Nueva York clasifica los Delitos Mayores en seis clases diferentes que van

desde los de Clase E, los de menor gravedad, a la Case A, los ms graves.

Los Delitos Mayores de Clase A se dividen en dos subcategoras: Clase A I y
Clase A II.
Rango de condenas por cada nivel
Las sentencias para los delitos mayores en Nueva York son un tanto
complicadas, imponiendo condenas en base a varios factores. Hay dos tipos
bsicos de condenas por delitos graves en Nueva York: indeterminado y
determinado.
Sentencias indeterminadas (Indeterminate sentences)
Cuando el tribunal condena a una sentencia indeterminada a alguien,
establece un rango de sentencia de un perodo de encarcelamiento mnimo
y mximo. Los tribunales suelen imponer sentencias indeterminadas por
delitos no violentos. Una vez que el condenado cumple el tiempo mnimo a
que le sentenci el tribunal, se convierte en elegible para obtener la libertad
condicional (parole). Si al condenado (convicted person) se le deniega la
libertad condicional, tendr que cumplir la pena mxima impuesta por el
tribunal. Hay diferentes sentencias indeterminadas para cada clase de delito
grave (felony offense).
Class A-I Felony: hasta cadena perpetua con un mnimo de entre 15 y 40
aos.
Class A-II Felony: hasta cadena perpetua con un mnimo de entre 3 y 8 aos.
Class B Felony: hasta 25 aos de prisin con un mnimo de entre un ao y
un tercio de la pena mxima dada.
Class C Felony: hasta 15 aos de prisin con un mnimo de un ao.
Class D Felony: hasta 7 aos de prisin con un mnimo de un ao.
Class E Felony: hasta 4 aos de prisin con un mnimo de un ao.
Sentencias Determinas (Determinate sentence)
Una sentencia determinada es un perodo determinado de aos, y no
implica un rango de tiempo. Por delitos graves con violencia
(violentfelonies), delitos graves relacionados con delitos de drogas (drug
offenses) y delitos graves en que el acusado haya sido condenado por un
delito grave con violencia con anterioridad, los tribunales de Nueva York
generalmente imponen una pena determinada. Una vez que el tribunal
impone una pena determinada, el condenado ha de cumplir un nmero
determinado de aos en prisin.
El rango de la posible sentencia determinada, depende de manera
significativa de la conducta anterior del acusado, de si el delito se clasifica
como un delito violento (violent offense), y en qu clase de delito grave est
involucrado. Adems, la persona condenada posteriormente con un segundo
delito grave sin drogas o sin violencia (non-drug or non-violent felony)
tendr que enfrentarse a una sentencia indeterminada en lugar de a una
determinada.

 Estos son algunos ejemplos de posibles penas determinadas para casos

de delitos graves.
Delito grave con violencia o drogas (Violent or drug felony), sin delitos
anteriores:
Class B Felony: de cinco a 25 aos.
Class C Felony: de tres aos y medio a 15.
Class D Felony: de dos a 7 aos.
Class E Felony: de ao y medio a 4 aos.
Delito grave con violencia o drogas, con delitos anteriores:
Class B Felony: de 10 a 25 aos.
Class C Felony: de siete a 15 aos.
Class D Felony: de cinco a 7 aos.
Class E Felony: al menos cuatro aos.
Prisin de por vida sin libertad condicional
La ley de Nueva York tambin permite la sentencia a cadena perpetua sin
posibilidad de libertad condicional (life imprisionment without the possibility
of parole). Por ejemplo, toda persona declarada culpable de terrorismo debe
cumplir una condena de cadena perpetua sin libertad condicional, mientras
que los condenados por asesinato en primer grado (first-degree murder)
podran cumplir una condena y si cumple ciertos requisitos, terminar
saliendo con la libertad condicional.
Multas (Fines)
Un tribunal puede ordenar a un condenado por un delito grave a pagar
una multa. El importe de la multa puede ser superior a $5.000 o el doble de
la cantidad que el acusado haya adquirido como causa de su delito. Por
ejemplo, si un condenada por un delito grave de robo (felony theft offense)
por valor de $10.000, el tribunal puede imponerle una multa mxima de
$20.000.
Adems, los condenados por un delito grave de drogas se pueden
enfrentar a sanciones mucho ms altas en Nueva York. La multa mxima por
estos delitos depende de la clase de delito grave en cuestin.

Class A-II Felony: hasta $50.000.
Class B Felony: hasta $30.000.

Estatuto de Limitaciones
Si los fiscales que trabajan para el estado de Nueva York quieren acusar a
alguien de un delito, deben hacerlo dentro de un perodo de tiempo
limitado. El plazo de prescripcin es una ley que limita el tiempo que tienen
los fiscales para presentar cargos penales y, una vez que el plazo ha
expirado, los fiscales ya no pueden acusar a alguien por ese delito.
Algunos crmenes en Nueva York, como el Asesinato en Primer Grado y el
Abuso Sexual con Agravante, no tienen lmite de tiempo. Otros delitos
graves se limitan a cinco aos, aunque hay excepciones.
