1 COMPLAINTS AGAINST EMPLOYEES Admin Reg 11-8-84 Revised 9-13-88 Renumbered 2-8-11 The Board of Trustees and the Associations encourage open communication between the home, school and the community. A positive partnership between parents, teachers, community and the administrative and support staff is essential to the educational process. Open and on-going communication among all parties minimizes the opportunities for problems to develop. In the event that concerns are received about an employee of the District, these sequential guidelines shall be followed. If the concern or complaint is filed in such a way that it does not fit into the sequence of these guidelines, the Assistant Superintendent, Personnel, and the WSEA or CSEA President will agree upon a course of action that complies as closely as possible with this policy. In cases where the allegation may require involvement by law enforcement agencies, the Assistant Superintendent, Personnel, may waive or place in abeyance this policy. 1. The concerned person shall attempt to resolve his/her concerns through oral communication with the employee or the employee's immediate supervisor or other local-level designees within a reasonable time. If the concern is not resolved, the immediate supervisor shall meet with the employee to discuss the concern and shall conduct a thorough investigation of the matter. The employee shall have the right to meet with the concerned person and supervisor. At this stage, conferences with various school personnel may be held in an attempt to resolve the concern. If this investigation determines that the allegations are unfounded, the concern shall be disregarded and shall not be a matter of record. If the concern is not resolved at the above level, it becomes a complaint and shall be made in writing by the complainant and given to the employee's immediate supervisor within five (5) school days of the meeting. Under extenuating circumstances, the Superintendent with concurrence of the Association President can waive these time limits. The employee shall be notified and furnished with a copy of this complaint within five (5) school days of the supervisor's receipt of the written complaint. The employee shall have the opportunity to respond in writing within five (5) school days. The supervisor shall prepare and furnish to the employee a summary of the complaint, a summary of the investigation and the action taken. Receipt of the summary shall be acknowledged in writing by the employee. This acknowledgment signifies receipt of the summary only, not necessarily agreement. The summary with the written response shall be reviewed by the employee's evaluator and may be placed in the employee's personnel file, unless the evaluator determines that the allegations are unfounded, in which case the complaint shall be disregarded and not be a matter of record. 6. In the event that the complaint is not resolved to the satisfaction of the complainant, an appeal may be filed with the Superintendent, or his designated Assistant Superintendent, within five (5) school days. The Superintendent, or his designated Assistant Superintendent, shall render a written decision to all parties concerned within ten (10) working days from the filing of the appeal. This decision will be final. In the event that the complaint is not resolved to the satisfaction of the employee, the problem processing or grievance procedure (as outlined in the Master Agreement) may be utilized. This appeal shall include all documentation and reports considered in Steps 1 through 5 above. Should these appeal processes be started, all interested parties will be notified.

WHITTIER UNION HIGH SCHOOL DISTRICT Whittier, California BP 1312.3 UNIFORM COMPLAINT PROCEDURES Board 12-12-06 The Board of Trustees recognizes that the District is primarily responsible for complying with applicable state and federal laws and regulations governing educational programs. The District shall investigate complaints alleging failure to comply with such laws and/or alleging discrimination and shall seek to resolve those complaints in accordance with the District's Uniform Complaint Procedures. (5 CCR 4620) The District shall follow Uniform Complaint Procedures when addressing complaints alleging unlawful discrimination against any protected group as identified under Education Code 200 and 220 and Government Code 11135, including actual or perceived sex, sexual orientation, gender, ethnic group identification, race, ancestry, national origin, religion, color, or mental or physical disability, or age, or on the basis of a person's association with a person or group with one or more of these actual or perceived characteristics in any District program or activity that receives or benefits from state financial assistance. (5 CCR 4610) Uniform Complaint Procedures shall also be used when addressing complaints alleging failure to comply with state and/or federal laws in adult education programs, consolidated categorical aid programs, migrant education, career technical and technical education and career technical and technical training programs, child care and development programs, child nutrition programs, and special education programs. (5 CCR 4610) Complaints related to sufficiency of textbooks or instructional materials, emergency or urgent facilities conditions that pose a threat to the health or safety of students or staff, and teacher vacancies and misassignments shall be investigated pursuant to the District's Williams Uniform Complaint Procedure (AR 1312.4). The Board encourages the early, informal resolution of complaints at the site level whenever possible. The Board acknowledges and respects every individual's right to privacy. Discrimination complaints shall be investigated in a manner that protects the confidentiality of the parties and the integrity of the process. This may include keeping the identity of the complainant confidential, as appropriate and except to the extent necessary to carry out the investigation or proceedings, as determined by the Superintendent or designee, on a case-by-case basis. The Board prohibits any form of retaliation against any complainant in the complaint process, including but not limited to a complainant's filing of a complaint or the reporting of instances of discrimination. Such participation shall not in any way affect the status, grades, or work assignments of the complainant.

WHITTIER UNION HIGH SCHOOL DISTRICT Whittier, California BP 4100 CERTIFICATED PERSONNEL Board 6-13-06 The Governing Board recognizes that teachers and other certificated personnel work closely with students in carrying out the District's educational goals. The Superintendent or designee shall ensure that the duties, responsibilities, and District's expectations for certificated positions are clearly defined and made known to each member of the certificated staff. Each certificated staff member shall be held accountable for duties assigned to him/her and shall undergo regular performance evaluations in accordance with law and negotiated agreements. The Board strongly encourages certificated staff to continually improve their skills and pursue excellence within their profession. Policies, rules and regulations related to certificated personnel shall be available to all concerned and shall be administered in a fair and equitable manner. WHITTIER UNION HIGH SCHOOL DISTRICT Whittier, California AR 4117.4 DISMISSAL - CERTIFICATED Admin Reg 10-1-52 Revised 11-8-94 Renumbered 10-26-10 Permanent Certificated Employees Permanent certificated employees may be dismissed for any one or more of the following reasons as set forth in Section 44932 of the Education Code of the State of California. 1. Immoral or unprofessional conduct. 2. Commission, aiding, or advocating the commission of acts of criminal syndicalism, as prohibited by Chapter 188, Statues of 1919, or in any amendment thereof. 3. Dishonest 4. Incompetency. 5. Evident unfitness for service. 6. Physical or mental condition unfitting the employee to instruct or associate with children. 7. Persistent violation of or refusal to obey the school laws of the state of reasonable regulations prescribed for the government of the public schools by the State Board of Education or by the governing board of the school district employing the employee. 8. Conviction of a felony or of any crime involving moral turpitude. 9. Violation of Education Code Section 51530 or conduct specified in Section 1028 of the Government Code, added by Chapter 1418 of the Statues of 1947. 10. Violation of any provision in Education Code Sections 7001 to 7007, inclusive. 11. Knowing membership by the employee in the Communist Party. 12. Alcoholism or other drug abuse which makes the employee unfit to instruct or associate with children. Permanent employees may also be dismissed due to decreased enrollment in the school system and for other related causes as prescribed in Education Code Sections 44955 and 44956. Substitute Certificated Employees Substitute certificated employees may be dismissed at any time upon action of the Board of Trustees. (Education Code Section 44953)

PROFESSIONAL STANDARDS Board 1-17-06 The Board of Trustees expects District employees to maintain the highest ethical standards, follow district policies and regulations, and abide by state and federal laws. Employee conduct should enhance the integrity of the district and advance the goals of the educational programs. Each employee should make a commitment to acquire the knowledge and skills necessary to fulfill his/her responsibilities and should focus on his/her contribution to the learning and achievement of district students. The Board of Trustees encourages district employees to accept the Five Guiding Principles of Commitment to the Student, Commitment to the Students Parents and Families, Commitment to the Profession, Commitment to Certificated and Classified Colleagues and Commitment to the Business Community.
