Publicadas las Normas para Regular los Mecanismos Alternativos de Solucin de Conflictos en la Actividad Aseguradora

En la Gaceta Oficial N 39.826 de fecha 22 de diciembre de 2011, fue publicada la Providencia N FSAA-9-3683 de fecha 05 de diciembre de 2011, por medio de la cual, se dictan las Normas para Regular los Mecanismos Alternativos de Solucin de Conflictos en la Actividad Aseguradora, emanada de la Superintendencia de la Actividad Aseguradora. Las normas contenidas en la Providencia antes identificada, tienen por objeto regular la conciliacin y el arbitraje como mecanismos alternativos de solucin de conflictos aplicados por la Superintendencia de la Actividad Aseguradora. Cabe destacar que la Providencia tambin establece que los conciliadores(as), el rbitro Arbitrador y los instructores en el procedimiento de arbitraje, debern guardar la confidencialidad sobre lo asuntos sometidos a su conocimiento. La confidencialidad a la que ac se refiere no ser atendida cuando se trate de situaciones que transgredan el orden pblico. La Providencia comentada entrar en vigencia a partir de los 30 das hbiles siguientes a su publicacin en Gaceta Oficial de la Repblica de Venezuela.

Publication of the Rules to Regulate the Alternate Mechanisms for Solving Conflicts in Insurance Activities
Order NFSAA-9-3683 of December 5, 2011 was published in Official Gazette N39,826 of December 22, 2011, establishing the Rules to Regulate the Alternate Mechanisms for Solving Conflicts in Insurance Activities, issued by the Office of the Insurance Activity Superintendent. The purpose of the rules contained in the aforementioned Order is to regulate conciliation and arbitration as alternate mechanisms to solve conflicts, to be applied by the Office of the Insurance Activity Superintendent. It should be noted that the Order also establishes that the conciliators, the Arbitrator, and the instructors in the arbitration proceeding shall keep the matters subjected to their attention as confidential. Such confidentiality shall not be extended in cases of situations violating public order. The Order shall become effective 30 business days after publication in Official Gazette of the Republic of Venezuela.
