RESUMEN
Given the status of an anthropocentric human culture, environmental protection has been
facing for a long time, only to see nature as a provider of goods and services to satisfy
human needs; which has allowed the establishment of technical criteria that have
contributed to the use, management and conservation of natural resources based on such
uses. Simultaneously with this premise, it also became necessary to see the environment as
a legally recognized and protected by law, giving specific weight within the defining scale
human rights and categorizing it as a right of third generation. The aim of this contribution
is to reflect on the meaning and importance of some laws for environmental protection in
Venezuela, in which policy development has legislated protectionism and coercive manner.
This reflection was based on a literature review of the regulatory function contribution to
environmental protection and its relationship with the development of a better quality of
life in communities is concluded that it is necessary to perform on-going research to
evaluate the effects generated by enacted legislation aimed at adapting the rules according
to environmental changes without incurring excessive and constant amendments thereto.

Por otro lado, la jurisprudencia reviste una trascendental importancia para el logro
de los objetivos propuestos en la ley en su labor interpretativa, atribuyendo legitimación
activa a cualquier persona (colectivos o difusos), debido a la afectación de un bien común
(interés genérico), en virtud de la aplicación e interpretación de la norma en materia
ambiental, dirigida a la protección y conservación de los recursos naturales, evitando o
mitigando el deterioro de los mismos. Surge entonces la necesidad de establecer una
función permanente de investigación para establecer los efectos que se generan de los
textos sancionados y promulgados para ir adecuando la normativa en función de los
cambios ambientales, sin incurrir en excesivas y constantes modificaciones a los textos
legales y reglamentarios dictados.
