RELEASE I understand and agree that, as a condition for my receiving three (3) days pay under the terms

of the settlement agreement between AFSCME and the Amherst, Pelham and Amherst-Pelham Regional School Committees, I am providing this release wherein I acknowledge, and unconditionally release, acquit and forever discharge the Committees and their former and current officers, employees and agents from, and with respect to, any and all charges, complaints, claims, damages, actions, causes of action, suits, and expenses (including attorneys fees and costs actually incurred) which I now have or which I had or claimed to have against the Committees, their current and former officers, employees and agents arising out or bearing any relation whatsoever to the facts alleged in MUP-11-6288 existing on, up to, and including the date of this Agreement, including, but not limited to, any claims for breach of express or implied contract, all claims for wages, all claims for breach of any express or implied covenant of employment, including the covenant of good faith and fair dealing; all claims for interference with contractual or advantageous relations, whether prospective or existing, as well as any and all claims arising under or based on any state or federal wage law, including without limitation, M.G.L. c. 148, 149 and/or 150E as well as the Fair Labor Standards Act In addition, I agree that I will not disclose or divulge the contents of this Agreement, its terms or the terms of settlement, including the amount of settlement or the fact of settlement to anyone except as required by law. It is agreed that this Confidentiality Agreement will be subject to enforcement in the Superior Court of the Commonwealth of Massachusetts and that the violation of this Confidentiality Agreement may result in damages and/or Court ordered sanctions. The parties agree that there will be no adequate remedy at law for breach of this Confidentiality Agreement and, therefore, the enforcing party will be presumptively entitled to an injunction. In the event that the enforcing party obtains such injunctive relief, I am on notice that if the Committees are successful in seeking the injunction, the successful party will seek damages and attorneys fees. I covenant and agree that I will not promote, encourage, or assist any other person or entity to commence any claims, demand or action against the Committees and their current and former officers, employees and/or agents, or assist in any way in any claim, demand or action against the Committees and their current and former officers, employees or agents where the allegations of such claim, demand or action are similar to the facts alleged in MUP-11-6288. _____________________________________ Witness Date ___________________________________ Printed Name of AFSCME member ___________________________________ Signature of AFSCME member Date
