Publicada Resolucin que Establece Rgimen Transitorio de la Ley Orgnica que Reserva al Estado las Actividades de Exploracin y Explotacin

En Gaceta Oficial N 39.804, de fecha 21 de noviembre de 2011, fue publicada la Resolucin conjunta de los Ministerios del Poder Popular para la Planificacin Finanzas y para las Industrias Bsicas y Minera, mediante la cual se establecen los mecanismos de aplicacin transitoria del Decreto con Rango, Valor y Fuerza de Ley Orgnica que Reserva al Estado las Actividades de Exploracin y Explotacin de Oro, con respecto al control y fiscalizacin de las regalas y las ventajas especiales previstas en dicho instrumento, as como el rgimen tributario aplicable, hasta tanto se finalice el proceso de migracin y sea organizada y estructurada la Superintendencia Nacional del Oro. De acuerdo al artculo 2 de dicha Resolucin, corresponde a las Inspectoras Fiscales de Minas, Inspectoras Tcnicas Regionales y la Direccin General de Fiscalizacin y Control Minero del Ministerio del Poder Popular para las Industrias Bsicas y Minera, el ejercicio transitorio de las funciones de control y fiscalizacin de las actividades, as como la liquidacin de las regalas y ventajas especiales previstas en el correspondiente Decreto Ley, sin perjuicio del ejercicio de las funciones establecidas en el Reglamento General de la Ley de Minas, y el Reglamento Orgnico del Ministerio de Industrias Bsicas y Minera, de fecha 28 de marzo de 2005. En este sentido, el Ministerio del Poder Popular para las Industrias Bsicas y Minera elaborar los instrumentos necesarios para el cumplimiento de los dispuesto en el artculo 2. La Resolucin entr en vigencia en la fecha de su publicacin en Gaceta Oficial.

Publication of Resolution Establishing the Transitory System of the Master Law that Reserves to the State the Gold Exploration and Exploitation Activities
Joint Resolution of the Ministries of Popular Power for Planning and Finance and for Basic Industries and Mining was published in Official Gazette N39.804 of November 21, 2011, establishing the mechanisms for transitory application of the Decree with Rank, Value and Force of Master Law that Reserves to the State the Activities of Gold Exploration and Exploitation, in relation to the control and audit of the royalties and special advantages set forth in such instrument, as well as the applicable tax system, until completion of the migration process and until the Office of the National Superintendent for Gold is organized and structured. According to Article 2 of such Resolution, the Fiscal Inspectorate for Mines, the Regional Technical Inspectorates, and the General Direction for Mining Control and Audit are responsible for the transitory exercise of the functions of control and audit of the activities, as well as for the settlement of royalties and special advantages set out in the respective Decree Law, without prejudice to the exercise of the functions established in the General Regulations to the Mines Law, and the Master Regulations of the Ministry for Basic Industries and Mining of March 28, 2005. In this regard, the Ministry of Popular Power for Basic Industries and Mining will prepare the instruments necessary for compliance with Article 2. The Resolution became effective from its publication on Official Gazette.
