Performance Contract

Estimado Gorrión Serrano:

Dear Gorrión Serrano,

La Sociedad de Folklore de la Universidad de Chicago lo invita a participar en su 61° Festival Folclórico Anual,
que se llevará a cabo en línea, el 12 y 13 de febrero de 2021. Usted acepta actuar de acuerdo con los siguientes
términos:
The University of Chicago of Chicago Folklore Society invites you to participate in its 61​th​ Annual Folk Festival,
to be held online, February 12th and 13th, 2021. You agree to perform according to the following terms:

1. Gorrión Serrano tocará por 35 minutos durante uno de los conciertos nocturnos del festival (12 y 13 de
febrero de 2021). La hora y fecha exacta de esto será determinada por la Sociedad Folclórica.
Gorrión Serrano will perform one set, 35 minutes, during one of the festival’s evening concerts (February
12 and February 13, 2021). The exact time/date of this will be determined by the Folklore Society.
2. Por la presente, Gorrión Serrano otorga permiso a la Universidad de Chicago y la Sociedad Folclórica para
transmitir la actuación en vivo a través de un programa de terceros (que incluye, entre otros, Zoom o
transmisión en vivo en YouTube y Facebook).
Gorrión Serrano hereby grants permission to the the University of Chicago of Chicago and Folklore
Society to broadcast the performance live via a third-party program (including, but not limited to, Zoom or
livestream on YouTube and Facebook).
3. Tendrá la opción de enviar un conjunto pregrabado o actuar en una transmisión en vivo (preferida)
configurada por la Sociedad de Folklore
You will have the option to submit either a prerecorded set or perform on a live stream (preferred) set up
by the Folklore Society
a. Si elige enviar un conjunto pregrabado, debe enviarlo a la Sociedad de Folklore antes del viernes 5
de febrero de 2021, una semana antes del Festival.
If you chose to submit a prerecorded set, it must be sent to the Folklore Society by Friday,
February 5th, 2021, one week in advance of the Fest.
b. Si elige actuar a través de transmisión en vivo, también debe participar en una prueba de sonido,
en un momento que determine la Sociedad de Folklore.
If you choose to perform via live stream, you must also participate in a sound check, at a time to
be determined by the Folklore Society.
4. Gorrión Serrano participará en una clínica el 13 de febrero de 2021, con la fecha y hora exactas que

Gorrión Serrano will participate in one festival workshop February 13, 2021, with the exact time and
date to be determined by the Folklore Society.
5. La Sociedad Folclórica se compromete a pagar $900 USD como remuneración total por Gorrión Serrano,
que se pagará en su totalidad con un cheque de la Universidad de Chicago a Gorrión Serrano, que se
enviará por correo. El contrato y el W9 deben estar completamente ejecutados y firmados por Gorrión
 Serrano y la Universidad de Chicago 4 semanas antes del evento para garantizar el control después de la
ejecución final.
The Folklore Society agrees to pay [cost] as total remuneration for Gorrión Serrano, which will be paid in
full by the University of Chicago of Chicago check to Gorrión Serrano, to be mailed to the Gorrión
Serrano. Contract and W9 must be fully executed and signed by both the Gorrión Serrano and the
University of Chicago 4 weeks before the event in order to guarantee check after final performance.
6. La Sociedad de Folklore no permitirá la grabación de audio o video por parte de terceros durante el
Festival. Nos reservamos el derecho de realizar una grabación de archivo de la actuación y pondremos esta
grabación a su disposición solo para uso personal. The Folklore Society se reserva el derecho de dejar la
transmisión en vivo en plataformas de redes sociales como Facebook y YouTube después de la
presentación.
The Folklore Society will not permit audio or video recording by outside parties during the Festival. We
reserve the right to make an archival recording of the performance, and will make this recording available
to you for personal use only. The Folklore Society reserves the right to leave the livestream up on social
media platforms like Facebook and YouTube after the performance.
7. En el caso de que exista alguna situación fuera del control de la Universidad de Chicago que pudiera afectar
seriamente la asistencia y / o la capacidad de continuar la actuación, la Universidad de Chicago tendrá
derecho a cancelar este contrato.
In the event that there are any situations beyond the University of Chicago’S control which could seriously
affect the attendance and/or the ability to continue performance, the “the University of Chicago” shall
have the right to cancel this contract.
8. Opcional: ​Si Gorrión Serrano está interesado en que su música sea utilizada en anuncios de radio o redes
sociales para el Festival, proporcionará a la Sociedad de Folklore una copia digital de su música
seleccionada al menos un mes antes del Festival.
Optional:​ If Gorrión Serrano is interested in having their music used in radio/social media advertisements
for the Festival, they will provide the Folklore Society with a digital copy of their selected music at least
one month prior to the Festival.

Virtual Event Clause

Si Gorrión Serrano viola los términos de uso de ZOOM y, como resultado, dicho desempeño se ve interrumpido y
los servicios no se prestan, no se realizará ningún pago a Gorrión Serrano en virtud del presente.
If Gorrion Serrano violates ZOOM’s terms of use and as a result such performance is disrupted, and services are
not rendered no payment will be made to Gorrión Serrano hereunder.

Gorrión Serrano debe cumplir con todas las regulaciones locales, estatales y federales para COVID-19, según
corresponda, que pueden incluir pero no se limitan a "refugio en el lugar", cuarentena, restricciones de viaje, etc.

Gorrión Serrano must comply with all local, state, and federal regulations for COVID-19 as applicable which may
include but not limited to “shelter in place”, quarantine, travel restrictions, etc. while hosting the event.

Si Gorrión Serrano o el Universidad de Chicago experimentan problemas técnicos fuera de su control inmediato, el
espectáculo se reanudará tan pronto como se puedan resolver los problemas técnicos. Si hay problemas persistentes
con la tecnología o los servicios de Internet (utilizados por el Gorrión Serrano o el Folklore Society), entonces la
actuación se reprogramará a una fecha mutuamente aceptable en la que Gorrión Serrano realizará el resto de la
duración establecida por el contrato. Una vez que el Gorrión Serrano haya completado la duración establecida del
contrato, UNIVERSIDAD seguirá siendo responsable de la garantía total que se indica en este documento. Si los
problemas técnicos o los servicios de Internet utilizados por Gorrión Serrano no permiten un servicio estable y en
vivo ininterrumpido por parte de Gorrión Serrano (es decir, no tiene buena banda ancha, múltiples usos de banda
ancha al mismo tiempo, no pagó la factura de internet, etc.) la actuación se reprogramará por un tiempo que cumpla
con los requisitos de la UNIVERSIDAD ya su discreción. Si no se encuentra ese tiempo y no se pueden prestar los
servicios, Gorrión Serrano renuncia al pago.
If Gorrión Serrano or the University of Chicago experiences technical issues outside of their immediate control, the
show will resume as soon as technical issues can be resolved. If there are persistent issues with technology or the
internet services (utilized by Gorrión Serrano or the Folklore Society), then the performance will be rescheduled to
a mutually agreeable date where Gorrión Serrano will perform the remainder of the contracted set length. Once the
Gorrión Serrano has completed the contract set length, the school will remain liable for the full guarantee listed
herein. If technical issues or the internet services utilized by Gorrión Serrano do not allow for stable, live
uninterrupted service on Gorrión Serrano’s part (i.e. does not have good broadband, multiple uses of broadband at
the same time, did not pay internet bill, and so forth) the performance will be rescheduled for a time that meets the
University of Chicago’s requirements and at their discretion. If no such time is found, and services cannot be
rendered, Gorrión Serrano forsakes payment.

Se entiende que los Gorrión SerranoA ejecuta este acuerdo como un contratista independiente y no es un empleado
de la “UNIVERSIDAD”, y que Gorrión Serrano tendrán el control mutuo de los medios, el método y los detalles
para cumplir con las obligaciones bajo este contrato, excepto por tiempo(s) de ejecución mínimo y duración máxima
del acto. Gorrión Serrano acuerdan cumplir con todas las obligaciones como contratista independiente bajo todas y
cada una de las leyes, ya sean existentes o futuras, de cualquier manera relacionada con el compromiso en virtud del
presente, incluidas, entre otras, las leyes del Seguro Social, el Seguro de Compensación Laboral Impuestos sobre la
renta, contribuciones o impuestos estatales al seguro de empleo. El Seguro de Responsabilidad Civil y Gorrión
Serrano mantendrá a la “UNIVERSIDAD” indemne contra tales leyes, así como contra todas las reclamaciones de la
Unión por pagos de asistencia social.
It is understood the Gorrión Serrano executes this agreement as an independent contractor and is not an employee
of the “the University of Chicago”, and that Gorrión Serrano shall have the mutual control of the means, method
and details of fulfilling obligations under this contract, except for performance time(s) minimum and maximum
length of the act. Gorrión Serrano agree to perform and discharge all obligations as an independent contractor
under any and all laws, whether existing or in the future, in any way pertaining to the engagement hereunder,
including but not limited to Social Security laws, Workman’s Compensation Insurance, Income Taxes, State
Employment Insurance taxes or contributions. Public Liability Insurance and Gorrión Serrano will hold the “the
University of Chicago” harmless against any such laws as well against all Union claims for welfare payments.

Gorrión Serrano declaran que al cumplir con los términos de este contrato, no están infringiendo los derechos de
propiedad, derechos de autor, derechos de patente o cualquier otro derecho de cualquier otra persona; y si se entabla
una demanda o alguien reclama que cualquier cosa relacionada con la propiedad o la presentación de dicho acto o
apariencia es una infracción de dichos actos, Gorrión Serrano indemnizará a la “UNIVERSIDAD” contra cualquier
pérdida , costo de daños, honorarios de abogado u otra pérdida de cualquier tipo por razón del Representante o
Agente de Gorrión Serrano que permita o permita la presentación del acto o atracción aquí denominada.
Gorrión Serrano represent that in performing under the terms of this contract, they are not infringing on the
property right, copyright, patent right on any other right of anyone else; and if any suit is brought or a claim made
by anyone that anything in conjunction with the ownership or the presentation of said act or appearance is an
infringement on the said acts, Gorrión Serrano will indemnify the “the University of Chicago” against any and all
loss, damage cost, attorney’s fee or other loss whatsoever by reason of Gorrión Serrano Representative or Agent
permitting or allowing the presentation of the act or attraction called herein.
