voluntarias entre agentes económicos se basan en la maximización de la
riqueza. Este tipo de operaciones puede ser deseable desde el punto de vista
moral porque favorece el bienestar y la autonomía. Robin West niega la
verosimilitud de la tesis de Posner a partir del análisis de la obra de Kafka. Los
personajes kafkianos muestran que a menudo el consentimiento de las partes
depende muchas veces del deseo de sumisión a la autoridad, de manera que la
justificación moral de la maximización de la riqueza descansa en una

conocimientos sobre Derecho y literatura para comparar la maximización de la
riqueza posneriana con el monstruo de Shelley. Según Malloy, Posner ha
perdido el control sobre su criatura y ha fabricado un" verdadero Frankenstein
que tras adquirir vida propia amenaza con desarticular los valores básicos de
