PROCEDIMIENTO
SUPUESTOS:
- Cuando hay acuerdo sobre el inventario, pero no sobre divisin de los bienes
inventariados (arts. 783-788 LEC). Designar al contador y perito/s
- cuando no hay acuerdo sobre el inventario: (art. 794 LEC): se intentar la
formalizacin del inventario en presencia del Secretario J udicial, si hubiere controversia
sobre la inclusin o exclusin de bienes en el inventario se ir a juicio verbal. El Tribunal
determinar mediante Auto lo que corresponda a la administracin, custodia
yconservacin del caudal
- Si hubiera acuerdo extrajudicial, se convocar a los herederos, legatarios, cnyuge
sobreviviente y a los acreedores a una J unta para que lleguen a un acuerdo para el
nombramiento del contador y de perito/s, si no se designar por sorteo
OPERACIONES DIVISORIAS: (2 meses), se contendrn en escrito
firmado por el contador donde se expresar la relacin de bienes, avalo
y la liquidacin del caudal, divisin y adjudicacin.
