What Is Piracy?

Piracy is the unauthorized duplication of an original recording for commercial gain without the consent of the rights owner. The packaging of pirate copies is different from the original. The problem of piracy has arisen with the rapid advance of technology.

End User Piracy:

Copying the same software onto more than one computer. An individual or company who takes one copy of software and deliberately reproduces it with fake certificates. The Distribution of copyrighted software via the Internet or a bulletin board system. Improper use of a registered trademark.

Introduction:
Copyright is the right given by law to the creators in literary, dramatic, musical and a variety of other works of mind. It ordinarily means the creator alone has the right to make copies of his or her works or alternatively, prevents all others from making such copies. The basic idea behind such protection is the premise that innovations require incentives. Copyright recognizes this need and gives it a legal sanction. Moreover, commercial exploitation of copy right yields income to the creators and thus making pecuniary rewards to individuals creativity.

The scope of copyright is not confined only to the creativity and the economic exploitation in the country. Emerged as a major factor. The first multilateral agreement on copyright is the Berne Convention which was concluded in 1886. The post second world war era saw the emergence of the need for protecting copyright on an universal basis.

Another form of right arising in case of cinematographic works is known as commercial rights. These are for showing movies through cable. By law, that normally cannot be shown in commercial places. Most 5 to 4 star hotels use cable operators to show movies in the hotel rooms etc. This can be as copyright violation from the point of view of commercial right of movies.

Brief About the Film Industry:

India produces the largest no. of feature films in the world. During the years 1931 to 1966, India has produced 27809 feature films in various languages. Hindi Films 29% Tamil Films 18% Telugu Films 17% The total turnover of the film industry during 1996 was about Rs. 2500 crores. There are 12623 cinema houses in India and if we take Rs. 5 per seat on an average it works to be about Rs. 2300 crores.

1. Songs

from different legitimate CDs are copied and put in single CDs. 2. Counterfeiting using the same label and logos. 3. Bootlegging where unauthorized recordings of performance by artist are made and reproduced and sold in market. CD piracy is the greatest threat to todays music world. At present CD market is just 2-3% of the overall music market in the country.

The piracy in computer software means copying and distribution of computer programs without the copyright holders permission. Licensing is a common practice in todays software industry. The publisher of a software generally authorizes its end user through the mechanism of the shrink wrap license contained in the package.

Besides illiteracy & poverty, unemployment can be another economic evil affecting piracy incidents in India. The immediate provocation to do so is influenced by the possibility of making quick and higher returns from less investment & efforts and a feature typical to piracy.

Important factor which may attract unemployed people to piracy field is the laxity in the countries copyright enforcement machinery. The laxity in enforcement is the result of slackness on the part of the enforcement machinery. The police on one hand and the passive attitudes on the part of rightholders on the other.

The lack of infrastructural facilities in India is also expected to influence copyright piracy in some way or the other. The world Competitiveness Year Book 1998, brought out by Lausanne (Switzerland) based IMD has accorded India the last rank in infrastructure among 46 countries whose performance were reviewed in the Year Book.

Conclusion:

The conclusion that emerges is that though social factors like illiteracy, unemployment etc. influence piracy, the phenomenon occurs more because of economic reasons than anything else. For pirates it is an easy way of making quick bucks. For the end users it is a gainful arrangement for buying a variety of info-entertainment products which otherwise remain unaffordable atleast to a vast majority. Basically this win-win situation for pirates and end users keep the piracy alive and active in the society. Other socioeconomic variables like poverty and high prises etc. only add to the degree of problem.
