The war with Chile was disastrous, and consequently lost the territories of Tarapaca
and Arica. The Treaty of Ancon (1883) and the Treaty of Lima (1929) determined new
land borders, but there are no references to the maritime border between Chile and
Peru. After a couple of decades by Supreme Decree No. 781 on August 1, 1947, Peru
proclaimed sovereignty and jurisdiction over the sea area at a distance of 200 nautical
miles. Later on August 18, 1952, Chile, Ecuador and Peru signed the Declaration on the
Maritime Zone, commonly called "Santiago Declaration" containing no agreement
whatsoever alluding to the distinction between general maritime zones. Then on
December 4, 1954, Chile, Ecuador and Peru signed an agreement to avoid the
imposition of sanctions on the "little bearing vessels crewed by seafarers sailing with
little knowledge of or lack the tools required to determine its exact position at sea. " In
1968 and 1969, Peru and Chile signed documents to guide fishermen tasks performed
in the vicinity of the coast, for that purpose placed two threading headlights that cast a
beam of light in the direction of the parallel 18 21 ' 03 "S.
Peru's position on maritime delimitation between States with adjacent coasts was
officially launched by the President of the Delegation of Peru at the Third United
Nations Conference on the Law of the Sea in 1980, meaning that in the absence of a
specific agreement delimitation expressly agreed to fix definitely the maritime
boundaries. On May 23, 1986, the then Minister of Foreign Affairs of Peru, Chile
Chancellor raised the lack of a boundary agreement. Since October 2000 there is an
exchange of letters between Peru and Chile concerning the issue of maritime
delimitation, formally proposing Peru, in 2004, the start of negotiations to end the
dispute. On January 16, 2008 our country submitted the application to the International
Court of Justice, based in The Hague, Netherlands, asking the court to proceed with the
maritime delimitation between the two states, given that on March 19 2008 Peruvian
present memory, dated March 9, 2010 presented its counter is Chilean, on 9 November
2010, the Peruvian replica, the July 11, 2011 the Chilean rejoinder from 3 to 14
December 2012, is conducted public hearings and must issue a ruling by the
International Court of Justice in The Hague, about the month of June 2013.
