EPS offers 48 seismic isolators of model FPT6122/14-12/10-6 for the Hospital de Cutervo.
The isolators are offered as a Triple Pendulum isolators that have capacities for vertical and
lateral loads, and lateral displacements that exceed the requirements of the attached project
specifications dated July 2016 and the final drawings sent in April 10th.. The properties of the
isolators comply with the isolator design criteria for Continued Functionality, including drifts
less than 3/1000, and median floor spectra accelerations less than 0.4g. The isolators are
offered in accordance with the attached specifications and terms.
The cost of 48 isolators delivered to the site in Cajamarca is $144,000, including testing,
shipping, nationalizing and IGV tax. The 48 isolators can be delivered to the site 12 weeks from
receipt of the signed acceptance of this offer, and payment of deposit of $29,000, and 8 weeks
after receipt of balance payment of $115,000.

ESPECIFICACIONES TÉCNICAS - REQUERIMIENTOS TÉCNICOS MÍNIMOS
AISLADORES SÍSMICOS
1. RESUMEN
Estas especificaciones técnicas incluyen requisitos para la preparación de planos de fábrica,
fabricación, ensayo, manipulación, transporte y almacenamiento en obra de los dispositivos
de aislamiento sísmico requeridos para el edificio del proyecto Hospital de Cutervo.
1.3.1. Treinta y seis (36) aisladores de tipo elastoméricos con núcleo de plomo, con
las características indicadas en las presentes especificaciones, para ser colocados en
obra.
1.3.2. Dos aisladores sísmicos de prototipo por cada tipo de aislador, idénticos a los
mencionados en el acápite 1.3.1, que serán sometidos a ensayos de laboratorio en
conformidad con estas especificaciones. Los aisladores de prototipo no podrán ser
utilizados en obra.
2. REFERENCIAS
La fabricación, ensayo, transporte, manipulación y mantenimiento del sistema de aislamiento
sísmico debe satisfacer, según corresponda, los requisitos de estas especificaciones y de las
últimas versiones de las siguientes normas y estándares:

3.1. El sistema de aislamiento sísmico considerado para este proyecto consiste en apoyos
elastoméricos con núcleo de plomo.
3.2. Los aisladores provistos por el fabricante deben permitir la posibilidad de reemplazo.
3.4. El diseño del sistema de aislamiento en la base considera el uso de un solo tipo de
aislador, a ubicarse en las posiciones indicadas en los planos estructurales del
proyecto.

Donde D, L y EM denotan las cargas muertas y vivas, y las producidas por el sismo
máximo considerado sobre los aisladores, respectivamente.
3.9. Los factores de seguridad deben ser como mínimo los siguientes:
3.9.1. Factor de seguridad para la estabilidad del aislador sísmico para cargas
estáticas: 3.0.
3.9.2. Factor de seguridad para la rotura del caucho para la deformación sísmica
total máxima del aislador será mayor o igual a 1.0.
3.10. Los aisladores deben contar con placas de montaje que permitan una fijación adecuada
a la súper y sub-estructuras, impidiendo la rotación del aislador en relación a las
columnas.
4. CRITERIOS DE DESEMPEÑO
4.2.1. Cada uno de los aisladores debe ser capaz de deformarse lateralmente un
desplazamiento igual al desplazamiento total máximo, soportando las cargas
verticales máximas, y manteniendo incrementos positivos de rigidez.

5. INFORMACIÓN DE RESPALDO
5.2. Se deberá enviar al cliente los planos de fabricación de los aisladores. Los
planos de fabricación deben indicar, como mínimo, el tipo de aislador, las
dimensiones del aislador, las tolerancias de fabricación, el peso del aislador, y las
propiedades del acero y caucho utilizados para la fabricación y acabado de los
aisladores. Dichos planos serán revisados y aprobados antes de iniciar la fabricación
por el profesional responsable del diseño del sistema de aislamiento.
6. ASEGURAMIENTO DE LA CALIDAD.
6.2. El fabricante deberá permitir el acceso del cliente y/o sus representantes a
cualquier fase del proceso de fabricación de los aisladores sísmicos.

6.3. El fabricante deberá cubrir el costo de los ensayos descritos en estas
especificaciones para los aisladores prototipo y de obra, los costos de cualquier otro
tipo de ensayo solicitado por el cliente, deberán ser cubiertos por el solicitante.
6.4. Los fabricantes de Aisladores sísmicos que no han podido completar la entrega
de un contrato en cualquier proyecto en los últimos cinco (5) años, no serán
aprobados para suministrar aisladores en este proyecto.
1.1. Los componentes de los aisladores sísmicos deberán tener las siguientes
características:
1.1.1. Aceros.
• Láminas interiores: ASTM A1011, Gr. 36.
• Placas de acero exteriores: ASTM 572 Gr. 50 o ASTM A36.
• Acero manguitos e insertos a hormigón: ASTM A36
• Pernos: ASTM A325 o ASTM 490
1.1.3. Plomo. La pureza del plomo utilizado en los aisladores debe ser
determinada por medio de análisis químicos. El ensayo, efectuado en
conformidad con ASTM B29 y ASTM E37, debe demostrar que la pureza del
plomo es superior al 99.9%. El fabricante del aislador deberá proveer
certificación de la pureza del plomo.
1. GARANTÍA DE FABRICACIÓN
1.1. El fabricante de los aisladores deberá garantizar los aisladores, ante cualquier
defecto de fabricación, por un periodo no menor a 15 años luego de la instalación
de los aisladores de obra.
2. TOLERANCIAS DE FABRICACIÓN
2.1. Capas de caucho. Las capas de caucho deben ser de espesor uniforme,
conforme a las tolerancias establecidas en ASTM D4014.
2.2. Las tolerancias en las dimensiones de los aisladores serán las siguientes:

• Diámetro del aislador: ± 4 mm
• Altura total del aislador: ± 6.35 mm
• Paralelismo de las superficies: ≤1/200
3. ENSAYOS DE CAUCHO
Deberá ensayarse al menos una probeta de cada compuesto de caucho a ser utilizado en el
proceso de fabricación de los aisladores sísmicos. No se requerirá efectuar estos ensayos, de
manera específica para este proyecto, si se ensaya en laboratorio la totalidad de los
aisladores sísmicos de obra y si el fabricante ha ensayado cauchos de características
similares. En cualquier caso, se deberá enviar al Solicitante los siguientes reportes o
certificados de ensayo:
3.3. Dureza. La dureza debe ser determinada de acuerdo con ASTM D2240.
4.1.3. Se acepta para los aisladores de obra y aisladores prototipos que los

ensayos y sus resultados se efectúen de dos en dos si el equipamiento del
laboratorio permite dichas condiciones.

Todos los datos de los ensayos de los cauchos utilizados y de todos los
aisladores descritos en estas especificaciones deben ser documentados en un
reporte titulado “Reporte Final de Ensayos del Sistema de Aislamiento Sísmico”.
El reporte deberá ser enviado al cliente luego de concluidos los ensayos de los
aisladores sísmicos de obra.
5. REDISEÑO Y REENSAYO
El fabricante de los aisladores estará obligado a proveer aisladores sísmicos que satisfagan
los requisitos de estas especificaciones. Si los resultados de los ensayos de los aisladores de
prototipo o de obra no se ajustan a las especificaciones del proyecto, el fabricante deberá
rediseñar y reensayar los aisladores a su propio costo hasta que se satisfagan los requisitos
de estas especificaciones.
6.1. Los aisladores sísmicos deberán ser identificados usando caracteres, ubicados
en las caras verticales de los aisladores.
6.2. Aisladores sísmicos de obra. Cada aislador de obra que haya pasado
satisfactoriamente los ensayos de control de calidad deberá ser identificado de la
siguiente manera:
7.2. Los aisladores de obra deben ser transportados a obra utilizando un embalaje de

protección adecuado.
7.3. Los aisladores sísmicos deberán ser almacenados en obra en un lugar protegido
de polvo, escombros o de eventual daño físico.
7.4. La manipulación de los aisladores deberá prevenir cualquier tipo de daño físico.
7.7. Antes de dar inicio a un trabajo de soldadura cerca o en contacto con los
aisladores deberá ser consultado al proveedor y al especialista de diseño del sistema
de aislamiento, además deberá ser validado por los mismos.
Se sugiere evaluar la capacidad y calidad del fabricante de los aisladores bajo el siguiente cuadro:
Factor de seguridad para la estabilidad del aislador sísmico para cargas estáticas: 3.0.
Factor de seguridad para la rotura del caucho para la deformación sísmica total máxima
del aislador mayor o igual a 1.0.
Se debe demostrar mediante cálculo que cada uno de los aisladores debe ser capaz de
deformarse lateralmente un desplazamiento igual al desplazamiento total máximo,
soportando las cargas verticales máximas.

Earthquake Protection Systems (“EPS”) warrants the Friction Pendulum bearings (“Bearings”) against
defects in materials and workmanship under the normal use and service for which they were designed
for the full period of 120 months from the date of shipment to Buyer. This warranty is limited to
correcting defects in materials and workmanship, which materially affect the Bearing’s ability to
perform its intended function in accordance with the Bearing Specifications provided herein. For any
Bearing determined to be outside the warranted performance, EPS shall, at its sole expense and option,
either recondition or replace the Bearing or components to be within the Bearing Property
Specifications for new bearings.
For any bearing warranty work, Owner or Buyer shall be responsible for Bearing removal,
reinstallation, and freight to and from EPS’s facility, including all associated costs of these items. For
any Bearing found to be within the warranted performance, Owner or Buyer shall be responsible for all
related costs incurred by EPS including testing, inspection, freight, handling, repair, and reconditioning.
This warranty does not cover cosmetic defects or changes, paint chipping or peeling, damage caused by
installation or construction, fire or accidental damage, abuse, neglect, overloads, or failure of
Contractor, Buyer or Owner to install and maintain Bearings according to EPS recommended
procedures. Any obligation under this warranty terminates if the Bearings are modified or directly
exposed to fire. In such instances, Owner may reactivate the warranty by hiring EPS to inspect all
Bearings and for Owner to pay EPS to recondition or replace any Bearing that is deemed required. In
no case shall the warranty period be extended beyond the period listed above, whether or not a Bearing
is replaced or reconditioned by EPS.

Bearing Manufacture and Testing: All EPS bearings are designed, manufactured and tested in accordance with
ISO 9001:2008 “Design and Manufacture of Seismic Isolation Bearings”, as audited by the ISO 9001 Registrar. The
ISO 9001 specifications and the EPS bearing drawings, specifications, and testing as specified in the EPS reports and
Commercial Offer, are the only specifications and requirements that apply to the EPS bearing engineering,
manufacture, and testing. Quality Control Test Reports are provided, signed and stamped by an EPS professional
engineer, accepting professional responsibility that the as manufactured bearings have the materials, manufacturing,
capacities and properties as specified by EPS. When prototype testing services are provided, EPS provides a
Prototype Testing Report signed and stamped by an EPS professional engineer, accepting professional responsibility
that the prototype and all production bearings have the materials, manufacturing, capacities and properties as specified
by EPS. Prototype bearings are the property of EPS. Buyer is encouraged to observe bearing testing as an
opportunity to learn about the EPS seismic engineering and bearing systems. However, Buyer must not interfere with
standard EPS operating procedures. Buyer’s inspection authority is limited to citing specific non-conformance with
the specifications in the Offer.
Professional Responsibilities: When engaged as the seismic isolation engineer, EPS designs and specifies the
isolation system to limit seismic damage to a specified percentage of the facility replacement cost. The Seismic
Isolation Engineering Report submitted by EPS is signed and stamped by an EPS professional engineer. This report
specifies the isolation system capacities and properties, and the corresponding structure and architectural design and
construction requirements, as required to achieve the specified reliability of limiting damage to the specified level.
EPS then manufactures and tests the bearings to demonstrate that the bearings have the properties and capacities as
required to achieve the specified seismic performance. The project engineering and architectural consultants,
construction contractor, and facility owner, are jointly responsible to design and construct the facility structure,
architectural, and mechanical components consistent with the requirements specified in the Seismic Isolation
Engineering Report. When engaged to manufacture bearings for an isolation system designed by others, EPS
provides a Bearing Engineering Report signed and stamped by an EPS professional engineer, taking professional
responsibility that the bearings have the capacities and properties as specified in the EPS report. For isolation systems
designed by others, the Buyer, owner, and their consultants are collectively responsible for the seismic performance
of the facility. EPS is then specifically excluded from responsibility or liability for the seismic performance of the
facility except for damage directly and primarily caused by failure of the bearings to have the capacities and properties
as specified in the signed and stamped EPS project reports.
Bearing Installation, and Facility Design and Construction: The Buyer and owner, and their consultants, are
responsible for the facility design and construction to conform with requirements specified in the EPS reports,
including verifying that bearing load and displacement demands do not exceed the capacities specified by EPS. The
Buyer and owner, and their consultants, are responsible to provide adequate bearing connection details, and structure
strengths, as required to accommodate all structure, environmental, and seismic loadings and displacements; and for
the proper installation and use of the bearings in accordance with EPS installation and maintenance recommendations.
The Buyer and owner, and their consultants, are responsible for compliance with all code and applicable government
requirements pertaining to the use of the bearings or services provided by EPS. The Buyer and owner, and their
consultants, are responsible to implement all non-structural components and details as appropriate to satisfy the
seismic resiliency performance specified in the EPS reports. The Total Price includes standard technical support as
normally provided by EPS engineers working at the EPS facility. The bearing assemblies include temporary shipping
plates attached to the bearing. Shipping plates must be removed after the structure is complete. Except as specifically
itemized, the Offer does not include the design or supply of any structure connection hardware or bolts, plates above
or below the bearings, shim plates, sole plates, or grout.
EPS Proprietary Bearing Systems: EPS is engaged in the development, design, manufacture, and testing of Friction
Pendulum Bearings, which are proprietary, trademarked, and patented products of EPS. The isolation system
design, bearing details, drawings, specifications, and related information as provided by EPS to the Buyer, Owner,
and Owner’s consultants are “EPS Proprietary Information” and shall be used only for the application named herein,
and with the restriction that the manufacture of the bearings is to be done exclusively by EPS. The EPS Proprietary
Information shall remain the property of EPS, with limited rights as granted to Buyer, Owner, and Owner’s

consultants as specified in the Commercial Offer. Buyer, Owner, and Owner’s consultants shall exercise due care to
safeguard all EPS Proprietary Information from unauthorized access.
General Terms and Conditions: Standard business practice according to the Uniform Commercial Code, UCC
NCCUSL, shall apply for all matters not specified herein. If Buyer’s written acceptance of this offer, without
modification, is not received by EPS within 14 days of first transmission to Buyer, EPS reserves the right to modify
the price, schedule and terms, or withdraw the offer. The ready-to-ship dates are based on the scope, terms and
conditions as specified in the offer and will be extended for any changes requested by Buyer, or actions by Buyer that
delay EPS. For any changes in the scope or requirements, EPS will evaluate the impact on cost and ready-to-ship
schedule and advise the Buyer prior to proceeding with the changes. Changes to the scope of work or requirements,
and non-customary support services, and support that requires EPS to work away from the EPS facility, will be paid
for as additional services according to the EPS Standard Charges. Payments are due as work is completed and
invoiced whether or not bearings are needed for construction. The ready-to-ship dates will be extended one day for
each day a payment to EPS is late. If a payment is more than 7 days late, the Buyer shall pay late payment charges
at the rate of one percent (1%) per month of the outstanding balance, for each month or fraction thereof for which the
payment is late. Bearings will be ready to ship within 14 days after receipt of payment due upon submission of the
QC test results. Bearings will not be released for shipment until all applicable payments have been received by EPS.
When EPS is engaged to provide third party shipping or delivery services, EPS will not be held not responsible for
any delay in shipping transit time, or its impact on construction. If the purchase is canceled by Buyer for reasons not
directly and primarily caused by EPS’s failure to perform, Buyer shall pay EPS the percentage of the Total Bearing
Price equal to the percentage of the component manufacture that was completed at the time of cancellation.
Charges for late performance by EPS are not applicable unless the average ready-to-ship date is more than 2 weeks
late, and EPS failure to perform was the sole contributor to the construction delay. Late performance charges claimed
against EPS shall not exceed 2% of the Total Price for each week the average ready-to-ship date is late, up to a
maximum of 20% of the Total Price. Late charges will not be claimed against EPS due to delays caused by natural
disasters, fires, strikes, or government actions that delay EPS’s work. If a payment to EPS is more than 6 months
overdue, all work in progress shall be considered abandoned and the title and ownership shall transfer to EPS, and
EPS shall have no further obligations to deliver any products or services.
This Offer may be accepted by signing the Buyer’s Acceptance, or making the payements specified herein, which
thereby constitutes a binding agreement for the subject matter contained in it and supersedes any and all prior oral or
written offers, discussions, negotiations, representations, understandings or agreements among the parties. No other
terms or conditions shall apply without written signed acceptance by EPS and Buyer. Should the EPS products or
services provided be named in any purchase order issued by the Buyer, the terms and conditions herein shall be the
sole provisions applicable to EPS’s products or services sold. Should the EPS products or services provided be sold
or assigned by the Buyer to a third party, the Buyer assumes sole responsibility to transfer all contract terms and
conditions herein to said third party, including liability and warranty limitations, and Buyer agrees to indemnify,
defend and hold EPS harmless from any claims by said third party which extend beyond the responsibilities and
liabilities of EPS as specified herein. The laws of the State of California will govern any disputes regarding this
agreement and the products and services provided. The applicable courts located in the City of Vallejo or the County
of Solano shall have exclusive jurisdiction over any dispute concerning this agreement or the EPS products or services
provided. In the event that any legal action arises out of this agreement or the products or services provided by EPS,
the prevailing party shall be entitled to recover from the other its reasonable attorney's fees and costs of suit.
LIMITATION OF LIABILITY: FOR ANY AND ALL DAMAGES CLAIMED AGAINST EPS FOR
NEGLIGENCE, DEFECTIVE PRODUCTS, PROFESSIONAL LIABILITY, FAILURE TO PERFORM, OR
ANY OTHER REASON WHATSOEVER, THE TOTAL CUMULATIVE CLAIMS SHALL BE LIMITED
TO A MAXIMUM EQUAL TO THE TOTAL PRICE AS SPECIFIED HEREIN. UNDER NO
CIRCUMSTANCES SHALL EPS BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL
DAMAGES OF ANY NATURE WHATSOEVER INCLUDING WITHOUT LIMITATION, LOST PROFIT
OR REVENUE. UNDER NO CIRCUMSTANCES SHALL ANY OFFICER, ENGINEER, OR EMPLOYEE
OF EPS BE HELD PERSONALLY LIABLE FOR ANY WORK PERFORMED IN RELATION TO THIS
AGREEMENT, WHETHER OR NOT SUCH CLAIMS ARE BASED IN CONTRACT OR TORT OR UPON
ANY OTHER LEGAL THEORY.
