PRESENTACIN
Ha transcurrido ms de un siglo desde que Chile invadi el Litoral boliviano y
provoc la guerra entre tres pueblos hermanos, confinando a Bolivia a un forzado
enclaustramiento geogrfico.
Desde entonces, varios Presidente s y Cancilleres de Chile comprendieron que
Bolivia no poda quedarse encerrada para siempre en el corazn de Amrica del Sur
y se comprometieron a negociar con Bolivia un acceso soberano al mar.
Hoy m pas, como siempre lo ha hecho, pide una solucin pacfica a su
enclaustramiento y por ello acude a la Corte Internacional de Justicia a fin de resolver,
en derecho , esta controversia que obstaculiza la integracin latinoamericana.
En el Libro del Mar se expresan los sentimientos de todas las bolivianas y bolivianos
para dar a conocer a la comunidad internacional y a todos los pueblos del mundo
las causas de la invasin y la guerra; los principales compromisos asumido s por
Chile de negociar con Bolivia una salida soberana al Pacfico; las razones con las
que Bolivia recurre a la jurisdiccin internacional para encontrar una solucin a
su enclaustramiento; y los dao s y perjuicios que sufre Bolivia a causa de su
mediterraneidad.
Estamos seguros que la historia, la conciencia de la comunidad internacional, la razn
y el derecho acompaan a Bolivia en su demanda martima, y que junto al pueblo
chileno, encontraremos la frmula que acabe para siempre con el enclaustramiento
y nos permita tener un acceso soberano al mar.
El mar de Bolivia, ser un mar de los pueblos, un mar de esperanza y reconciliacin,
abierto al encuentro de todas las naciones del mundo como testimonio de que los
pases hermanos pueden resolver sus conflictos de manera pacfica.
PRESENTATION
A century has passed since Chile invaded the Bolivia n littoral and ca used the War
among three brothern a tions, imprisoning Bol ivia in a torce d geog raphic
confinement.
Since then, seve ral Chilean Presidents and Chancellors understood that Bolivia
could not remain cloistered in the heart of America forever and undertook to
negotiate with Bolivia this latter's sovereig n access to the sea.
Today my country, as it has always done, asks far a peacefu l solution to its
confinement, and dueto that, it resorts to the lnternat iona l Co urt of Justice in
arder to settle this controve rsy, by law, which hampers integ rat ion in Lati n Amer
ica.
The Book of the Sea translates the feelings of ali Bolivians and to let the
international community and all nations of the world know the rea so ns behind the
invasion and the war, the main undertakings assumed by Chile to negotiate with Bo
livia a sovereign access to the sea, the motives by which Bolivia has resorted to
international jurisdiction to find a solution to its confinement, and the damages
and detriment that Bolivia endures on account of its landlocked condition.
We are certain that history, the awarene ss of the international community, reason
and the applicable law endorse Bolivia's maritime c la im, and a long w ith the C
hilean people we s hall find a formu la that puts an end to t he confine me nt fo reve
r and allows us to have a sovereign access to the sea.
The sea far Bolivia will be a sea far the people, a sea of hope and reconciliation,
open to the convergence of all nations of the world as a testimony that brother
countries can settle their conflicts peacefully.

Mucho antes del Imperio del Tahuantinsuyo, Tiahuanacu, la metrpoli milenaria del macizo
andino. Haba impreso el sello de su civilizacin en aquellas costas. Luego, la dinasta de
Manco Capac y Mama Dello irradi desde esa misma meseta su cultura adm irable. Diversos
lugares del Litoral tienen nombres de origen incaico y conservan huellas de su presencia.
Se sabe que la palabra Atacama es de origen quechua y que ese territorio fue descubierto
durante el reinado del Inca Yupanqui quien lo Incorpor a su Imperio. ':"

Long before the Empire of Tahuanti nsuyo, T iahuanacu, the millenary metropolis of the Andean
massif, had printed the hallmark of its civilization on those coasts . Subsequently, the dynasty
of Manco Capac and Mama Dello irradiated its admirable culture from that plateau. Plenty of
the names employed i n the littora l have an Inca origin and they keep treads of its presence. lt
is known that the word Atacama' has a Quechua origin and that that territory was discovered
during the rule of I nca Yupanqui who incorporated it to Inca Empire.

En 1877 un terremoto y el consecuente maremoto [estimado
en 8,8 grados en la escala de Richter en mediciones
posteriores] arrasaron la costa boliviana devastando ese
territorio. Ver figuro 9. Por si esto fuera poco, en 1878 una
terrible sequa asol importantes sectores del territorio
boliviano. Como consecuencia de estos desastres naturales,
el Gobierno de Bolivia solicit a la empresa anglo-chilena
Compaa de Salitres y Ferrocarril de Antofagasta el pago
de 10 centavos por cada quintal de salitre exportado a fin
de generar recursos ante la catstrofe natural que haba
afectado a la regin. Ver figuro 10. Esta solicitud suscit un
reclamo por parte del Gobierno de Chile antes que la
Compaa acudiera
a
los
tribunales
bolivianos
correspondientes. Por su parte, el Gobierno de Bolivia hizo
saber que estaba llano a acogerse al recurso arbitral
previsto en el Protocolo Complementario de 1875.

emiti una Circular expresando la intencin de su pas de

Asimismo, Chile confirm en las citadas notas sus
compromisos previos y su predisposicin a estudiar en
gestiones directas con Bolivia la posibilidad de otorgarle
un acceso soberano al mar. Ver figuras 28 y 29.
Ese acuerdo fue refrendado por las autoridades chilenas
en numerosas declaraciones pblicas en los meses
siguiente s .
En el curso de las negociaciones, el Presidente chileno
Gonzlez
Videla
le
comunic
al
Presidente
norteamericano Harry Truman que la frmula de acuerdo
por la cual Bolivia obtendra un acceso soberano al
Ocano Pacfico sera a cambio del uso, por parte de
Chi le, de agua s del Lago Titicaca . Haciendo eco de
esta informacin, e l Presidente Truman se refiri en dos
ocasione s a la negocia c in entre Bolivia y Chile en los
trminos planteados por el Gobierno chileno. Sin
embargo, Bolivia aclar pblicamente que nunca
comprometi el uso de esas aguas a favor de Chile.
Pese a las aclaraciones respecto a los verdaderos
trminos de la negociacin, una serie de especulaciones
periodstica s generaron la oposicin de crculos polticos
tanto en Bolivia como en Chile, razn por la cual la
negociacin pactada mediante las Notas de 1950 qued
pendiente. Ver figuro 30.

En 1986, varias reuniones sostenidas entre los Cancilleres
de Bolivia y Chile, Guillermo Bedregal y Jaime del Valle,
respectivamente, dieron lugar a un nuevo proceso de
negociacin conocido como "Enfoque Fresco".
El escenario principal de la negociacin, tuvo lugar en
Montevideo entre el 21 y 23 de abril de 1987. En esa
oportunidad el Canciller de Bolivia entreg dos memorndums
al Canciller de Chile. Por el primero se propuso la cesin a
Bolivia de una franja territorial soberana al norte de Arica
unida al territorio boliviano, y por el segundo la cesin de un
enclave, el cual no perjudicara la continuidad territorial de
Chile. Finalizada la reunin en Montevideo, un comunicado
conjunto confirm que la propuesta boliviana sera sometida
a la consideracin del Gobierno chileno.
No obstante, mediante un comunicado de prensa de 9 de
junio de 1987 Chile rechaz categricamente las propuestas
de Bolivia, dando as por terminado de manera abrupta e l
proceso de negociacin s in que ste pudiera alcanzar el
objetivo planteado. En la oportunidad, Chile manifest que
no cedera soberana a favor de Bolivia. See figure 35.

(1986-1987]
In 1986, severa ! meetings held between the Foreign
Ministers of Bolivia and Chile, Guillermo Bedregal and Jaime
del Valle, respect ive ly, led to a new process of negotiation
known as "Fresh Approach".
The main sce nario of the negotiations took place in
Montevideo between 21 and 23 April 1987. On that occasion,
the Bolivian Foreign Minister submitted two Memoranda to
the Chilean Foreign Minister. The transfer of a sovereign strip
of land, located in the north of Arica and linked to the Bolivian
ter ritory was proposed through the first memorandum . And
through the second one, Bolivia proposed the transfer of an
enclave that wou ld not prejudice Chile's territorial continuity.
At the e nd of the meeting, a joint communiqu confirmed
that the Bolivian propasa! would be subject to the
consideration of the Chilean Government.
However, through a press release of 9 June 1987, Chile
categorica lly rejected Bolivia's proposaIs, abruptly putting an
end to the negotiation process and preventing it from meeting
its aim. On that occasion, Chile declared that it would not
transfer sove rei gnty in favour of Bolivia. See figure 35.

TRIBUNAL INTERNACIONAL
En estas circunstancias en su discurso del 23 de marzo,
el Presidente Morales expres: "a pesar de 132 aos de
dilogo y esfuerzos, Bolivia no tiene una salida soberana
al Pacfico . Frente a esta realidad es necesario dar un paso
histrico... el Derecho Internacional, en estas ltimas dcadas
y particularmente estos ltimos aos, ha dado grandes
avances. ahora existen tribunales y cortes a los cuales pueden
llegar los Estados soberanos a reclamar y demandar lo que en
derecho les corresponde ... Por todo ello, la lucha por
nuestra reivindicacin martima. lucha que ha marcado
nuestra historia por 132 aos, ahora debe incluir otro

former Chancellors. who agreed on the fact that the Solivian
maritime c laim is a national and higher cause which stands

territory, Bolivia ceased to be a coastal state able to
directly communicate with the rest of the world. That
situation cont inues to have negative implications on its
economic a nd social development, for, besides having
lost a land area of approximate ly 120.000 km2, Bolivia
was depr ived of the natur al resources ex isting in that
territory as well a s in the adjacent coasta l area.

La Repblica de Chile i la Repblica de Bolivia en el propsito
de estrechar cada vez mas los vnculos de amistad que unen
a los dos paises i de acuerdo en que una necesidad superior
i el futuro desarrollo i prosperidad comercial de Bolivia
requieren su libre i natural acceso al mar, han determinado
ajustar Tratado especial sobre trasferencia de territorio i al
efecto han nombrado i constituido por sus Plenipotenciarios,
a saber:
Su Excelencia el Presidente de la Repblica de Chile a don
Luis Barros Borgoa, Ministro de Relaciones Esteriores,
i Su Excelencia el Presidente de la Repblica de Bolivia a
don Heriberto Gutierrez, Enviado Estraordinario i Ministro
Plenipotenciario de Bolivia en Chile.
Quienes, despus de haber canjeado sus Plenos Poderes i
habindolos hallado en buena i debida forma, han acordado
las siguie ntes bases:

Si a consecuencia de l Plebiscito que haya de tener lugar
en conformidad al Tratado de Ancn o a virtud de arreglos
directos, adquiriese la Repblica de Chi le dominio i soberania
permanentes sobre los territorio s de Tacna i Arica, se obliga
a trasferirlos a la Repblica de Bolivia en la misma forma i
con la misma estension que los adquiera, sin perjuicio de lo
estab lecido en el artculo 11.
La Repblica de Bolivia abonar como indemnizacion por
dicha transferencia de territorio la suma de cinco millones[$
5.000.000] de pesos de plata, de ve inticinco gramos de peso
i nueve dcimos de fino, quedando especialmente afecto
para responder a este pago el cuarenta por ciento [LW%] del
rendimiento bruto de la Aduana de Arica.

except after all ot her nitrate deposits existing within the
territory of the Republic of Chile are exhausted, unless the two
Governments agree differently through a spec ial agreement.
VII.
This Treaty, which shall be signed at the same time as
those of Peace and Commerce concluded between the two
Republics, shall be confidential and shall not be published
without the agreement of the two High Contracting Parties.
VIII.
The instruments of rat ificatio n of this Treaty shall be
excha nged within a period of s ix months and the
exchange shall take place in the city of Santiago.
In witness whereof, the Minister of Foreign Affairs of Chile

deuda reconocida a favor de Don Pedro Lpez Gama ,

reconoc idos en favor de Don Juan G. Meiggs,
representado por Don Eduardo Squire, provenientes del
contrato celebrado en 20 de marzo de 1876, sobre arren

La Repblica de Bolivia tendr el derecho de constituir
ajencias aduaneras en los puertos que designe para hacer
su comercio. Por ahora seala por tales puertos habilitados
para su come rcio los de Antofagasta i Arica.
Las ajencias cuidarn de que las mercaderas destinadas
en trnsito, se dirijan del muelle a la estacin del ferrocarril
i se carguen i transporten hasta las Aduanas de Bolivia en
vagones cerrados i sellados i con guas que indiquen el
nmero de bultos, peso i marca, nmero i contenido, que
sern canjeados con tornaguas.

VIII
Mientras las Altas Partes Contratantes acuerdan celebrar
un Tratado especial de Comercio, el intercambio comercial
entre ambas Repblicas se rejir por las reglas de la ms
estricta igualdad con las aplicadas a las dems naciones i en
ningn caso se colocar a los productos de cualquiera de
las dos Partes en condiciones de inferioridad respecto de
las de un tercero. En consecuencia, tanto los productos
naturales i manufacturados de Bolivia como los de Chile,
quedarn sujetos en su internacin i consumo, en uno i otro
pas, al pago de los impuestos vijentes para los de las dems
naciones, i los favores, exenciones i privilejios que cualquiera
de las dos Partes otorgare a una Tercera podrn ser exijidos
en igualdad de condiciones por la otra.
Las Altas Partes Contratantes conv ienen en dar,
recprocamente, en todas las lneas frreas que crucen sus
respectivos territorio s, a los productos nacionales de uno i
otro pas, la tarifa que acuerden a la nacin ms f avorecida.

Los productos naturales i manufacturados de Chile i las

Artculo X
Los productos naturales i manufacturados de Bolivia en trnsito
para el estranjero sern espartados con guas franqueadas por
las Aduanas de Bolivia o por los funcionarios encargados de
este objeto. Dichas guas sern entregadas a los agentes
aduaneros en los respectivos puertos i sin otra formalidad,
embarcados estos productos para los mercados extranjeros.

Article VII.
The Republic of Bolivia shall have the right to establish
customs agencies in the ports which it may designate for its
commerce. For the present it indicates as suc h ports for its
commerce those of Antofagasta and Arica. The agencies
shall tak e care that the goods in transit sha ll go directly
from the pier to the railroad station and shall be loaded
and transported to the Bolivian custom-houses in wagons
closed and sea led and with freight schedu les whi ch shall
indicate the number of packages, their weight and marks,
numbers and contents, whic h shall be exchanged for
receipts.
Article VIII
Until the high contracting parties s hall agree to celebrate
a spec ial commercial treaty the commercial interchang e
between the two Republics s hall be regulated by rules of the
st rictest equality with those applied to other nations, and
in no case shall any product of either of th e two parties be
placed under conditions inferior to tho se of a third party. Ali
the natural and manufactured products of Chile, therefor e,
as well as those of Bolivia, s hall be s ubject on their entry
into and their consumption in the other country, to the
payment of the imposts in force for those of other nations,
and the favours, exemptions, and privileges which either of
the two parties sha ll grant to a third may be demanded on
equal conditions by the other.
The high contract ing parties agree to accord reciprocally
on ali railroad lines which cross their respective territory
the sa me rates to the native products of the othe r country
that they accord to the most favoured nation.
Article IX
The natural and manufactured products of Chile and the
nationa lized goods, in order to be taken into Bolivia, shall
be dispatched with the proper consular invoice and with t
he freight schedules spoken of in Article 7. Cattle of ali
kinds and natural products of little va lue may be
introduced without any formality and dispatched with the
simple manifest written in the custom-house.
Article X
The natural and manufactured products of Bo livia in transit
to f oreign count ries shall be exported with schedules
issued by the Bolivian custom- house s or by the officers
charged with this duty; these schedules s hall be delivered to
the customs agents in the respective ports and the products
embarked without other forma lity for foreign markets.

Reunidos en el Ministerio de Relaciones Exter iores de la
Repblica de Bolivia los Seores Carlos Gutirrez, Ministro
de Relaciones Exteriores y Emilio Bello Codes ido, Enviado
Extraordinario y Ministro Plenipotenci ario de la Repblica
de Chile, animados del deseo de hacer ms slidos y
duraderos los lazos de amistad existentes entre sus pases
respectivos mediante nuevos acuerdos que propendan al
mayor desarrollo de sus relaciones polticas y comerciales.
consultando la armona de sus intereses y asp iraciones
recprocas han convenido en iniciar estas conferencia s con
el fin de cambiar las ideas generales sobre la manera de
hacer prcticos estos elevados propositos.
El Ministro de Chile expuso que, como haba tenido ya
oportunidad de ma nifestarlo a la Cancilleria de Bolivia en
cumplimiento de la grata y honrosa misin que le ha sido
confiada ante este Gobierno, existe de parte del Gobierno de
Chile el mejor deseo de propiciar una poltica de sincero y ms
estrecho acercamiento con Bolivia; que a este objeto reproduce
las bases que en lneas generales somet i al Honorable seor
don Oaro Gutirrez en Septiembre ltimo para procurar un
acuerdo que permita a Bolivia satisfacer su aspiracin de
obtener una salida propia al Pacfico, independientemente de
la situacin definitiva creada por las estipulaciones del Tratado
de Paz y Amistad de 20 de Octubre de 190LJ.
Las ideas o puntos fundamental es que, obedeciendo a
sentimientos especialmente amistosos hacia Bolivia,
propone el representante de Chile, debidamente autorizado
por su Gobierno como bases de un acuerdo entre ambos
pases, son las siguientes :
El Tratado de Paz y amistad celebrado entre Chile y Bolivia
el 20 de oc tubre de 190LJ, define las rnlaciones poltica
s de los dos pases en forma definitiva y puso trmino a
toda s las cuestione s derivadas de la guerra de 1879.

V. En el curso de las negociaciones he sugerido para su
consideracin en una forma u otra tres frmulas lgicas
de arreglo. Las ideas de Chile y del Per no convergieron
hacia ninguna de ellas. He sugerido varias combinaciones
tales como la divisin del territorio co rtado por una espec ie
de "corredor" y el proyecto de "ciudad libre". Discusiones
interesantes de detalles. de fronteras. etc .. siguieron, pero
esta s discusiones no llegaron a conclusin alguna. He
sugerido tambin la neutralizacin del territorio, pero ello no
ha sido favorecido por ambas partes.
Recapitulando: Los procedimientos segn el artculo 111
del Tratado de Ancn han sido infructuosos. Las partes no
convinieron acerca de la divisin del terr itorio sobre base
alguna. Tampoco convinieron en la neutralizacin de todo o
parte del territorio. Ninguna sugestin que se formul pudo
ser aceptada por Chile y el Per.

Con este preludio permtaseme ahora definir la sugestin
concreta que someto a los tres pases:

reflexiones que el Secretario de Estado hace, al exponer los
antecedentes que lo han inducido a propiciar aquella frmula,
determinan al Gobierno de Chi le a rememorar, aunque sea
brevemente, las principales fases histricas y diplomticas
de la cuestin.

The Government of Chile has read with keen interest the
Memorandum in which His Excellency, the Secretary of State
of the United States of Ame rica, submits to its consideration
the general lines of a plan intended to procure a definitive
so lut ion of the controversy regarding Tacna and Arica. The
reflections which the Secretary makes in setting forth the
antecede nts wh ich have induced him to favour that formula,
move the Chilean Government to recall, although briefly. the
principal historical and diploma tic phases of the question .

Furthermore, in the course of the negotiations conducted
during the present year befare the State Oepartment and
within the formula of territoria l division, the Government of
Chile has not rejected the idea of granting a strip of territory and
a port to the Solivian nation. The lofty and inspired proposals
which the Government of Chile has accepted in this particular
matter, did not encounter on the part of the Government of
Peru the reception which they deserved, and the question has
remained pending until the present moment.
Our Government remains within the stipulations of the Treaty
of Ancon, thus following its long and uninterrupted tradition
of respect for the pledged word and the faithful and exact
fulfilment of internationl ubligations.
With the same thought it has respected the Award of
President Coolidge and believes that the best solution of
the problem is the application of the method indicated in
Article 3 of the Treaty of Ancon and confirmed by the
decision of the Arbitrator .
T he definitive possession of the territory as between Chile
and Peru, once determined in conformity with these
provisions, the Chilean Government would honour its
declarations in regard to the consideration of Solivian
aspirations.
The proposal of the Department of State goes much farther
than the concessions which the Chilean Government has
generously been able to make. lt involves the definitive
cession, to the Republic of Bolivia, of the territory in dispute
and a lthough, as the Secretary of State says, this solution
does not wo und the dignity of the contending countries and
is in harmony with the desire, repeatedly shown by the
Chilean

Subseq uent ly, on the occas'ibn of the claim presented by
Bolivia on 1November 1920, at the First Assembly of the
League of Nations, the Delegate of Chile, His Excellency
Agustn Edwards, stated as follows:

Kellogg, for Chile and Peru to cede to Bolivia "any right. title
and i r1terest which either may have in the provinces of Tacna
and Arica", his Excellency Mr. Jorge Matte. Minister of Foreign
Affairs of Chile, stated that "the Government of Chile has not
rejected the idea of granting a strip of territory and a port
to the Solivian nation" and that it accepts "to consider . in
principie, the proposal".
At the start of his Government, His Excellency the President
of the Repub lic, Mr Gabriel Gonzlez Videla, demonstrated a
s imilar d isposition: during his c onver sa ti o ns with the
Member of la Junta and Minister of Foreign Affairs, His
Excellency Mr. Aniceto Solares, who attended the
presidential inauguration, in November 19LJ6; subsequently
during his meetings with the former President of Bolivia
and current Ambassador in Spain, His Excellency sir
Enrique Hertzog, during his stay in Santiago. in December
19LJ9; and. finally, during the numerous hearings that were
held to dea l with this issue.
With such important precedent s. that identify a clear policy
direction of the Chilean Republic, 1 have the honour of
proposing to His Excellency that the Governments of Bolivia
and Chile formally enter into direct 11egotiatio11s to satisfy
Bolivia's fundamental need to obtain its own sovereign
access to the Pacific Ocean, so lving the problem of
Bolivia's landlocked situation on terms that take into account
the mutual benefit and genuine interests of both nation s.
Certain of being able to rely upon the acceptance of the
Government of His Excellency, thus beginning a work of great
future possibilities for Bolivia and Chi le, 1 renew assurances

[Xl0/81] of December 10, 1981. and AG/RES . 602 [Xll-0/82], of
November 20, 1982, in which, respectively, it is declared and
reiterated that it is of continuing hemispheric interest that
an equitable so lution be found whereby Bolivia may obtain
sovereign and useable access to the Pacific Ocean; and
CONSIDERING:
That in a spirit of fr aternity and with a view toward American
integration, it cont inues to be necessary to achieve the
objective set forth in the preceding declaration and
conso lidate a climate of peace and harmony to st imulate
economic and social progress in the area of the Americas
directly affected by Boliv ia's lack of its own access to the
sea,

concerning the maritime problem of that country, of the
observations made by the governme nts o f Ch ile and

BOLIVIA Y CHILE DE 22 DE FEBRERO DE 2000
l. Los Ministros de Relaciones Exteriores de Bolivia y Chile
se reunieron en Algarbe Portugal, el 22 de febrero del
ao 2000, para cont inua r el dialogo que iniciaron en Ro
de Janeiro y la Habana, en junio y noviembre de 1999.
Estuvieron acompaados de altos funcionarios de sus
Despachos.
2. Los Cancilleres resolvieron conformar una agenda de
trabajo, que ser formalizada en las siguientes etapas de
dialogo, que incorpore,sin exclusin alguna. las
cuestiones esenciales de la relacin bilateral, con el
espritu de contr ibuir al establecimiento del c lima de
confianza que debe presidir ese dilogo. Los avances
logrados sern puestos en conocimiento de las nuevas
autoridades del Gobierno de Chile para la ulterior
prosecucin de las conversaciones encaminadas a
establecer esa agenda .
3. En la
ocasin abordaron, con una clara voluntad
constructiva y con el fui sea lado precedentemente,
todos los temas de inters fundamental para ambos
pases, sin exc lusiones .
Lj, El desarrollo de ese dilogo estar encam i nado a superar
las diferencias que han impedido una plena integracin
entre Bolivia y Chile, con el firme propsito de buscar y
alcanzar soluciones a las cuestiones que afectan sus
relac iones polticas y econmicas.
5. Los Cancilleres dejan constancia de la forma franca y
amistosa en que se han llevado a cabo esos encuentros,
as como de la buena disposicin de las partes, la que
reafirmaron la voluntad de dilogo que se ha puesto en
marcha.

l. The Ministers of Foreign Affairs of Bolivia and Chile met
in Algarve, Portuga l on 22 February 2000 to continue the
dialogue that was sta rted in Rio do Janeiro and La Habana
in June and November 1999. They were accompanied by
high officials from their Offices .
2. The Ministers of Foreign Affairs resolved to define a
working agenda that will be formalized in the subsequent
stages of dia logue and which includes, without any
exception, the essential issues in the bilateral
relationship:
in the spirit of contributing to the
establishment of a trusting atmosphere that should
preside over this dialogue. The process achieved

3. On that occasion they addressed, with a clear constructive
willingness and for the purpose indicated above, ali the
issues of main interest for both countries, with no exclusion.

the differences which have prevented the full integrat ion
between Bolivia and Chile, with the firm purpose of
searching and reaching solutions to the question s that
affect its political and economical relations.
5. The Ministers of Foreign Affairs evidence the frank and
friendly manner with which those meetings were held as
well as the willingne ss of the parties to reaffirm the wil l
to engage in the dialogue that has been launched .

Con fecha 25 de noviembre de 2006, se celebr en Santiago
la XV Reunin del Mecanismo de Consultas Polticas Chile
- Bolivia . Las Delegaciones estuvieron presididas por el
Subsecretario de Relaciones Exteriores de Chile, Embajador
Alberto Van Klaveren y por el Viceministro de Relaciones
Exterio1es y Cultos de Bolivia, Embajador Mauricio Dorfler.
Ambas delegaciones coincididen que el desa rrollo de la
confianza mutua es el cimie nto sobre el que descansa el
tratamiento de todos los lemas de la relacin b ilateral.
En un ambiente de buena disposicin y espritu constructivo,
consideraron y aprobaron el conten ido del Acta de la 11
reunion del Grupo de Trabajo sobre Asuntos Bilaterales,
adoptada en Santiago el 31 de octubre pasado.

The XV Meeting of the Mechani s m for Political
Consultation Chile-Bolivia was held in Santiago on
25 November 2006. The delegations were headed by
the under- Secretary of the Foreign Ministry of Chile,
Ambassador Alberto Van Klaveren and by the Sol
ivian v ice-Minister of Foreign Affair s an d Worship ,
Ambassado r Mauricio Dorfler.
Both delegations agreed on the fac t that mutual trust
is the base far dealing with a li the items of the
bilateral relation.
In this atmos phere of wi llingness and constructive
spirit, they considered and approved the content of
the Minutes of the 111 Meeting of the Working Group
on Bilate ral lssues a dopted in Santiago on 31
October.

pending issues between the two States and that "Bolivia lacks

30. In these circumstances, it is clear that Chile has no
intention of tru ly going forward in the formal negotiation
regarding the agreement to perform. its obligation of
effect ive ly e nsur ing a fully sovereign access to the sea
for Bolivia. Therefore, being a peaceful State, Bolivia has
decided to solve the present dispute with Chile by means of
peaceful settlement mechanisms provided
far
in
international law. Bolivia therefore submits the present
dispute to the lnternationa l Court of Justice.
IV. The legal Grounds on which the Claim is Based
31. The facts provided above [Sec t ion 1 11) show that, beyond
its general obligations under international law, Chile has
committed itse lf, more specifica lly through agreements,
dip lomatic practice and a series of declarations attributable
to its highest -level representatives, to negotiate a sovereign
access to the sea for Bolivia. Chile has not complied with this
obligat ion and, what is more, at the present date Chile denies
the very ex i st ence of its obligation.

SPEECH ISSUED BY PRESIDENT EVO MORALES ON THE
Bolivia was born to independent life with a coast line 011 the
Pacific Ocean of LJOO kilometres of coast and 120 square
kilometres from the Loa River to Paposo; the possession of
that territory was given centuries ago when Tiahuanacota's
culture spread its inluence to the sea. On t he other hand, the
Republic of Chile was born to independent living with a
smaller territory, of course, w ith a different border from the
one it currently owns.
The first Chilea n constitutions clearly identified that the
northern boundary of t hat country was the Atacama Desert,
from which the Bolivian territory began. In the judgment
of the lnternation a l Court of Justice, the Peruvian -Chi
lean maritime dispute of 22 January 201LJ, th e following
is mentioned:
