331 mediante el cual se dicta del Decreto con Rango, Valor y Fuerza de Ley de Costos y Precios Justos

Publication of Decree No.8,331 providing for the Decree with Rank, Value and Force of Law of Fair Costs and Prices

En la Gaceta Oficial N 39.715 de fecha 18 de julio de 2011, fue publicado el Decreto con Rango, Valor y Fuerza de Ley N8.331, emanado de la Presidencia de la Repblica, mediante el cual se dicta la Ley de Costos y Precios Justos. Dicho Decreto tiene por objeto establecer las regulaciones, as como los mecanismos de administracin y control necesarios para mantener la estabilidad de precios y propiciar el acceso a los bienes y servicios a toda la poblacin en igualdad condiciones. Las disposiciones del mencionado Decreto son aplicables en todo el territorio nacional, a las relaciones establecidas entre sujetos de derecho pblico o privado que, con ocasin de su giro comercial, productivo o de prestacin de servicios, determinen los precios que correspondan a la venta de bienes o la prestacin de servicios, as como los costos inherentes a tales operaciones. Ahora bien, se exceptan de la aplicacin de este Decreto los bancos y las instituciones financieras sometidas a la vigilancia de la Superintendencia de las Instituciones del Sector Bancario. Mediante el referido Decreto: Se crea la Superintendencia Nacional de Costos y Precios, la cual formar parte de la estructura del la Vicepresidencia de la Repblica, as como el Sistema Nacional Integrado de Costos y Precios. Se establece para todos los sujetos obligados el deber de inscribirse y de mantener los datos actualizados en el Registro Nacional de Precios de Bienes y Servicios. Se establece tambin para todos los sujetos obligados el deber de informar, a travs de los modelos o formularios que cree la Superintendencia Nacional de Costos y Precios, los costos y gastos al Sistema Automatizado de Administracin de Precios, los cuales no podrn exceder a los registrados contablemente.

Decree with Rank, Value and Force of Law No. 8,331 was published in Official Gazette No.39,715 of July 18, 2011. Such Decree was issued by the President of the Republic and provides for the Law of Fair Cost and Prices. This Decree shall establish the regulations , administration and control mechanisms necessary to maintain price stability and promote access to goods and services to the people on equal terms. The provisions of this Decree are applicable throughout the national territory and to the relations between subjects of public or private law, which during the course of their operation, production or service delivery, determine prices corresponding to the sale of goods or the provision of services , as well as the costs inherent to such activities. Banks and financial institutions ruled by the Office of the Superintendent of Banking Institutions, are exempted from application of this Decree. The Decree provides for the following: The National Office of the Superintendent of Costs and Prices is created, which is attached to the Vice President of the Republic and to the National Integrated System of Cost and Prices. Individuals and entities ruled thereunder shall be obliged to register and keep their information up-to-date with the National Register of Good and Service Prices. Individuals and entities ruled thereunder shall also be obliged to inform, through the models or forms created by the National Office of the Superintendent of Costs and Prices , on all their costs and expenses to the Automated System for Price Administration, and these shall not exceed those recorded in books.

Cuando alguno de los sujetos regulados deba incorporar nuevos bienes o servicios , en adicin a aquellos que hubiere informado previamente a la Superintendencia, deber seguir el procedimiento establecido en el Decreto para la determinacin del precio justo del bien o servicio, previo a su oferta. Entre los rganos auxiliares del Sistema Nacional Integrado de Costos y Precios, se encontrarn la Fuerza Armada Nacional Bolivariana y la Polica Nacional Bolivariana. Asimismo, el INDEPABIS, CADIVI, SENIAT, BCV y el Ministerio Pblico prestarn cooperacin interinstitucional. Se prev entre otras, las siguientes medidas preventivas:

Should any individual or entity ruled thereunder incorporate new goods or services, in addition to those previously reported to the Office of the Superintendent of Costs and Prices, the procedure established in the Decree to determining the fair price of the good or service, before their offering, shall be applied. Ancillary bodies to the National Integrated System of Cost and Prices include the Bolivarian National Armed Forces and the Bolivarian National Police, as well as INDEPABIS, CADIVI, SENIAT, BCV and the Attorney General, which shall provide interinstitutional cooperation. Preventive measures considered include:

Suspensin del intercambio, distribucin o venta de los productos, o de la prestacin de servicios. Comiso.

Suspension of the exchange, distribution or sale of products or provision of services. Seizure.

Requisicin u ocupacin temporal de los establecimientos o bienes indispensables para el desarrollo de la actividad, o para el transporte o almacenamiento de los bienes comisados. Cierre temporal preventivo del establecimiento.

Requisition or temporary use of commodities and premises required for developing a determinate activity or for the transportation and storage of seized goods.. Temporary preventive closure of the premises.

Suspensin temporal de licencias, permisos o autorizaciones. Temporary suspension of licenses, permits or authorizations. En materia de determinacin y control de precios, las sanciones a las infracciones previstas en el mencionado Decreto, se aplicarn con preferencia a las contenidas en otras leyes. Entre las sanciones previstas en dicho Decreto resaltan: Multa, la cual ser calculada sobre la base de determinado nmero de salarios mnimos urbanos vigentes para el momento de la comisin de la infraccin. Inhabilitacin temporal del ejercicio del comercio, la actividad o profesin. Dicha inhabilitacin ser impuesta por los tribunales con competencia en materia penal. Cierre temporal de almacenes , depsitos o establecimientos. El infractor deber seguir pagando los salarios a los trabajadores y dems obligaciones laborales y seguridad social, durante el tiempo que se mantenga la medida. Regarding price determination and control, penalties in case of violations listed in the aforementioned Decree shall prevail over other penalties set forth in other laws. Penalties listed in such Decree include: Penalty calculated based on the specific number of minimum urban wages in effect at the date of the violation. Temporary barring from commercial or professional activities, imposed by the Courts with jurisdiction in criminal matters Temporary closure of stores, warehouses or premises. The offender shall continue paying wages, as well as any other labor and social security obligations, to its workers during the penalty term. Whoever increases the price of a good or service without prior authorization from the Office of the Superintendent shall be subject to a penalty of fifteen to thirty urban minimum wages, plus one hundred percent of the total amount of the products sold or services rendered.

Ser sancionado con multa de quince a treinta salarios mnimos urbanos, ms el cien por ciento del monto total de productos comercializados o servicios prestados, quien aumente el precio de un bien o servicio sin la previa autorizacin de la Superintendencia. La especulacin ser sancionada con ocupacin temporal del almacn, depsito o establecimiento ms multa de acuerdo a lo establecido en el Decreto. Las sanciones aumentarn progresivamente en los casos de reincidencia segn se establece en el mencionado Decreto. El Decreto con Rango Valor y Fuerza de Ley de Costos y Precios Justos entrar en vigencia vencido el plazo de noventa das hbiles contados a partir de su publicacin en Gaceta Oficial., salvo las normas contenidas en los artculos 23, 28, 29, 30, 31, 34, 35, 36 y 37, las cuales entrarn en vigencia con la publicacin del mencionado Decreto en Gaceta Oficial.

Speculation shall be punished with temporary occupation of the premises, warehouse or store, plus a penalty imposed in accordance with the provisions of the Decree. Penalties shall gradually increase upon recurrent violations, as set forth in the Decree. The Decree with Rank and Force of Law of Fair Costs and Prices shall enter into force upon expiration of the term of ninety calendar days from the date of its publication in the Official Gazette, except for the rules contained in Articles 23, 28, 29, 30, 31, 34, 35, 36, and 37, which shall become effective from the date of its publication in Official Gazette.
