This states that all Members, even if they have not ratified the
[fundamental] Conventions, have an obligation, arising from the
very fact of membership in the Organization, to respect, to promote
and to realize, in good faith and in accordance with the Constitution,
the principles concerning the fundamental rights which are the
subject of those [fundamentalConventions (ILO, 1999a, p. 51).
In Recommendation No. 91, Paragraph 2,
collective agreements are defined as:
(Convention No. 87, Articles 3 and 10, ILO, 1996b, pp. 528-529). Moreover,
they must not be under the control of employers or employers
organizations
fulfil their purpose of furthering and defending the interests of workers
through collective bargaining,
and must be able to organize their activities without any interference by the
public authorities which would restrict this right or impede the lawful
exercise
