MEMORANDUM OF UNDERSTANDING BETWEEN Salem-Keizer Education Association And Salem-Keizer Public Schools, Marion County, 24J In response to the

current national, state and local economic crisis and the District revenue challenge, the parties above agree to a memorandum of understanding. Acknowledging the following: The level of revenue available to fund the 2012-2013 economic provisions of the current Collective Bargaining Agreement remains in a state of flux. The Salem-Keizer School District and SKEA, in an effort to work collaboratively, as well as responding positively to the Districts request that the Association share in the burden regarding the ongoing funding problems of the State and the Associations request that the District address the members workload, do hereby agree to the following: A. REDUCTION OF WORK DAYS 1. For the 2012-2013 school year, the work year for bargaining unit members (Article X) shall be reduced by seven (7) days: a. October 12, 2012, statewide in-service day. b. December 19, 20, and 21, 2012. c. January 7 and 8, 2013. d. April 1, 2013. 2. All furlough days will be indicated on all District Calendars as furlough days with the following explanation in the legend: F Furlough day for all staff, due to insufficient funding no school. There will be a joint message from the Associations and the District that will be released to the public regarding the furlough days. 3. By reducing the school year by seven (7) days the District agrees to reduce the amount of work expected of the SKEA members by seven (7) days. This means by reducing six (6) student contact days that the duties associated with those days of student contact will be reduced. 4. Salaries for bargaining unit members (Article IX) shall be reduced pro rata for each day that is reduced, that is, 1/192 per day reduced. Deductions for reduced days shall be taken at an amount

equal to 7 tenths (.7 FTE day) per month for ten months beginning with the September 2012 payroll and ending with the June 2013 payroll. July and August checks will not be affected. 5. All differentials will be computed from the 2012-2013, 192 day Appendix A. 6. The three in-service days at the beginning of the year will be divided into 2 days (or the equivalent hours) of teacher directed work time and one day (or equivalent hours including Job alike or other District required meetings) for principal directed work time. 7. Statewide in-service day: Those who desire to attend in-service on October 12, 2012 may select the classes they attend at their discretion. 8. By November 1, 2012 all schools will conduct a taking stock meeting to assess the work load of their staff, and prioritize and/or eliminate tasks and activities that do not support the Mission of the District or the CSIP. Written minutes will be provided to SKEA and SKSD by December 3, 2012. 9. Eliminate the need for licensed staff to input work sample data required by ODE and DRA and EDL data into the district data warehouse. The District will provide clerical support through IAs for data input. 10. Lesson planning is an expectation of the District. Educators will be allowed flexibility in the lesson plan format they select, provided the plans contain basic elements and are available upon request for supervisory observations. Additionally, the District may direct individual teachers to provide more detailed or specific lesson plans if performance concerns have been clearly identified. 11. During the ten day period for completion of the Elementary Progress Reports schools will eliminate building level required meetings (excluding IEPS and/or emergencies) for teachers grades one through five who need to complete the reports. B. Insurance 1. Two on Contract Salem-Keizer Public Schools will pay the portion of the premium covered by both employees allocated district cap. The following criteria must be met: a) Both employee and spouse (domestic partner) work for Salem-Keizer b) Both employee and spouse (domestic partner) are benefit eligible c) Both benefit eligible employees complete and sign a form enrolling in the Two on Contract benefit arrangement. d) Two on Contract means:

One spouse (domestic partner)/employee declines the medical, dental, and vision enrollments offered through their employment. ii. The other spouse(domestic partner)/employee enrolls all eligible family members in a medical, dental, and/or vision plan offered by OEBB. iii. The family has one set of medical, vision and dental benefits and is not double covered through the District. e) If the employee and/or spouse work part time and receive a pro-rated District contribution, the District will pay up to 100% of the pro-rated contribution for each person. Examples: Employee A works full time: District contribution is $1063 Employee B works half time: District contribution is $531.50 Total District pays toward one premium = $1594.50 Employee A works .75 FTE: District contribution is $797.25 Employee B works .60 FTE: District contribution is $637.00 Total District pays toward one premium = $ 1434.25 Employee A is 1.0 FTE: District Contribution is $1063.00 Employee B is 1.0 FTE: District Contribution is $1063.00 Total District pays toward one premium = $2126.00 f) Any premium amount not covered by the district contribution is paid by the employee. 2. Health Savings Account (HSA): Beginning 10-01-2012, a benefit eligible employee who selects the OEBB high deductible medical insurance plan, and who is eligible to participate in an HSA will be eligible to receive a district contribution to their HSA account. a) For the 2012/13 plan year a contribution of $50 per month will be made by the District to the employees HSA account. b) Employee may also make a contribution to the HSA, pre-tax, up to the maximum allowed by federal regulations. c) This agreement is for the 2012/13 insurance year only. This agreement will be in force from July 1, 2012 until June 30, 2013. If the revenue challenge continues subsequent to June 30, 2013, the parties agree to meet again. _____________________________ On behalf of SKEA ______________________ Date _____________________________ On behalf of the District _______________________ Date
