Las esperanzas en relacin a cambios en inmigracin en el
2012 han creado un escenario casi Dantesco. Seguimos es-
perando alcanzar el cielo, pero por ahora tendremos que con-
formarnos con el purgatorio. Todo empez a raz de la carta
de Janet Napolitano al Senador Harry Raid en Agosto del
2011, en donde se confrmaba que en cuanto a deportacio-
nes los recursos del gobierno se utilizaran en casos de alta
prioridad, es decir en relacin a individuos peligrosos para la
sociedad. Esto permiti que la llamada discrecin prosecuto-
rial se rehabilitada como otra herramienta migratoria.

Desafortunadamente, a su vez solo podra ser utilizado por
personas que estn enfrentando un juicio de inmigracin, y
que adems cumplan con varios factores prestablecidos. En
marzo, el pequeo nmero de afortunados individuos benef-
ciados por esta discrecin prosecutorial segn TRAC (Trans-
actional Records Access Clearing house) apenas alcanzo
un 0.9 % del total de casos de deportacin. En Abril, fuentes
del gobierno anunciaron un estimado del 7 % del total de
los casos. En la prctica, la realidad es que incluso aquellos
benefciados saben que sus casos no han terminado. La
mayora de la poblacin no esta al tanto de que esto implica
una especia de limbo jurdico, que no da ningn estatus legal
y en el que incluso la posibilidad de permiso de trabajo es
incierta. Al explicar esto a mis clientes siempre hablo de un
cuarto obscuro y polvoriento en donde se colocaran estos
expedientes hasta que alguien decida revisarlos nuevamente
y entonces la lucha empezar nuevamente. La incertidum-
bre es alta. Abogados de inmigracin, ofciales de gobierno
y clientes aprenden conforme se desarrollan estos casos.
No es mi intencin ser negativa pero si ser clara. La discre-
cin prosecutorial no es el cielo, para algunos ser un limbo
temporal, para otros algo inaceptable, y para muchos no ser
ni siquiera una posibilidad. La estrategia se mantiene no
rendirnos al inferno de la deportacin, seguir teniendo espe-
ranza de llegar al cielo, mientras aprendemos a defendernos
con las nuevas herramientas que nos brinda el purgatorio.

heaven, but in the mean time we have to be content with
purgatory.
The expectations started after Janet Napolitanos letter of
August 2011 to Senator Harry Reid confrming that govern-
ment resources should focus on high priority cases; mean-
ing individuals that signify a danger to our society. With this
announcement the power of prosecutorial discretion was
revitalized. Unfortunately, this immigration tool, Prosecuto-
rial Discretion, is not only limited to those that had to attend
immigration court, but those able to comply with various
factors. By March the small number of lucky individuals, was
confrmed by TRAC (Transactional Records Access Clearing
house). Only 9% of those cases appeared to reach prosecu-
torial discretion. In April, Government sources estimated 7%
of cases reached administrative closure. In practice, even if
you are one of those lucky individuals the reality is that your
case is not terminated. What most of the population does
not know is that this implies a limbo legal status, it does
not give the individual any legal status, and even the beneft
of employment authorization is uncertain. I always tell my
clients they will take your fle put it in a dark dusty room until
someone decides to take a look and then we will start the fght
again. The uncertainty is high and immigration attorneys,
government offcials, and clients are learning as it goes. do
not mean to be negative, just clear. This is not immigration
heaven, for few it will be a temporary limbo, for others it will
be unacceptable, and for many not be a possibility.

"What is "Cinco de Mayo? (t's the ffth of May in Spanish). Why
is it celebrated? What is this day in History? (May 5, 1862).
Today its a celebration of Mexican Heritage, celebrated on both sides of the
US-Mexican border. t's a time for festas, parades, dancing and Mariachi music. t's
a date in history when Mexicans realized they could defeat 6000 French soldiers with
a two thousand local natives at the battle of Puebla de Los Angeles, a small town in
east-central Mexico.
What are the events that lead up to Cinco de Mayo?
The Mexican government was nearly bankrupt after spending the 1900's fghting several
military battles, such as the war of Independence from Spain ending in 1821, the Mexican-American
War of 18461848 and the Mexican Civil War of 1858. Mexico was unable to pay its European debt
to its backers, England, Spain and France. Without any money to pay the debt, President Benito
Juarez declared that his government would suspend payment of the debt for two years. The Europeans
didnt approve and conspired to invade Mexico and collect their money. The French had other plans. It
wanted to invade Mexico and turn it into a French Colonial Empire, ruled by a Monarch. When Spain
and England heard the news, they dropped out of the plan and withdrew. Meanwhile, Napoleon III,
proceed with his invasion plans and sent a French Fleet of about 6,000 troops to storm Veracruz and
later, invade Mexico City and topple the government. The plan almost worked except for one thing.
The French general ordered a frontal assault on Puebla. As Diazs troops rode to battle the French,
Zaragoza's fghters held their position and forced the French to retreat. -- Reported by "Beyond the

Another account of the event reports a smaller number of troops were involved: It was reported
that the Mexican soldiers were out numbered. At the time, the French army was one of the most
powerful armies in the world. The French began the battle with 6000 French troops vs, 2000 Mexican
troops. After fghting from dawn to dust, the French lost nearly 500 soldiers whereas 100 Mexicans
were lost. After the battle, the remaining French soldiers retreated in defeat. (Source: the History

proved that the giant Goliath could be defeated by the small David. It became a rallying point and
source of pride that has been celebrated up to this very day. However, at the time, the short victory
would not last. The larger war was lost after Napoleon III heard the news and sent another well-armed
French Fleet to storm Veracruz and defeat all opposition. That year,

Mexico City, topple the Mexican government, and install his cousin, Austrian Duke Ferdinad Maximilian
I, as Emperor of Mexico. Although not a major strategic win in the overall war against the French,
Zaragozas success at Puebla represented a great symbolic victory for the Mexican government and
bolstered the resistance movement. Six years laterthanks in part to military support and political
pressure from the United States, which was fnally in a position to aid its besieged neighbour after the
end of the Civil WarFrance withdrew. The same year, Austrian Archduke Ferdinand Maximilian, who
had been installed as emperor of Mexico by Napoleon in 1864, was captured and executed by Jurezs
forces. Puebla de Los Angeles was renamed for General Zaragoza, who died of typhoid fever months

Cinco de Mayo is not a national holiday in Mexico. However it is celebrated in the state of
Puebla and other parts of Mexico with military parades, recreation of the Battle of Puebla and other
fe tive events. In the United States, Cinco de Mayo is widely interpreted as a celebration of Mexican
culture and heritage, particularly in areas with substantial Mexican-American populations.

Hoy es una celebracin de la Herencia Mexicana, que se celebra en ambos
lados de la frontera Mxico-Estados Unidos. Es un tiempo para las festas, desfles,
bailes y msica de mariachi. Es una fecha en la historia cuando los mexicanos dieron
cuenta de que poda derrotar a 6,000 soldados franceses con un dos mil nativos de
la zona en la batalla de Puebla de los ngels, una pequea ciudad en el este-centro
de Mxico.
Cules son los eventos que conducen hasta el Cinco de Mayo?
El gobierno de Mxico estaba casi en bancarrota despus de pasar los aos
1900 la lucha contra varias batallas militares, como la guerra de la Independencia de
Espaa que termina en 1821, la guerra Mxico-Americana de 1846-1848 y la Guerra
Civil mexicano de 1858. Mxico no pudo pagar su deuda europea a sus partidarios,
Inglaterra, Espaa y Francia. Sin dinero para pagar la
deuda, el presidente Benito Jurez declar que su gobierno
iba a su pender el pago de la deuda por dos aos. Los
europeos no estaban de acuerdo y conspiraron para
invadir Mxico y recoger su dinero. Los franceses tenan
otros planes. No quera invadir ha Mxico. Lo queria
convertir en un imperio colonial francs, gobernado por
un monarca. Cuando Espaa e Inglaterra escucharon la
noticia ellos se retiraron del plan. Mientras tanto, Napolen
, continuo con sus planes de invasin y envi una fota
francesa de unos 6.000 soldados para asaltar Veracruz y
ms tarde, quiciron invadir la ciudad de Mxico y derrocar
al gobierno. El plan casi funcion, excepto por una cosa.
El general francs orden un asalto frontal a
Puebla. Mientras las tropas de Daz montaron para
combatir a los franceses, los combatientes de Zaragoza
mantuvieron posicin y obligaron a los franceses a

Cinco de Mayo Otra cuenta del evento informa de un
nmero menor de tropas implicados fueron: Se inform
que los soldados mexicanos estaban contados a cabo.
En ese momento, el ejrcito francs fue uno de los ejrcitos ms poderosos del mundo.
Los franceses comenzaron la batalla con 6,000 frente a las tropas francesa de 2000 las
tropas mexicanas.Despus de luchar desde el amanecer hasta el polvo, los francecs
perdi cerca de 500 soldados, mientras que 100 mexicanos se han perdido. Despus de

her American life. Her family lives in constant fear of being
discovered by the authorities and sent back to the poverty
they left behind in Mexico. Can Tyler and Mari fnd a way to
be friends despite their differences?
In a novel full of hope, but no easy answers, Julia
Alvarez weaves a beautiful and timely story that will stay with

Return to Sender began with a surprise: One day, a farmer
asked me to translate for several Mexican workers on
his dairy farm. In Vermont, we dont have a large Latino
population. But my neighbors know I speak Spanish.
Thats how I came to realize that much of the work
on surrounding farms is now being done by Mexican workers
who have left their own farms behind in order to earn a living
in the United States. Many come alone. Others come with
their wives, and sometimes their children, and then have
children in this country, who show up in our schools.
These Mexican farmer-workers share the same story
as their Vermont farmer-employers. Both are fnding it hard
to make a living at farming, Mexican-American children with
undocumented paents are forces live in an underground life in
the United States. Their parents have also have left the land
and their homes for generations. Sometimes its only in the
world of story that we understand the human side of political
and loaded issues. Through the imagination we can rise
above the boarders that divid us and make a new homeland
together through reading and friendship.
The American Library Associations Pura Belpre Award, estab-
lished in 1996, is presented to a Latino/Latina writer and illus-
trator whose work best portrays, affrms, and celebrates the
Latino cultural experience in an outstanding work of literature
for children and youth.

In State Tuition
Colorado State Republican lawmakers dashed the
aspirations of thousands of young Hispanic immigrants who
dreamed of the possibility of applying to college and pay
tuition as state residents for the seventh time.
A House committee controlled by Republicans
rejected the measure and stated it would be useless for
these young people to graduate from college because
they could not get jobs based on their irregular immigration
status.
The attitude of the Republicans was harshly
criticized by Democrats, who indicated that these young
people deserve the opportunity to continue their education at
an affordable price, because the state has already invested
enough money in their basic education.
The initiative would have allowed any student who
graduated from high school in Colorado, pay a slightly higher
tuition than state residents, but much lower than that of
foreign students and other states.

jvenes hispanos indocumentados, quienes soaban con

will see two main areas.
The frst thing a realtor does is to determine the
value of your home is to provide the owner of a Comparable
Market Analysis (CMA). The aim is to compare your home to
homes that have sold in your area in recent months, typically
six months. If Michigan houses are not sold, the houses of
Dallas sell like hotcakes and there are many properties in
foreclosure, located across town in the vicinity of a co-worker
--- this is irrelevant to you. As a landlord, what matters most
to you is the sales activity in the area where you live. The
area can be defned as a quarter mile radius, a subdivision,
zip code or complex building (s) for a condominium. What are
the Days on Market (DOM) in that area? What is the average
price in that area? What is the price per square foot? With
more homes to compare, you can specify a value of your
property After all, your house is worth what a buyer wants to
pay for it.
