United Nations Migrant Workers Convention

The 1990 United Nations Migrant Workers Convention is the most important international
human rights treaty concerning migrants. It sets out the rights to which all migrant workers
and their family members are entitled.
La Convencin de las Naciones Unidas sobre los Trabajadores Migratorios de 1990 es el
tratado internacional de derechos humanos ms importante en relacin a los migrantes. En
ella se disponen todos los derechos a los que todo trabajador migratorio y sus familiares estn
legitimados.
The Convention was written following two major events in the 1970s. In 1972, Idi Amin, the
ruler of Uganda, forced tens of thousands of Asians living and working in the country to leave,
and the international community was unable to do anything to stop him. This highlighted the
lack of sufficient international human rights law to properly protect migrants. The United
Nations requested a global legal study to be carried out and recommended the drafting of a
treaty setting out the rights of migrants. Around the same time, an oil crisis caused an
economic depression where there was less work available and migrant workers were therefore
more vulnerable to exploitation.
Mexico and Morocco had many citizens who lived in other countries as migrant workers and
out of concern for their citizens, these two countries called for an international treaty on
migrants' rights.

In response, in December 1979, the United Nations General Assembly appointed a group of
people to start drafting a Convention on migrants' rights.

Over a period of ten years, the Member States of the United Nations negotiated over what
rights migrants should have in international law. This was a difficult task, because once rights
are recognised, States have a legal obligation to respect and protect those rights. Finally, on 18
December 1990, a day that is now celebrated as International Migrants Day, the Migrant
Workers Convention was adopted by the United Nations General Assembly.

The Convention is open to ratification by any country. Ratification means that a State agrees
to respect and implement all of the rights contained in the treaty. A group of people called the
Committee on Migrant Workers monitors the behaviour of ratifying States to ensure that they
provide migrants with the rights outlined in the Convention.
La Convencin est abierta a la ratificacin de cualquier pas. La ratificacin significa que un
Estado se compromete a respetar y poner en prctica todos los derechos recogidos en el

The Convention grants rights to all migrant workers and members of their
families, regardless of sex, race, political belief, colour, language, religion, nationality, age,
economic position or marital status. The Convention applies to all the stages of the migration
process, including preparation, departure, and transit to and from the migrants State of
origin.
La Convencin otorga derechos a todos los trabajadores migratorios y miembros de
sus familias, independientemente de su sexo, raza, creencia poltica, color, idioma, religin,
nacionalidad, edad, situacin econmica o estado civil. La Convencin se aplica en todas las

The Convention defines a migrant worker as a person who is to be engaged, is
engaged, or has been engaged in a paid activity in a State of which s/he is not a
citizen. However, the Convention does not apply to all persons working outside of their State
of origin. For example, investors, asylum-seekers, trainees and students are not protected by
the Convention. The Convention also protects migrants in particular categories of
employment defined as follows: La Convencin define al trabajador migratorio como
una persona que vaya a realizar, realice o haya realizado una actividad
remunerada en un Estado del que l/ella no es ciudadano/a. Sin embargo, la

Frontier workers: workers who live in a neighbouring State to which they return at
least once a week.
Seasonal workers: workers who work only during a certain part of the year.
Seafarers: workers who work on board a vessel registered in a State different from
the workers State of origin.
Workers on an offshore installation: workers employed on an offshore
installation in a State that is different from the workers State of origin.
Itinerant workers: workers who live in one State, but have to travel for a short
amount of time to another State for their job.
Project-tied workers: workers who are allowed into a State of employment for a
specific amount of time to work on a specific project.

The term members of a migrant workers family means a person who is married
to a migrant worker, a migrant workers children and other family members who are
supported by a migrant worker. States should promote ways for documented migrant
workers to be joined by members of their family and to protect the rights of a family to
be together. States should also protect the rights of family members following divorce or
the death of a documented migrant worker.
El trmino "miembros de la familia de un trabajador migratorio" se refiere a una
persona que est casada con un trabajador migratorio, los hijos de un trabajador migratorio y
otros miembros de la familia que son mantenidos por un trabajador migratorio. Los Estados

There is a difference between a documented and undocumented migrant. If a
migrant worker is allowed to enter, stay and work in a State by law, they are considered a
documented migrant. If a migrant is not allowed to enter, stay or work in a State in
accordance with the States law, they are considered an undocumented migrant.
Documented migrants have records proving that they are lawfully allowed to be in a State.
Undocumented migrants do not.
Hay una diferencia entre un migrante documentado e indocumentado. Si a un
trabajador migratorio se le permite entrar, quedarse y trabajar en el Estado legalmente, se le
considera un migrante documentado. Si a un migrante no se le permite entrar, permanecer ni

The Convention uses specific terms to define where a migrant is coming from, where the
migrant is working, and the countries that a migrant passes through. Heres a closer look at
the terms used:

State of origin: a migrant workers home country.

State of employment: where the migrant worker was, is or will be working.

State of transit: the country or countries a migrant worker passes through to reach

All migrant workers and members of their families have the right to leave any State.
Documented migrant workers and members of their family have the right to live
and travel freely within their State of employment. These rights can only be restricted for very
serious reasons.
Todos los trabajadores migratorios y miembros de sus familias tienen derecho a
salir libremente de cualquier Estado. Los trabajadores migratorios documentados y
miembros de su familia tienen derecho a vivir y viajar libremente dentro de su Estado de

Migrant workers and members of their family have the right to life. Nobody has the right to
end the life of a migrant worker or that of a member of their family. This also means that
migrant workers and members of their family have the right to be protected by law if their life
is at risk.

derecho de poner fin a la vida de un trabajador migratorio o de cualquier miembro de su

Freedom from Torture Matters! Article 10

Migrant workers and members of their families should never be tortured or subjected to
inhuman or degrading treatment. The term "torture" means the intentional infliction of severe
physical or mental pain or suffering. Torture does not include pain or suffering arising only
from lawful sanctions.
Los trabajadores migratorios y miembros de sus familias nunca deben ser sometidos a tortura
o tratos inhumanos o degradantes. El trmino "tortura" significa la imposicin de dolor fsico

Migrant workers and members of their families should not be owned as property or forced to
work against their will.

Migrant workers and their families are free to hold their own thoughts, beliefs and religion
without fear of being forced to change what they believe in. The only time this right is limited
is if it interferes with the rights or protection of others. States must also respect migrant
workers freedom to provide or not provide their children with a religious and/or moral
education.
Los trabajadores migratorios y sus familias son libres de tener sus propios pensamientos,
creencias y religin sin temor a ser coaccionados u obligados a cambiar aquello en lo que
creen. Solamente se puede limitar este derecho en caso de que interfiera con los derechos o la

Migrant workers and members of their families have the right to their own opinions and to
express these opinions themselves in any way. The only time this right may be restricted is
when it interferes with the rights or protection of others.

Migrant workers and members of their families have the right to have their social, family and
personal life respected. This includes such things as their reputation, personal relationships,
interests, activities and private communication.

Migrant workers and members of their families have the right to own belongings that are kept
for their own use. If their property is taken by a government to be used for public good, the
State must give fair compensation.

If a migrant worker or family member is arrested and charged, they have the right to be
informed in a language they understand of the reasons for the arrest and the charges against
them. They also have a right to consular or diplomatic help from their State of origin in the
case of arrest, detention or trial. If a migrant worker or family member is arrested illegally
they have the right to compensation.
Si un trabajador migratorio o miembro de su familia se encuentra detenido y acusado, tienen
derecho a ser informados sobre los motivos de su detencin y los cargos de los que se les
acusan en un idioma que comprendan. Tambin tienen derecho a ayuda consular o
diplomtica de su Estado de origen en el caso de arresto, detencin o juicio. Si un trabajador
migratorio o familiar de ste es detenido ilegalmente tiene derecho a una indemnizacin.
Rights in Time of Imprisonment & Detention Matter! Article 17

Even when detained, a migrant worker or member of their family should be treated humanely
and their cultural identity should be respected. When detained or imprisoned they should be
treated the same as citizens. If detained for violations of migration law, they should be held
separately from convicted persons and persons in detention pending trial.
Incluso cuando se encuentre detenido, un trabajador migratorio o cualquier miembro de su
familia debe ser tratado humanamente y con respeto a su identidad cultural. En caso de estar
detenidos o encarcelados deben ser tratados de la misma manera que un ciudadano nacional.
Si son detenidos por violacin de las disposiciones sobre migracin, deben estar en locales

Fair Trial Matters! Article 18

If a migrant worker or member of their family is charged with a criminal offence, they have
the right to a fair and public trial and to legal assistance. They are also entitled to the same
protections as citizens of the State. If a migrant worker or member of their family needs an
interpreter, one should be provided for free.
Si un trabajador migratorio o algn miembro de su familia es acusado de un delito, tienen
derecho a un juicio justo y pblico y a disponer de asistencia jurdica. Tambin tienen derecho
a las mismas protecciones que los nacionales del Estado. Si un trabajador migratorio o algn
miembro de su familia necesita un intrprete, se le debe proporcionar de forma gratuita.
Equality Before the Law Matters! Article 19

Migrant workers and members of their families cannot be held guilty of a criminal offence for
doing something that was not, at that time, considered a crime. In giving a sentence for a
criminal offence, the court should always take into account humanitarian considerations
related to the status of migrant workers.
Los trabajadores migratorios y miembros de sus familias no pueden ser considerados
culpables de un acto criminal que en el momento de cometerse no fuera delictivo. Al dictar

una sentencia por un delito penal, el tribunal siempre debe tener en cuenta consideraciones

Freedom from Unlawful Imprisonment Matters! Article 20

Migrant workers and members of their families cannot be imprisoned or forced to leave the
State if they are unable to fulfil a contractual obligation. The protection against being forced to
leave the State does not apply to migrant workers whose work permit or permit of residence is
dependent on fulfilling an obligation in a work contract.
Los trabajadores migratorios y sus familias no pueden ser encarcelados u obligados a salir del
Estado en caso de no poder cumplir una obligacin contractual. La proteccin contra la
obligacin de abandonar el Estado no se aplica a los trabajadores migratorios cuyo permiso de

Personal Documents Matter! Article 21

It is illegal to take, destroy, or attempt to destroy personal documents (e.g. passport, visa or
identity card) belonging to migrant workers or members of their families. Public officials who
are authorized by law are the only persons who can take or destroy personal documents. If
this is the case, a detailed receipt must be provided. The destruction of a passport (or
equivalent document) is never allowed.
Es ilegal confiscar, destruir o intentar destruir documentos personales (por ejemplo,

Group expulsion of migrant workers and members of their families from a State is not
allowed. Each case should be decided individually and in accordance with the law. Migrant
workers must be informed of the decision in writing and in a language they can understand.
Migrant workers and members of their families have the right to explain why they should not
be required to leave a State. In the case that they are required to leave a State, migrant
workers may seek entry to a State other than their State of origin and have the right to receive
wages due to them.

In general, documented migrant workers have the right to freely choose their job. States
should consider giving permission to family members of a documented migrant
worker to work in the State of employment before other workers seeking entry to the State.
The State of employment can limit the right of migrant workers to freely choose their job
when it is in the interests of the State of employment or when a migrant worker's
qualification, education or skills are not recognised by the State of employment. However,
States of employment should try to provide recognition of such qualifications. When migrant
workers permission to work is limited in time, the State of employment may make the right to
freely choose a job subject to two years lawful residence and may limit their access to certain
jobs as part of a policy of favouring citizens and long-term residents.
En general, los trabajadores migratorios documentados tienen el derecho a elegir
libremente su trabajo. Los Estados deben considerar dar permiso a los familiares de un
trabajador migratorio documentado para trabajar en el Estado de empleo antes de

other work and giving them priority over other workers seeking to enter that State.
Itinerant workers: itinerant workers must be granted the rights in Articles 36 to 56
to which they are entitled to because of their presence and work in the territory of the
State of employment.
Specified-employment workers: specified-employment workers are entitled to
the rights in Articles 36 to 56 but with important exceptions concerning Articles 43,
52 and 54.
Project-tied workers: project-tied workers are entitled to the rights in Articles 36
to 56 but with important exceptions concerning Articles 43, 45, and 52 to 55. They
have the right to receive payment in their State of origin or habitual residence.

Self-employed workers: the right to stay of self-employed workers and their

families must not come to an end only because their economic activity has come to an
end, except where the right to stay is dependent upon the specific remunerated
activity for which they were admitted.

and ratified the Convention.

La Convencin de las Naciones Unidas sobre los Trabajadores Migratorios cumplir 25 aos
el 18 de diciembre de 2015. Pero debera el primer cuarto de siglo de este tratado de derechos
humanos estar marcado por el silencio y tratado como una ocasin para la reflexin sombra y
lgubre o se trata en realidad de un 25 aniversario que debera ser celebrado en voz alta y
pblicamente, llamando la atencin de todos?
An evaluation of the Convention on the 25th anniversary of its adoption by the United Nations
certainly provides much food for thought and raises many questions. Why have only 48 States
ratified the Convention so far? Why is the Convention the least popular of the ten core
international human rights instruments? Why has none of the 28 EU Member States ratified
the Convention? Is it the Convention itself that States oppose, or is failure to ratify
symptomatic of a deeper disregard for migrants rights? Is the Convention equipped to deal
with 21st century migration trends? Is it still worth advocating for ratification?
Una evaluacin de la Convencin en el 25 aniversario de su adopcin por las Naciones
Unidas, sin duda ofrece mucho material para reflexionar y plantea muchas preguntas. Por
qu hasta ahora slo 48 estados han ratificado la Convencin? Por qu es esta Convencin la
menos popular de los diez instrumentos internacionales bsicos de derechos humanos? Por
qu ninguno de los 28 Estados Miembros de la UE ha ratificado la Convencin? Los Estados
se oponen a la Convencin en s misma, o es el fracaso de su ratificacin un sntoma de
desprecio profundo hacia los derechos de los migrantes? Est la Convencin capacitada para
hacer frente a las tendencias migratorias del siglo XXI? Sigue valiendo la pena abogar por la
ratificacin?
This last question is easy to answer. Ratification of the Convention, apart from its practical
impact, would be hugely symbolic. By ratifying, a State would be acknowledging the
importance of migrants rights. This in fact provides a reason for celebration. 48 States, nearly
25% of the international community, have ratified the Convention and recognised migrants
rights as human rights. It took 13 years for the Convention to gain the 20 ratifications
necessary for it to enter into force, but during the last 12 years it has gained 28 ratifications. A
conspicuous celebration of 25 years of the Convention highlights not only these achievements,
but also acknowledges the role played by individuals and NGOs in advocating for the

Convention and in using the Convention as a yardstick for measuring the human rights
compliance of national migration laws and policies.
Esta ltima pregunta es fcil de responder. La ratificacin de la Convencin, adems de su
impacto desde un punto de vista prctico, sera tambin enormemente simblica. Al
ratificarla, un Estado estara reconociendo la importancia de los derechos de los migrantes.
De hecho, esto proporciona un motivo de celebracin. 48 Estados, casi el 25% de la
comunidad internacional, han ratificado la Convencin y reconocido los derechos de los
migrantes como derechos humanos. La Convencin tard 13 aos en obtener las 20
ratificaciones necesarias para entrar en vigor, pero durante los ltimos 12 aos ha conseguido
28 ratificaciones ms. Una acentuada celebracin de 25 aos de la Convencin pone de relieve

Perhaps most importantly, a 25th anniversary celebration focuses attention on migrants
themselves and on the fact that they have human rights which, though all too often violated,
deserve respect and protection.

The Convention has been described as the best kept secret in the UN, which may go some way
to explaining the relatively low rate of ratification so far. This, then, is yet another reason why
we should celebrate as loudly and wildly as possible the first 25 years of the Convention we
need to make all States and all people aware of the existence of the most of the existence of the
most comprehensive international treaty in the field of migration and human rights

increase the chances of ratification.
