Publicada Ley Especial del Fondo Nacional de Prestaciones Sociales

En la Gaceta Oficial N 39.945 de fecha 15 de junio de 2012, fue publicado el Decreto N 9.053 mediante el cual se dicta el Decreto con Rango, Valor y Fuerza de Ley Especial del Fondo Nacional de Prestaciones Sociales. El objeto del presente Decreto es crear el Programa Fondo Nacional de Prestaciones Sociales mediante el cual se establecen las condiciones para la recepcin y administracin de los depsitos correspondientes a la garanta de las prestaciones sociales de los trabajadores en las instituciones financieras del sector bancario que integran la Banca Pblica. El Programa Fondo Nacional de Prestaciones Sociales se desarrollar bajo los lineamientos que determine el Ministerio del Poder Popular con competencia en planificacin y finanzas, y se ejecutar a travs de las instituciones financieras adscritas al Ministerio del Poder Popular con competencia en materia de banca pblica, garantizando que las operaciones financieras que se realicen en el marco de este Programa, se hagan mediante los instrumentos o mecanismos ms idneos que aseguren liquidez, confiabilidad y el mximo retorno de los recursos para nico beneficio de los trabajadores. Prev la norma que el patrono, a libre eleccin del trabajador, podr depositar la garanta de las prestaciones sociales de stos en las cuentas correspondientes al Fondo Nacional de Prestaciones Sociales. Publication of Special Law of the National Fund for Severance Benefits

Decree No.9,053, which provides for the Decree with Rank, Value and Force of Special Law of the National Fund for Severance Benefits, was published in Official Gazette No.39,945 of June 15, 2012. The purpose of this Decree is to create the "National Fund for Severance Benefits Program" establishing the conditions for receipt and administration of the deposits corresponding to the workers severance benefits guarantee at the financial institutions of the public banking sector. The "National Fund for Severance Benefits Program" shall be developed under the guidelines of the Peoples Ministry for Planning and Finance, and shall be implemented through the financial institutions ascribed to the Peoples Ministry for Public Banking, ensuring that financial transactions under this program are carried out through the most appropriate instruments and mechanisms to guarantee the liquidity, reliability and maximum return of funds for the sole benefit of the workers. The Law sets out that the employer, at the workers own discretion, may deposit the severance benefits guarantee in the accounts corresponding to the National Fund for Severance Benefits. This Decree came into effect from its publication in Official Gazette.
