En la Gaceta Oficial N 39.713 de fecha 14 de julio de 2011, fue publicado el Decreto N 8.

332 mediante el cual, se dicta la Reforma Parcial del Reglamento de la Ley de Alimentacin para los Trabajadores y las Trabajadoras, emanada de la Presidencia de la Repblica, en virtud de la cual se realizan modificaciones y ajustes en el beneficio de alimentacin de los trabajadores. La mencionada Reforma, si bien se mantiene la condicin de que el patrono slo se ver obligado a otorgar el beneficio de alimentacin a aquellos trabajadores que devenguen un salario mensual que no exceda de tres (03) salarios mnimos, sin embargo elimina el limite previsto en el Reglamento anterior, el cual, consista en que para poder otorgarle el beneficio mencionado a sus trabajadores deba tener bajo su cargo ms de 20 trabajadores, en concordancia con el Decreto con Rango, Valor y Fuerza de Ley de Reforma Parcial del Decreto con Rango, Valor y Fuerza de Ley de Alimentacin para los Trabajadores y las Trabajadoras, publicada en la Gaceta Oficial N 39.660 en fecha 26 de mayo de 2011. El otro punto importante de esta Reforma, es la inclusin del Capitulo III, en el Ttulo III, el cual es cnsono con el Decreto con Rango, Valor y Fuerza de Ley de Reforma Parcial del Decreto con Rango, Valor y Fuerza de Ley de Alimentacin para los Trabajadores y las Trabajadoras, antes identificado, que incluy la posibilidad de otorgar el beneficio de alimentacin por medio de dinero en efectivo. Dicho nuevo Captulo est conformado por 2 artculos que se refieren, (i) el primero, a la oportunidad para el pago del beneficio de alimentacin, el cual, debe hacerse dentro de los cinco (05) das siguientes al vencimiento del mes respectivo; y (ii) el segundo, a la entrega de recibo por parte del empleador al trabajador, por medio del cual se dejar constancia del cumplimiento del beneficio de alimentacin por parte del empleador, distinguindolo del pago que se realiza por concepto del salario. El presente Reglamento entrar en vigencia a partir de su publicacin en la Gaceta Oficial.

Decree No.8332 was published in Official Gazette No.39,713 of July 14, 2011. Such Decree provides for the Partial Reform of the Regulations to the Workers Food Law, enacted by the President of the Republic, which includes modifications and adjustments to the workers food benefit. Although this Reform retains the condition that employers shall solely be obliged to payment of the food benefit to workers with monthly minimum remunerations not exceeding three (03) minimum salaries, it eliminates the limit established in the previous Regulations instructing that all employers with over 20 workers were obliged to pay food benefits, in pursuance with the Decree with Rank, Value and Force of Law of Partial Reform to the Decree with Rank Value and Force of Workers Food Law, published in Official Gazette No.39,660 on May 26, 2011. Another significant aspect in this Reform is the incorporation the new Chapter III, Title III, which is in conformity with the Decree with Rank, Value and Force of Law of Partial Reform to the Decree with Rank Value and Force of Workers Food Law cited above included the possibility of granting the food benefit in cash. Such new Chapter include two Articles herein mentioned refer to (i) the first one, to the timeliness for payment of the food benefit, which shall be within the first five (5) days following month-end; and (ii) the second, to the delivery of a receipt voucher by the employer to the worker which shall leave evidence of compliance with the food benefit on the part of the employer, aside from any payments made corresponding the workers salaries. This Reform shall be effective from its publication in Official Gazette.
