BASES LEGALES DE PARTICIPACIÓN EN EL SORTEO

(Sorteo Noviembre Nocturno y Ovter Gods en Instagram)

1.- EMPRESA ORGANIZADORA DE LA PROMOCIÓN

La Asociación Noviembre Nocturno identificada con domicilio en Madrid e identificada con el
número 50760142Q y la empresa Ovter Gods con domicilio en Valencia e identificada con el número
18053644R organiza el sorteo (en adelante, “la Promoción”) de ámbito internacional, a desarrollar a
través de Internet, de acuerdo con lo dispuesto en el apartado requisitos de participación.
La finalidad de este sorteo es [regalar una camiseta, una sudadera y una taza a los seguidores de las
marcas].

2.-FECHA DE INICIO Y FECHA DE FINALIZACIÓN

La Promoción se iniciará el [día 15 de febrero de 2020 a las 22.30h], y finalizará el [día 23 de febrero
de 2020 a las 00.00h].

3.- REQUISITOS DE PARTICIPACIÓN Y MECÁNICA DE LA PROMOCIÓN

Los requisitos de participación serán los siguientes:
• Podrán participar aquellas personas de cualquier lugar del mundo y sean mayores de 18 años.

• Sólo podrán participar aquellos Participantes que sean titulares de una cuenta en Instagram.

• Los Participantes deberán seguir a los dos perfiles de las marcas (Noviembre Nocturno y Ovter Gods) y comentar
la publicación de cualquiera de las dos marcas (en una de las dos publicaciones) en la red social Instagram
etiquetando a 1 amigo/a durante el periodo de participación.

• Los Participantes sólo podrán participar con un único perfil de Instagram. Si se detecta que un Participante
participa con varios perfiles de Instagram serán descalificados.

• Aunque los Participantes escriban varios comentarios en una misma publicación, solamente participarán con una
única participación en el sorteo aleatorio.

• La aplicación acumulará menciones y hashtags de un mismo Participante aunque estén en comentarios distintos.

4.- CONDICIONES DE LA PROMOCIÓN Y PREMIOS

Se elegirá al ganador por medio de la plataforma CommentPicker de forma aleatoria. El ganador será
comunicado el 26-febrero-2020
a través de los perfiles sociales de la marca, junto con el certificado de validez del sorteo.
El premio consistirá en una camiseta de la ouija. El premio no se podrá canjear por dinero en
metálico o por cualquier otro premio, ni puede ser objeto de cambio o alteración.
La celebración del sorteo, así como la concesión del premio quedan sujetos a la normativa fiscal
vigente.
5.- DESCALIFICACIONES Y PENALIZACIONES
Si se evidenciase que cualquiera de los Participantes no cumple con los requisitos exigidos en las
Bases, o los datos proporcionados para participar no fueran válidos, su participación se considerará
nula y quedarán automáticamente excluidos de la Promoción perdiendo todo derecho sobre los
premios otorgados en virtud de esta Promoción.

6.- PUBLICACIÓN DE COMENTARIOS U OPINIONES

No se permitirán comentarios u opiniones cuyo contenido se considere inadecuado, que sean
ofensivos, injuriosos o discriminatorios o que pudieran vulnerar derechos de terceros. Tampoco
se permitirán comentarios contra un particular que vulneren los principios de derecho al honor, a
la intimidad personal y familiar y a la propia imagen. No nos responsabilizaremos de los daños
ocasionados por los comentarios que hagan los Participantes en la Promoción, y que en cualquier
momento pudieran herir la sensibilidad de otros Participantes.
La participación en la presente Promoción, así como la publicación de los comentarios que se
realicen por parte de los Participantes en las publicaciones no podrán vulnerar bajo ningún concepto
las Reglas comunitarias de Instagram ni las Condiciones de uso de Instagram.

7.-EXONERACIÓN DE RESPONSABILIDAD
A título enunciativo, pero no limitativo, no nos responsabilizamos de las posibles pérdidas, robos,
retrasos o cualquiera otra circunstancia imputable a terceros que puedan afectar al desarrollo de la
presente Promoción, así como tampoco nos responsabilizamos del uso que haga el Participante
respecto del premio que obtenga de esta Promoción.
No asumimos la responsabilidad en casos de fuerza mayor o caso fortuito que pudieran impedir la
realización de la Promoción o el disfrute total o parcial del premio.

8.- PROTECCIÓN DE DATOS PERSONALES

De conformidad con lo establecido en el Reglamento General de Protección de Datos, cada
participante con la aceptación de estas Bases Legales consiente que sus datos personales sean
incorporados a un fichero, titularidad de ésta, con la finalidad de gestionar el sorteo, así como
difundir y dar publicidad a sus resultados, y tramitar la entrega del premio.
Le informamos que puede ejercer sus derechos de Acceso, Rectificación, Supresión, Oposición,
Limitación del tratamiento, Portabilidad, olvido y a no ser objeto de decisiones individuales
automatizadas mediante el envío de un e-mail a contact@ovtergods.com
o info@noviembrenocturno.es adjuntando una copia del documento de identificación personal.

9.- CAMBIOS Y ACEPTACIÓN

Nos reservamos el derecho de modificar o ampliar estas bases promocionales, en la medida que no
perjudique o menoscabe los derechos de los Participantes en la Promoción.
El mero hecho de participar en el sorteo implica que el Participante acepta totalmente las
condiciones de estas Bases Legales. Asimismo, la participación en un sorteo de esta naturaleza
supone la aceptación de las normas de la red social Instagram a través del cual se desarrolla el
mismo.
10.- LEGISLACIÓN APLICABLE Y JURISDICCIÓN
Estas bases legales se regirán de conformidad con la ley España. Serán competentes para resolver
cualquier reclamación o controversia que pudiera plantearse en relación con la validez, interpretación
o cumplimiento de estas bases los Juzgados y Tribunales de la ciudad de residencia de los
Participantes.

LEGAL BASES OF PARTICIPATION IN THE DRAW

(Noviembre Nocturno and Ovter Gods raffle on Instagram)

1.- ORGANIZING COMPANY OF THE PROMOTION

The association Noviembre Nocturno with domicile in Madrid company and identified with the
number 50760142Q and the company Ovter Gods with domicile in Valencia and identified with the
number 18053644R organize the draw (hereinafter, “the Promotion”) of international scope, to be
developed through the Internet, in accordance with the provisions of the participation requirements
section.
The purpose of this raffle is [to give a t-shirt, a hoodie and a mug to the followers of the brands].

2.-START DATE AND END DATE

The Promotion will begin on [February 15, 2020 at 10:30 p.m.], and will end on [February23, 2020 at
00:00 p.m.].

3.- PARTICIPATION AND MECHANICAL REQUIREMENTS OF THE PROMOTION

The participation requirements will be the following:
• Those persons residing in anywhere in the world and over 18 years of age may participate.

• Only Participants who have an Instagram account may participate.

• Participants must follow to Noviembre Nocturno and Ovter Gods accounts and comment on the publication of any
of the two brands (in one of the two publications) on the Instagram social network by tagging 1 friend during the
participation period.

• Participants can only participate with a single Instagram profile. If it is detected that a Participant participates with
several Instagram profiles, they will be disqualified.

• Even if the Participants write several comments in the same publication, they will only participate with a single
participation in the random drawing.

• The application will accumulate mentions and hashtags of the same Participant even if they are in different comments.
4.- CONDITIONS OF THE PROMOTION AND AWARDS
The winner will be chosen through the CommentPicker platform randomly. The winner will be notified
on February 26, 2020 through the brand’s social profiles, along with the certificate of validity of the
draw.
The prize will consist of an ouija shirt. The prize cannot be exchanged for cash or any other prize, nor
can it be subject to change or alteration.
The holding of the raffle, as well as the awarding of the prize, are subject to current tax regulations.

5.- DISQUALIFICATIONS AND PENALTIES

If it is evidenced that any of the Participants does not comply with the requirements demanded in the
Bases, or the data provided to participate were not valid, their participation will be considered void
and they will be automatically excluded from the Promotion losing all rights over the prizes awarded
under This Promotion.

6.- PUBLICATION OF COMMENTS OR OPINIONS

No comments or opinions whose content is considered inappropriate, that are offensive, injurious or
discriminatory or that could violate the rights of third parties. Nor will comments be allowed against an
individual who violates the principles of the right to honor, personal and family privacy and the image
itself. We will not be responsible for the damages caused by the comments made by the Participants
in the Promotion, and that at any time could hurt the sensitivity of other Participants.
Participation in this Promotion, as well as the publication of the comments made by the Participants
in the publications may not under any circumstances violate the Community Instagram Rules or the
Instagram Conditions of Use.

7.-DISCLAIMER OF LIABILITY
By way of example, but not limitation, we are not responsible for any losses, thefts, delays or any
other circumstance attributable to third parties that may affect the development of this Promotion,
nor are we responsible for the use made by the Participant regarding the prize You get from this
Promotion.
We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the
realization of the Promotion or the total or partial enjoyment of the prize.

8.- PROTECTION OF PERSONAL DATA

In accordance with the provisions of the General Data Protection Regulation, each participant with the
acceptance of these Legal Bases consents that their personal data is incorporated into a file, owned
by it, in order to manage the draw, as well as disseminate and publicize your results, and process the
award ceremony.
We inform you that you can exercise your rights of Access, Rectification, Suppression, Opposition,
Limitation of treatment, Portability, forgetting to no longer be subject to automated individual
decisions by sending an e-mail to contact@ovtergods.com or info@noviembrenocturno.es attaching
in both cases a copy of an identification document.
9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or expand these promotional bases, to the extent that it does not harm
or impair the rights of Participants in the Promotion.
The mere fact of participating in the raffle implies that the Participant fully accepts the conditions of
these Legal Bases. Also, participation in a raffle of this nature implies acceptance of the rules of the
Instagram social network through which it is developed.

10.- APPLICABLE LEGISLATION AND JURISDICTION

These legal bases will be governed in accordance with the Spanish law. The Courts and Tribunals of
the Participants’ city of residence will be competent to resolve any claim or controversy that may arise
in relation to the validity, interpretation or compliance of these bases.
