS SETENTA Y DOS PESOS COLOMBIANOS M/L ($79.966.772) de
recurso en efectivo y OCHENTA Y TRES MILLONES OCHOCIENTOS SESENTA MIL
OCHENTA Y TRES PESOS COLOMBIANOS M/L ($83.860.083) de aporte en especie.
b) La UCONN hace un aporte de TRECE MILLONES CIENTO TREINTA Y CINCO MIL DOS
PESOS COLOMBIANOS M/L ($13.135.002) de aporte en especie.

CUARTA. OBLIGACIONES CONJUNTAS DE LA UMNG Y UCONN
1). Garantizar la dedicación de los investigadores. 2) Contar con el presupuesto comprometido para el
desarrollo del proyecto. 3) Destinar un responsable para hacer seguimiento al desarrollo del proyecto. 4)
Presentar los informes de ejecución técnica y financiera final según lo establecido en el presente
Convenio. 5) Mantener durante la vigencia del Convenio a los investigadores indicados en la propuesta de
investigación. 6) Informar previamente a la UMNG la modificación con relación a los investigadores y
cambios en la investigación. 7) indicar en toda publicación, actividades y materiales divulgativos que son
resultado de una investigación científica realizada conjuntamente entre la UMNG y la UFSC. 8) Cumplir
con la entrega de informes, actividades, cronograma y resultados de investigación indicados en la
propuesta de investigación. 9) Suscribir los documentos a que haya lugar para la liquidación del presente
Convenio y los necesarios para la protección de resultados protegibles mediante propiedad intelectual. 10)
Dar cumplimiento a las respectivas obligaciones con los sistemas de salud, pensión, riesgo laborales y
FOURTH. JOINT OBLIGATIONS BETWEEN UMNG AND UCONN
1). To guarantee the dedication of the researchers. 2) To have the budget committed for the development
of the project. 3) To assign a person responsible for monitoring the development of the project. 4)
Submit the final technical and financial execution reports as established in this Agreement. 5) Maintain
the researchers indicated in the research proposal during the term of the Agreement. 6) Inform UMNG in
advance of any modifications regarding the researchers and changes in the research. 7) To indicate in all
publications, activities and dissemination materials that they are the result of scientific research
conducted jointly between UMNG and UFSC. 8) Comply with the delivery of reports, activities,
schedule and research results indicated in the research proposal. 9) To sign the necessary documents for
the liquidation of this agreement and those necessary for the protection of results that can be protected by
intellectual property. 10) To comply with the respective obligations with the health, pension, labor risk
and parafiscal systems in accordance with the established in the national regulations, 11) The other

financiados o cofinanciados por la UMNG en los programas de CTeI.
DÉCIMA QUINTA. CONFIDENCIALIDAD Y PUBLICACIÓN DE RESULTADOS . La UMNG y
la UFSC se comprometen a no difundir información técnica perteneciente a la otra institución firmante.
Los datos e informes obtenidos durante la realización del proyecto tendrán carácter de confidencialidad
cuando así sea catalogado por la UMNG y la UFSC. Las instituciones firmantes se encargarán de
mantener la confidencialidad, reserva y debida custodia de cualquier información del proceso de
investigación, así como, de la protección del resultado del proyecto, por medio de la suscripción de
acuerdos de confidencialidad. En todo caso, las instituciones firmantes estarán facultadas para: (i) publicar
o divulgar los resultados de investigación derivados de sus actividades en el proyecto y (ii) usar los datos e
información obtenida o recibida, a partir de la ejecución del Convenio en otros proyectos de investigación,
siempre que esta información no haya sido catalogada como confidencial.
Las obligaciones de confidencialidad descritas en la presente cláusula, no serán aplicables a aquellos
eventos en que la UMNG o la UFSC puedan establecer mediante prueba idónea lo siguiente:  (a)  que tal
información pertenezca, o haya pasado a pertenecer al dominio público, siempre que no sea consecuencia
de acciones u omisiones imputables a la otra parte; (b) estuviera en posesión de la UMNG o la UFSC
antes de que haya sido entregada o desarrollada por la otra parte; o (c) sea divulgada por mandato legal,
judicial, administrativo u otro de similar naturaleza.
SEXTA. ENTREGA DE INFORMES. Los informes de avance y finales, técnicos y financieros, deberán
ser presentados en los tiempos descritos a continuación:

the evaluation criteria of external collaboration, set forth in these terms of reference.
8 (1) Young researcher enrolled to the project for a minimum of eight months according to
the criteria of the current Resolution on personnel enrolling to research projects financed
or co-financed by the UMNG in the CTeI programs.
FIFTEENTH. CONFIDENTIALITY AND PUBLICATION OF RESULTS. UMNG and UFSC
pledge not to disseminate technical information belonging to the other signatory institution. The data and
reports obtained during the execution of the project will be treated as confidential when so classified by
UMNG and UFSC. The signatory institutions will be responsible for maintaining the confidentiality,
reserve and due custody of any information of the research process, as well as the protection of the
results of the project, through the signing of confidentiality agreements. In any case, the signatory
institutions will be authorized to: (i) publish or disclose the research results derived from their activities
in the project and (ii) use the data and information obtained or received, from the execution of the
Agreement in other research projects, as long as this information has not been classified as confidential.
The confidentiality obligations described in this clause shall not apply to those events in which UMNG
or UFSC can establish by means of suitable evidence the following: (a) that such information belongs,
or has come into the public domain, provided that it is not a consequence of actions or omissions
attributable to the other party; (b) was in the possession of UMNG or UFSC before it was delivered or
developed by the other party; or (c) is disclosed by legal, judicial, administrative or other similar
mandate.
SIXTH. SUBMISSION OF REPORTS. The progress and final technical and financial reports shall be
submitted within the times described below:

protección se requiere con anterioridad a la liquidación contractual de este Convenio, sin perjuicio de
acuerdos adicionales. El mecanismo de protección, modalidad de explotación y de transferencia
tecnológica serán establecidos mediante convenios específicos suscritos entre las instituciones.
Parágrafo segundo:  La UMNG y la UFSC garantizarán lo necesario para que las personas naturales
creadoras de las obras científicas o técnicas incorporadas a los resultados de los proyectos desarrollados
transfieran los derechos a favor de la institución respectiva.
DÉCIMA QUINTA. CONFIDENCIALIDAD Y PUBLICACIÓN DE RESULTADOS . La UMNG y
la UFSC se comprometen a no difundir información técnica perteneciente a la otra institución firmante.
Los datos e informes obtenidos durante la realización del proyecto tendrán carácter de confidencialidad
cuando así sea catalogado por la UMNG y la UFSC. Las instituciones firmantes se encargarán de
mantener la confidencialidad, reserva y debida custodia de cualquier información del proceso de
investigación, así como, de la protección del resultado del proyecto, por medio de la suscripción de
acuerdos de confidencialidad. En todo caso, las instituciones firmantes estarán facultadas para: (i) publicar
o divulgar los resultados de investigación derivados de sus actividades en el proyecto y (ii) usar los datos e
información obtenida o recibida, a partir de la ejecución del Convenio en otros proyectos de investigación,
siempre que esta información no haya sido catalogada como confidencial.
Las obligaciones de confidencialidad descritas en la presente cláusula, no serán aplicables a aquellos
eventos en que la UMNG o la UFSC puedan establecer mediante prueba idónea lo siguiente:  (a)  que tal
información pertenezca, o haya pasado a pertenecer al dominio público, siempre que no sea consecuencia

FIFTEENTH. CONFIDENTIALITY AND PUBLICATION OF RESULTS. UMNG and UFSC

UMNG and UFSC. The signatory institutions will be responsible for maintaining the confidentiality,
reserve and due custody of any information of the research process, as well as the protection of the
results of the project, through the signing of confidentiality agreements. In any case, the signatory
institutions will be authorized to: (i) publish or disclose the research results derived from their activities
in the project and (ii) use the data and information obtained or received, from the execution of the

invenciones que hayan sido desarrolladas con el apoyo de comunidades, se deberá mencionar su
participación e incluir su colaboración en cuanto a la titularidad de los derechos patrimoniales cuando sea
generada con base en su contribución intelectual o conocimientos tradicionales, para lo cual las
instituciones participantes realizarán las consultas cuando sea necesario. La custodia y cuidado de los
productos tecnológicos estará a cargo de la UMNG y la UFSC de conformidad con el acuerdo que se
realice entre las mismas.
DÉCIMA OCTAVA. DOCUMENTOS DEL CONVENIO. Hacen parte integral del presente Convenio
y en consecuencia producen los mismos efectos vinculantes y obligaciones jurídicas entre la UMNG y la
UFSC, en cuanto sean aceptados y comunicados por los interlocutores identificados en el presente

SIXTEENTH. OWNERSHIP OF EQUIPMENT. The equipment acquired with the resources of the
present project shall belong to the institution that made the economic contributions for its acquisition,
without any additional act being necessary for its declaration. In any case, priority shall be given to the
use of such equipment for the execution of the project during the term of this Agreement.
SEVENTEENTH. RECOGNITION OF COMMUNITIES. When publications and/or inventions that
have been developed with the support of communities arise, their participation shall be mentioned and
their collaboration shall be included as regards the ownership of the patrimonial rights when it is
generated based on their intellectual contribution or traditional knowledge, for which the participating

DÉCIMA NOVENA. EXCLUSIÓN DE RELACIÓN LABORAL. La UMNG y la UFSC dejan
expresamente establecido que en virtud del presente Convenio y al no existir subordinación o dependencia
alguna entre ellas, no contraerán derechos y obligaciones propios de una relación laboral, por lo que la
UMNG y la UFSC  quedan expresamente exoneradas de toda responsabilidad por este concepto. Se
entiende que las obligaciones que surgen de este Convenio son de carácter institucional y que, por lo tanto,
la UMNG y UFSC no asumen compromisos individuales de orden laboral alguno con los funcionarios o
contratistas de la otra institución y que participen en el desarrollo del Convenio.
NINETEENTH. EXCLUSION OF LABOR RELATIONSHIP. UMNG and UFSC expressly state
that by virtue of this Agreement and in the absence of any subordination or dependence between them,
they will not contract rights and obligations of an employment relationship, so that UMNG and UFSC
are expressly exonerated from any liability for this concept. It is understood that the obligations arising
from this Agreement are of an institutional nature and that, therefore, UMNG and UFSC do not assume
any individual labor commitments with the employees or contractors of the other institution who
participate in the development of the Agreement.
