UNO. Mandato judicial. Por el presente acto, el
señor _________ confiere mandato judicial, tan
amplio y suficiente como sea necesario conforme a
derecho, a _____________, chileno, ________,
abogado, cédula nacional de identidad Nº
________________ emitida por el Servicio de Re-
gistro Civil e Identificación de la República de Chile,
y a _______________, chileno, ______, abogado,
cédula de identidad Nº ___________ emitida por el
Servicio de Registro Civil e Identificación de la
República de Chile, ambos en adelante referidos
como “los Mandatarios”, domiciliados en

_______, República de Chile, para que cada uno o
cualquiera de ellos pueda actuar a nombre y repres-
entación del mandante, interponiendo una demanda
de divorcio ante los Juzgados de Familia que tengan
competencia territorial en Chile, en contra de su
mujer, ___________, chilena, casada, __________,
cédula nacional de identidad Nº ______________
emitida por el Servicio de Registro Civil e Identifica-
ción de la República de Chile; como también para
actuar en su representación como demandado, en
caso que el mandante haya sido demandado por su
mujer.
En el ejercicio de este mandato, los mandatarios
podrán representar judicialmente al mandante re-
specto de las siguientes materias relativas al procedi-
miento de divorcio de acuerdo al derecho chileno de
familia: a) Regulación completa y suficiente de rela-
ciones mutuas entre los cónyuges y respecto de sus
hijos; b) Compensación económica; c) Régimen
matrimonial; y d) Cualquier otro aspecto que fuese
objeto de acuerdo, según la legislación chilena, para
obtener una sentencia de divorcio. Los mandatarios
podrán también actuar en representación del mand-
ante en cualquier mediación familiar ordenada por el
tribunal.
Los mandatarios no estarán facultados para ser em-
plazados ni para recibir notificaciones o comunica-
ciones de cualquier tipo en representación del mand-
ante en ninguna acción, juicio o procedimiento;
como tampoco podrán hacer libre uso de los bienes
raíces ni de grupo de propiedades y obligaciones
(universalidades) del patrimonio del mandante.
Este mandato les permitirá a ambos abogados actuar
en representación del mandante hasta la completa
ejecución de la sentencia y otras resoluciones, en-

or “the principal”, of full age, who states:
ONE. Judicial power of attorney. Mr. ________
hereby grants judicial power of attorney (“P.O.A.”),
as ample as necessary in accordance to the law, to
__________________, chilean, _______, lawyer,
national identity card No. ___________ issued by
the Civil Registration and Identification Service of
the Republic of Chile, and ________________,
chilean, _______, lawyer, national identity card No.
____________ issued by the Civil Registration and
Identification Service of the Republic of Chile, both
hereafter referred to as “the Attorneys”, domiciled in
______________, commune of ________,
__________ Region, Republic of Chile, so that each
and any of them may act on behalf of the mandator
filing a divorce lawsuit before the Family Courts that
have territorial jurisdiction in Chile, against his
wife,. ________________, chilean, married, archi-
tect, national identity card No. _____________ is-
sued by the Civil Registration and Identification
Service of the Republic of Chile; as well as to act in
his behalf as a defendant, in case the mandator had
been sued by his wife.
In the exercise of this P.O.A., the attorneys may
legally represent the mandator regarding the follow-
ing matters related to divorce proceedings according
to Chilean family law: a) Complete and sufficient
regulation of mutual relations between spouses and
regarding their children; b) Alimony; c) Marital
property system; and d) Any other aspect that could
be subject to an agreement, according to Chilean
legislation, in order to obtain a divorce decree. The
attorneys may also act on behalf the mandator in any
family counseling ordered by the Court.
The attorneys shall not have the authority to be
summoned or subpoenad, nor to receive notices or
communications of any kind on behalf of his man-
dator in any actions, claims or proceedings, without
prior notice to the mandator; nor can they make free
use of real estate or any group of properties and
obligations of the estate of the mandator.
This P.O.A. allow both Attorneys to act in behalf of
the mandator until the complete execution of the
sentence and other decisions, being expressly em-
powered to appoint representing attorneys and prox-
contrándose expresamente facultados para designar
abogados patrocinantes y apoderados con todas las
facultades que por este instrumento se le confieren, y
pudiendo delegar este poder y reasumirlo cuantas
veces lo estimen conveniente. Además, ambos man-
datarios se encuentran facultados para actuar en
forma conjunta, separada e indistintamente uno del
otro.-
DOS. Facultades especiales para audiencia de con-
ciliación. Respecto de la audiencia especial de con-
ciliación que se exige en los juicios de divorcio, de
acuerdo a los artículos 67 a 70 de la Ley No. 19.947
de la República de Chile, en el presente acto, el
mandante manifiesta su voluntad de no perseverar en
el vínculo matrimonial que tiene con __________,
en virtud del matrimonio celebrado el
______________, el cual se encuentra inscrito bajo
el Nº ______ del mismo año en la circunscripción de
___________ del Servicio de Registro Civil e Iden-
tificación de la República de Chile; facultando espe-
cialmente a ambos mandatarios, designados en la
cláusula anterior, para que concurran, conjunta o
separadamente, a dicha audiencia y manifiesten su
voluntad de no persistir en el vínculo matrimonial
descrito.-
TRES. Facultades judiciales. Por este mandato, se
otorga a los mandatarios todas y cada una de las
facultades establecidas en ambos incisos del artículo
7 del Código de Procedimiento Civil chileno, las
cuales se dan por expresamente reproducidas, en
especifico, las de demandar, iniciar cualquier otra
especie de gestiones judiciales, reconvenir, contestar
reconvenciones, desistirse en primera instancia de la
acción deducida, aceptar la demanda contraria, ab-
solver posiciones, renunciar a los recursos o térmi-
nos legales, transigir, avenir, conciliar, comprometer,
designar árbitros y otorgarles facultades de arbit-
radores o mixtos, aprobar convenios y percibir.
Asimismo, quedan facultados los mandatarios para
comparecer en representación del Mandante, en la
audiencia preparatoria y de juicio del procedimiento
chileno de familia; realizar las alegaciones pertin-
entes; suscribir un acuerdo completo y suficiente de
relaciones mutuas entre los cónyuges y respecto de
sus hijos ante el Ministro de Fe correspondiente;
comparecer en la audiencia de conciliación y renun-
ciar a ella; renunciar a la mediación familiar; notifi-
carse personalmente de todas las resoluciones cuya
naturaleza lo exija, como la resolución que cita a la
audiencia de conciliación y preparatoria y la senten-
cia definitiva; y realizar cualquier trámite en que se
requiera la comparecencia personal del suscrito en
los respectivos juicios.
CUATRO. Duración y extensión del mandato. El
presente poder tendrá una duración indefinida y se
extiende a todo lo que pueda hacer personalmente el
mandante en un juicio de divorcio.-
CINCO. Mandato para corregir escritura. El mand-

TWO. Special powers for conciliation hearing.
Regarding the special conciliation hearing that is
required in divorce proceedings, according to articles
67 to 70 of the Law No. 19,947 of the Republic of
Chile, the mandator hereby expresses his will to not
persevere in the matrimonial relationship he has with
____________, by virtue of the marriage held on
______________, which is registered under No.
_______ of the same year in the constituency of
___________ of the Civil Registration and Identific-
ation Service of the Republic of Chile; especially
empowering both attorneys, designated in the previ-
ous clause, to attend, jointly or separately, at the
hearing and to express his willingness to not to per-
severe in the described matrimonial relationship.-
THREE. Judicial powers. By this P.O.A., the attor-
neys are granted each and every one of the powers
established in both sections of the article 7 of the
Chilean Code of Civil Procedure (“Código de Pro-
cedimiento Civil”), which are expressly reproduced,
specifically, to sue, to initiate any other kind of judi-
cial proceedings, to file a counterclaim, to answer a
counterclaim, to abandon an action during the first
instance, to accept the opposing claim, to reply to
interrogatories, to renounce to judicial remedies or
terms, to reach a settlement whether it be judicial or
extrajudicial, to attend a conciliation hearing and
reach a settlement in it, to designate arbitrators and
grant them powers of an arbitrator ex aequo et bono,
or those of a mixed arbitrator, to approve agreements
in a bankruptcy procedure and to collect.
Likewise, the attorneys are authorized to appear on
court on behalf of the mandator at the preliminary
and trial hearings of the Chilean family procedure;
make the relevant claims; to sign a complete and
sufficient agreement of mutual relations between
spouses and regarding their children before the cor-
responding Certifying Officer; to appear at the con-
ciliation hearing and waive it; to waive family coun-
seling; to notify themselves personally of all de-
cisions whose nature requires it, like the resolution
citing the conciliation hearing, the preliminary hear-
ing and the sentence; and to carry out any procedure
that requires the personal appearance of the under-
signed in the respective trials.
FOUR. Duration and extension of the Power of
Attorney. The present P.O.A. will have an indefinite
duration and extends to everything that the mandator
could personally do in divorce proceedings.-
FIVE. Power to correct deed. The mandator grants
tioned, to clarify, rectify, amend or complement this
deed. This power is as broad as necessary so that the

SEIS. Idioma del mandato. El presente mandato
judicial, para efectos de ser otorgado ante una Not-

en español e inglés. En caso de conflicto de traduc-
ción o interpretación, el contenido en español preval-
ecerá para todos los efectos legales, particularmente
en la jurisdicción chilena.
SIETE. Derecho aplicable. Para todos los efectos
legales, el presente mandato judicial se encuentra
regido por la ley chilena, sin perjuicio que cumplirá
todos los requisitos de una escritura publica de
acuerdo a la legislación de _____________.
OCHO. Facultad al portador. El mandante faculta
al portador de copia autorizada de este mandato
judicial para requerir y firmar las inscripciones,
subinscripciones y demás que procedan de acuerdo a
la ley. El portador también se encuentra autorizado
para realizar todos los actos que se requieran para
que el presente poder tenga plena validez y eficacia
en la República de Chile.-

SIX. Language of the Power of Attorney. The
present P.O.A., for the purpose of being granted
before a Notary Public in ___________, is written in
Spanish and English. In case of translation or inter-
pretation conflict, the Spanish text will prevail for all
legal purposes, particularly in the Chilean jurisdic-
tion.
SEVEN. Applicable law. For all legal purposes, this
P.O.A. is governed by Chilean law, notwithstanding
that it will meet all the requirements of a public deed
in accordance with _____________ law.
EIGHT. Bearer power. The mandator authorizes the
bearer of an authorized copy of this P.O.A. to re-
quest and sign the inscriptions, sub-registrations and
others that proceed according to the law. Also, the
bearer is authorized to carry out all the necessary
acts that may be required in order for this P.O.A. to
be valid and effective in the Republic of Chile.-
